COUNCIL HELD AT THE TONN HALL ON 'NEDNESDAY, MAEEH 3rd, 1948
AT 8 P.M.

Upon motion of Mr. Merritt , seconded by Mr. Bull , the regular month-
ly-auceting scheduled for March 8th , was postponed to March 9th.
A discussion was had in reference to the location of the new water-
works system. Mr. Bull was requested to submit to the Town a prop-
osition for land around the 6 -inch artesian well located on the Army
Camp site to be considered at the regular meeting.
The matter of assessments to cover benefits accruing to ocean front
property owners and the public at large by virtue of work done dur-
ing the October storms , was thoroughly discussed and the proposed
preliminary assessments as submitted by the Town Supervisor, was
approved and adopted. The letter prepared to be sent to all
property owners was referred to the Town Attorney for complet; on and
by unanimous consent, the President of the Town Council was authorized
to sign this letter and the Town Clerk to attest it. The preliminary
assessments 1- 11 is hereto attached .
The follow' ng motion was introduced by Mr. Merritt , seconded by Mr.
Williams and unanimously adopted:
" NHEREAS, the Gibbs Corporation , in a letter dated February 26th,
1948 , has withdrawn their account against the Town in the amount
of $113.97 , on the grounds that several of their employees make the
Town their Home and they, themselves , arc very much interested in
the Torn and regret the storm damage very much,
"NOW, THEREFORE BE IT RESOLVED BY THE MAYOR AND TONN COUNCIL OF THE
TONN OF ATLANTIC BEACH , FLORIDA ,
"That , the action of the Gibbs Corooration in this instance , is very
encouraging and greatly appreciated , and
"BE IT FURTHER RESOLVED That the Town Clerk be instructed to furnish
the Gibbs Corporation ai th a copy of this Resolution, which i is
hoped will be received by the said Gibbs Corooration as a token
of the Town's sincerest thanks. "

The Town Supervisor submited a letter signed by Andrew Greig, asking
perm ssion to move a 16 x 16 foot building to the corner of the May-
pert Road and Atlantic Boulevard , said building to be used as a tempor-
ary store room during the construction of new additions to their pre-
sent building. The Build! ng Inspector was authorized to issue a per-
mit to Mr. Grieg from an application stating that this temporary build-
ing will be removed from the premises within 12 months after complet' on
of the new building.
The matter of use of Government loaned equipment for the purpose of
digging a drainage ditch along the right-of-way dedicated to the Town
by the Bull Interests , was thoroughly discussed. Upon motion of Mr.
Nirilams, seconded by Mr. Bull , the following Resolution was cassod:
"WHEREAS, the storms of late Fall , 1947 , continuing on through almost
up to the present date has caused great damage to paving , seawall ,
roads, ditches, septic tanks , foundatons , water lines , etc. in the
Town of Atlantic Beach, Duval County, Florida , and
"NHEFEAS, It is the consensus of opinion that a considerable amount
of this damage con be chargeable to the luck of drain ge and the con-
sequent high water lever throughout the entire Town by virtue of the
failure of the drainage to funct ' on , and
"NHEREAS, the R. C. B. S. Corporation and the Atlantic Beach Holding
Company, have dedicated to the Town, a strip of land running from the
intersection of the Plaza in a northwesterly direction to the tide-
water area west of the Mayport Road for the purpose of digging a
N drainage ditch, and 1� Z
"WHEREAS, the Federal Government has furnished the Town with certain
equipment suitable for use in digging this Canal , and
"WHEREAS, in spite of the fact: that the Federal Government has fur-
nished this equipment because of large expenditures in storm damage
work. the Town is not , at this time , financially able to undertake
a full scale operot' on in connection ith the digging of this
drainage ditch, and
"NHEREAS, it may be possible to arrange with contractors needing fill
dirt to operate some of this machinery at their own expense , thereby
saving the Town considerable monies and at the same time accomplish
the purposes desired,
"NOP, THEREFORE , BE IT RESOLVED BY THE MAYOR AND TO'NN COUNCIL OF THE
TO/iN OF ATLANTIC BEACH , FLORIDA , That official cognizance is taken of
the fact that a high water level has contributed in a great measure
to the damages to the various installations enumerated above and
that a drainage ditch will not only relieve present serious con-
ditions but prevent fature damages to the property in the Town of
Atlantic Beach, and
"BE IT FURTHER RESOLVED, That the Public -"forks Committee be and it
is hereby instructed to prepare a set of rules for the operation of
equipment and the disposal of waste on this project t-o be adopted
by the Council as official rules and regulations , and
"BE IT FURTHER RESOLVED, That the Finance and Taxation Committee
be and it is hereby requested to set rules and regulations pertain-
ing to the finances involved In this operation."
The Town Attorney gave his opinion in reference to contracts with
private individuals for work on this canal by which the private in-
dividuals could use the Government-loaned equipment and keep 7ithin
the purpose intended by the Government in loaning the equipment to the
Town. The Town Supervisor was authorizedarddirccted to negotiate
contracts with any and all persons who might be interested on the
basis of services in return for spoils , these contracts to be worked
out betwo . n the Town Supervisor and the Town Attorney.
