09-13-48 v MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH TOWN COUNCIL
HELD AT THE TOWN HALL ON MONDAY, SEPTEMBER 13th, 1948 at 8 P.M.

The meeting was called to order by the President , Idr. Ganzel,
who called for the reading of minutes.
Upon motion of Mr. Kirby, seconded by Mr. Bremer the minutes
of the re kular meeting of August 23 , 1948 were approved.
The minutes of the adjourned meeting of August 28th, 1948
were approved as read.
The Public hearing on the Re-Zoning of Saltair in line with
notice in Ocean Beach Reporter on August 27, 1948 , certifica-
tion of publication is attached hereto , was called. There being
no objections, the clerk read Ordinance # 116 Amending Zoning
ordinance #50, creating Residence A-1 in Saltair , and defining
the word "enclosed" , and upon motiom of Ivlr. Rawls, seconded
by Mr. Mason this ordinance was passed on 3rd and final reading.
Upon motion of Mr. Mason, seconded by Mr. Bremer, the Town
personnel was retained as follows :
C.R. Frazier, Town Supervisor
J.L. Russell, Town Marshall
Adele S. Grage , Town Clerk and Tax Collector
Brooke G. White , Town Treasurer,
and all other employees approved.
Mr. Mason reported that he had contacted Mr. Crawford relative
to the Town Attorney place , but that he did not give a definite
answer, as he would like to discuss the matter with the Council
as a whole.
There was a discussion as to an auditor, and it was brought out
that we should use tje services of an auditor who lives in the
Town. Upon motion of Mr. Rawls, seconded by Mr. Kirby,Mr. H.L.
Tyson was approved as Auditor, at same fee as last year, with
understanding that it will have a C .P.A. approval. Mr. Mason
was asked to contact IV;r. Tyson.
The Chair next recognized visitors present. Mr. Bowery presented
to the Council the need of improved streets and drainage ditches,
and gave them some literature on equipment that can be used in
such work. The Council expressed their appreciation of his
interest .
Mr. Keyser requested that urgent consideration be given the
speeding on East Coast Urive , as well as muffler cut-outs. There
was considerable discussion of the traffic situation on this
street as well as others in the town, and upon motion of Mr.
Rawls , seconded by Mr. Mason, the matter was referred to the
Police and Public Safety Committee for study and recommendations.
Mr. Scheffler pry: sented to the Council plans and sketch of duplex
1111 he plans to build on the Plaza, and requested permission to build
outside stairs. There was a discussion of the matter, and upon
motion mf Mr. Bremer , seconded by Mr. Mason an Ordinance Amending
Zoning Ordinance #50 by permitting outside stairs , was passed on
1st and second reading.
Lawrence of the Copper Kettle requested Council to make
some adjustment in their Assessment on the Special Seawall
Emergency as he feels it is too high , and advised that they
would like to pay it off by the month, if possible. The Council
advised him that they were going to study the entire Seawall
Emgegency Assessment, and they would advise him as to any action
taken.
The letter to be written to the Ocean Front property owners
relative to repairs was discussed. The following letter was
approved with instructions that it be sent to the property
owners where needed: upon motion of Mr. Bremer, seconded by
Mr. Kirby:
The Atlantic Beach Town Council has taken
• notice of the fact that several property owners
have thus far failed to, in any manner, secure
their seawalls against further damage by storms
and that the condition of the walls not only en-
danger their own property but the property of
others.
It has also been determined that the Town
will not undertake to do any work in the case of
future storm damage ; that repairs now needed, and
such precautionary work as may be found necessary
in case of future storms is the obligation of the
property owners .
An ordinance has been proposed which will
legally require repairs to be made , or new walls
to be built and will provide that in the event of
failure the Town will let contracts for needed re-
pairs and assess the property for the costs.
Particularly in your case the wall in front
of your property cannot be expected to withstand
another severe storm and you are requested to take
necessary steps at once to reasonably secure your
wall.

