MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH
TONN COUNCIL HELD AT THE TO ! N HALL ON MONDAY, FEBRUARY
9th, 1948 at 8 P.M.

The meeting was called to order by the President, Mr.Travis.
Minutes of the regular meeting of January 26th , 1948 were read
and upon motion of Mr. Minchcw , seconded by Mr. Bull , were approved.
Mr. Travis recognized the visitors present and Mr. Kcinath asked
about the water rate to be charged at his apartments. It wt s brought
out that the new schedule on rates applied in his case and it would
take no action of Council.
Mr. Merritt reported on the matter of drainage and advised that he
does not think we should do a part of the work but should do the
.chole project if undertaken at all . We will have to borrow the
money if we do the drainage and he does not think that this should
be done until we arc sura that the County will fix the box culverts
immediately when needed . Mr. Mir_chew advised that he did not think
that we should go into debt at the present time ihile we still have
the 425,000.00 seaviall emergency debt to be taken care of. There
was considerable discussion on this drainage nroicct and it was
brought out that the Town ..ould not want to do anything definite on
the matter until right-of-way easements were secured. Mr. Bull ad-
vised that the casements could be taken care of and that he did not
think that we should let a catastrophe stop further improvements in
the town. Mr . Travis stated that he had been on the uouncil for
6 years and during which time drainage had been discussed but noth-
ing done about it, and that he felt that we should take some definite
step toward getting the drainage started. There was further dis-
cussion and upon motion of mr. Minchcw , seconded by Mr . Merritt , the
drainage project was deferred to a future meeting of uouncil. The vote
was Minchcw , Merritt , wi11iams "yes" - Bull "no" .
The Board of Appraisers presented anotlhcr report which was discussed
Ilk at length. It was brought out that if there is any difference in any
quarter in the assessments that that minue someone will bring a
suit into court to establish the validity of the assessment . Upon
motion of Mr. Minchcw, seconded by Mr. Bull , the report was referred
back to the board of Appraisers pending the a;poointment of a third
member of the Appraiser board for the Seawall Emergency work.
Thu Finance Committee reported that they had discussed with the Attor-
ney the matter of a sliding scale on the utility Tax and he advised
that he believed it would be quite legal just so the jump was not too
abrupt. After some discuss on,and upon motion of Mr. Minchow,
seconded by Mr. Merritt , an Ordinance amending Ordinance No. 103 , was
passed on first reading. Upon moi-ion of Mr. Minchcw, seconded by Mr.
Merritt , it was passed on second reading . This amended scale to read
as follows :
"First (15.00 to be taxed at 10%
Second 415.00 to be taxed at 5%
All over 430.00 to be taxed at 1%" .
There was considerable discussion on groins and Mr. Travis advised
411 that some of the property owners were not willing to have groins put
in front of their places unless they could be protected against li ubi lity
by some Urdiitarce or Law. Upon motion of Mr. Merritt, seconded by Mr.
Williams, an Ordinance creating a recreational and safety arca from
the seawall out for 100 feet and p,'ohibiri ng all vehicular travel
therein , was passed on first reading . Upon motion of Mr.Minchew,
seconded by Mr. Merritt , it mus passed or second reading.

Thu Ft ar:cc Committee reported on the watcrwo r ks contract as n rosen-
ted by smith & Gillespie. In the discuss' on, it was brought out
that we will have to have everything ready i-o lot the contract before
we could sell certificates. Also, it appears that there is no de-
ferment clause in the contract end Mr. Merritt was a:sk 1 '-o contact
Smith & Gillespie end sec what could be worked out with them on the
matter of payments as we could like to make a moderate cash pay-
ment and pay the balance later at the sale of the certificates or4111
securities .
upon motion of Mr. Bull , seconded by Mr. Minchew, the wa erworks
Ordinance No. 107 was passed on third and finLl reading, having been
read in its entirety by the clerk.
Mr. Frazier reported that he had contacted various firms for inforn,a -
tion on a water pump. So far, he has only heard from one company,
but expects to have more ioformat- ' on by the next meeting.
Upon motion of Mr. Merritt , seconded by Mr. Minchew , the Treasurer ' s
report was approved. Balances were as follows :

Groin fund 50. 40
Upon motion of Mr. Minchew, seconded by Mr. Willie! P, the following
bills were approved for payment:

A bill from Hubbard & Company covering gloves and timber carriers
which t_ad been charged to personal account of Mr. Bull , was
approved for puymen - upon motion of Mr. Merritt- and seconded by
Mr. Minchew. This bill was made during the Seawall Emergency work.
Upon motion of Mr. Minchew, seconded by Mr. Williams , Brooke G.
White , Jr. was appointed Town Treasurer.
In the contract from the Federal Works Agency co•%eri ng R.A.A. mater-
ials, Mr. Frazier was asked to contact Mr. Brennen -co ascertain what
is meant by the word "place" in the contract. The crane was not
acceptable in its present state of repairs but the Federal Works11
has approved the repairs on same .
Upon motion of Mr. Bull , seconded by Mr. Williams , an Ordinance nam-
ing streets in Section H was pes-ed on first reading . Upon motion of
Mr. Bull , seconded by Mr. Minchew, -i-hc Ordinance was passed on second
reodinL .
The matter of permanent groins on the beach was referred to
the Public Works uommittee for study and recommendation.
Upon motion of Mr. Mi nchcvt , the meeting adjourned.