Ordinance #117 requiring property owners to keep in repair
bulkhead on official bulkhead line was read in full, by Mr.
Ganzel. Mr. Bremer presented some objections which had been
made to him by some of the ocean front property owners who feel
that a third party should be called in when there is a question
of repairs, before any work is done . The chair opened the matter
to the floor for discussion. Mr. Harcourt Bull advised that he
thought there was nothing in the Ordinance that tells what should
be done. George Bull says that every Engineer has a different
opinion as to what should be done, and he feels the Ordinance is
not sufficient. There was considerable discussion on the subject ,
and it was suggested that the Ordinance be amended by adding a
Section which would allow the owner to request a hearing after
he has received his notice to repair, at which hearing he may
present such facts and figures as are pertinent to and substan-
tiating any and all objections he may have to the proposed work.
Upon motion of Mr. Kirby, seconded by Mr. Bremer the Ordinance
was passed on third and final reading including the amended 41/1section as suggested.
Mr. Ganzel presented his thoughts on the Special seawall Emergency
Assessments, then opened the meeting for discussion from the floor.

Mr. George Bull reveiwed the work done during the storm. There
was a general discussion, and upon motion of Mr. Rawls , seconded
by Mr. Bremer, the matter was referred to the Finance & Taxation
Committee for study and recommeddations.
411 Mr. Frazier reported that he had written McCormick, but had not
had a reply.
Mr. Frazier reported that he had gone as far as he could with
repairs at 15th and 16th street on Seawall and Ramp, until
concrete is again available. There is an acute shortage at
this time.
Mr. Mason advised that he had received a phone call from Mr.
Register , but he had not been able to meet Mr. Register at that
time. Mr. Frazier reported that he had seen Mr. Register and
that Mr. Register is working on the Assessments for the 1948
Tax Roll.
Upon motion of Mr. Rawls, seconded by 1'ir. Bremer the Treasurer's
Report was approved. The balances were as follows :

Upon motion of Mr. Bremer, seconded by Mr. Rawls , the following

Insurance policies for renewal were presented and explained
by the Mayor. Upon motion of Mr. Rawls, seconded by Mr.
Bremer the renewals were approved with the exception that
on the trucks it be raised to 4100. deductible, and that the
jeep be removed from the liability collision, as we no longer
have the jeep.
Upon motion of Mr. Mason, seconded by Mr. Bremer,Mr. Frazier
410 was instructed to send the bill for cleaning the school yard
to Mr. Boyd, to-gether with a letter.
The Mayor told of the discontinuance of the colored school in
Atlantic Beach, and expressed his regrets that this step had been
taken by the School Board. Mr. George Bull, advised that he
had taken in the petition of protest, and had talked to Mr.
Harper about the matter , but that they feel it is an economi cal

move at this time. Mr. Rawls moved that the Council go on record
as disapproving of the move by the Commission, this was seconded
by Mr. Bremer and carried.
A Resolution from the A & N Club was read requesting the Town
to relinquish its rights , etc . in the traffic lights on Atlantic
Boulevard. Upon motion of Mr. Bremer, seconded by Mr. Rawls the
following Resolution was adopted:
Whereas, the A & N Business Club has by resolution
requested that the Mayors and Town Councils of the Towns
of Neptune Beach and Atlantic Beach relinquish all rights
in the traffic lights on Atlantic Boulevard to Duval County
and requesting the Board of County Commissioners to here-
after assume ownership and responsibility of the said traffic
lights and
hereas, the lights are necessary for the control of traffic
and the assurance of proper operation can only be had through
one agency,

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND TOWL COUNCIL OF
THE TOWN OF ATLAhTIC BEACH
That, all rights and claim of partial ownership in the said
traffic light be hereby relinquished to the County of Duval
And, be it further resolved that a copy of this resolution be
furnished the A & N Business Club, the Town of Neptune Beach
and the Board of County Commissioners of Duval County.
Application was presented from Charlie Kahn operating as Poor
Boy' s Cabs for a Certificate of Convenience and Necessity to
operate cabs in Atlantic Beach. Upon motion of Mr. Mason,
seconded by Mr. Rawls the certificate was approved subject to
receipt of insurance certificate from him. He is also to
furnish rates to be charged.
Upon motion of Mr. Mason the meeting adjourned from day to day. 410
