COUNCIL HELD AT THE TOWN HALL ON MONDAY, OCTOBER 25, 194$

The meeting was called to order by the President , Mr. Ganzel ,
who called for the reading of the minutes of the last meeting.
Upon motion of Mr. Rawls, seconded by Mr. Mason, the minutes
of the regular meeting of October 11, 194$ were approved as
read.
Mr. Thompson advised that he would work along with the Council
for the time being as Town Attorney.
Mr. Ganzel made public apology to those present for his part
in the argument between he and Mr. George Bull at the last
meeting. This apology was accepted by Nr. Bull.
Mr. Robert Gunn of Gibbs & Co. talked to the Council about
the Caterpillar graders which his Company has for sale . he
advised that he was sorry about the mix-up in information
given on the ages of these machines. One machine is 10 years
old, in very good condition , and the price is 0000. The
other machine , which was out on rentaa when Mr. Frazier was
there , is about 4 years old, same price. He advised that it
could be bought outright , or on a rental-purchase agreement
at X250. per month. After some discussion the matter was
referred .to the Public Works Committee who are to report to
the next meeting.
Pr. Scheffler requested that his water deter be checked, as
he had an excess of over '$7. Mr. Johnson advised that he has
already checked the i .eter and found it to be in order .
There was a discussion of the installation of the new water
pump, and upon motion of Ir. Rawls , seconded by kir. 1$irby
it was decided to install the new pump with the Town pouring
the foundation, setting the anchor bolts, and furnishing all
materials , but to secure the services of suitable person for
the installation of the pump under the supervision of the
Town Supervisor and the Public Works Committee.
It was reported that due to the illness of Er. Wallace Smith
of Smith-Gillespie, Engineers that they would not be able to
attend to-night 's Council meeting with any report on the informa-
tion received from fiscal agents. They expect to be ready for
conferences with some fiscal agents in the next few days.
Mr. Frazier reported on the condition of Mayport Road , and
advised that he had contacted Pair. Gordon Jones , as he could
not get in touch with lir. Sollee. Mr. Jones agreed that the
County would take over immediately and fix the road , but to
date had not, and the Town has continued to put out flambuoys
for safety. Upon motion of Mr. 'Jason, seconded by Mr. Rawls
Sit was decided that Mr. Ganzel with a member mf Council would
see Mr. Sollee.
1' r. Frazier advised that he has a white man at present , but
he is on a temporary day by day extra labor basis .
The matter of lot cleaning was tabled until the spring as it
is too late to do anything about it for this year.
Mr. Mason reported that he does not have a recoruendation at this
time as to the extending of liquor hours as requested by Mr.
Richmond at the last meeting. The liquor dealers were to get
to-gether and give him some figures after an auditor had gone
over some of the books. Mr. Rawls stated that he did not think
the question was as to whether they were making money or not ,
but whether it wa' good for the Town to allow them to stay open
to later hours. The matter was d eferred to the next meeting.
I1r. Bremer pre sented the matter of additional street lights
on the Plaza , ana a general discussion followed as to lights
needed throughout the Town. No action was taken and the matter
will be considered at a later time.
Upon motion of Mir. Bawls , seconded by i'ir. Mason the Chairman of
the Finance & Taxation Committee to-gether with the Presiden t
of the Council shall decide on a place and time for a meeting
of the Council, Citizen's Comr ittee and Tax Assessor to peruse
the Tax Roll in view to making a last minute adjustments.
I.r. Mason advised that most of the assessments were ready, but
they stillave the hotel Reservation, business property, and
Satair toAdone, and that this should be done before a meeting
with Er. register . There was a discussion, and Li—. Bowery, Lr.
Bremer and Mr. Ganzel made arrangements to get to-gether to
take care of some of this.
It was decided that a Waterworks Fund be opened at the Beach Bank
/ and all monies received on water be d eposited therein. Upon
V motion of Mr. Mason, seconded by hr. Rawls the following Resolution
was adopted:
BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF
ATLANTIC BEACH, DUVAL COUNTY, FLORIDA ,
That , a Separate account be opened at the Beach Bank for a
Waterworks Fund , said Fund to have the usual Town Signatures.
Upon motion of Mr. Rawls , seconded by Mrl Bremer the following
were approved for payment :

There was a discussion of the two outstanding notes which are
due during the first part of November. Mr. Mason advised that
he would see Mr. Allen about renewal of the one at the Beach
Bank for , 1000. , and Mr. Bremer will see Dr. Carraway re extension
of his note for $2000. Upon motion of Mr. 3remer, seconded by
Mr. Rawls the following Resolution was passed :
BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH,
DUVAL COUNTY, FLORIDA, That
We, the Town Council of the Town of Atlantic Beach, Florida do
hereby appoint F.P. Ganzel and Adele S. Grage , respectively the
President of the Town Council and the Town Clerk of the said Town ,
our joint attorneys for us and in our name , and stead, to jointly
and in their official capacities , draw, sign and endorse promissuy
note in amount of $1000. for thirty ( 30) days for General Fund;
and do waive demand notice of protest of all such notes.
Giving and gtanting to our said attorneys full power and authority
to do and perform all and every act and thing whatsoever requisite
necessary or proper to be done in and about the premises , as fully
to all intents and purposes , as we acting in an aggregate official
capacity , might or could do ; hereby ratifying and confirming all that
our said attorneys shall lawfully do, or cause to be done by virtue
hereof.
The Tax Collector presented the request of Emerson Jackson and
wife , Ardella that they be allowed Homestead Exemption on the
1946 Tax Roll, as they presented proof that the County had
allowed same , but had failed to send copy of Homestead Exemption
card to the Town. Upon motion of Mr. Mason, seconded by Mr. Bremer
the following Resolution was passed:
WHEREAS , the following property owners signed the necessary
application for 1946 Homestead Exemption with the County, but
copy thereof was not received by the Town of Atlantic Beach, and
WHEREAS , copy in proof thereof has been presented to the Tax
Collector,
NOW THEREFORE BE IT RESOLVED BY THE (MAYOR AND TOWN COUNCIL OF THE
TOWN CF ATLANTIC BEACH , DUVAL COUNTY, FLORIDA , THAT
Homestead Exemption for the year 1946 be allowed to Emerson Jackson
and Ardella on Lots 7 ,$,9,15 and 16, Block 16 Donner' s Subdivision,
Atlantic Beach.
A letter of invitation was read from the Fletcher P-TA to a joint
meeting of the P-TA and Dad's Club on the night of November 8th at
which time the Youth Forum will present the program. Thanks was
expressed for the invitation but regret that that is the regular
meeting time of the Council, and will not be able to attend.
A letter was read from 1,ir. E.P. Owen, Jr. thanking the Council for
their Resolution re :his reconsidering and remaining secretary of
the Florida League of Municipalities.
W.B. Jensen presented a request that Lots 1 and 3 , Block 8, Atlantic
Beach be re-zoned to permit the building of a 3-unit apartment on same .
The matter was discussed and upon motion of Mr. Kirby, seconded by
Mr. Mason an Ordinance entitled "An Ordinance Amending Zoning
Ordinance #50 by changing the Zoning Map on Lots 1 & 3 , Block 8 to
Residence "C" was passed on first reading. Upon motion of Lr. Kirby,
seconded by Mr. Mason it was passed on 2nd reading. The date for the
public hearing on this was set for Monday, November 8th, 194$ at $ P.M. ,
and the building inspector was instructed to so advertise.
A letter was read from Dr. Van Schaick relative to the seawall repairs
he wished to make , and after a discussion and upon motion of mr. Rawls ,
seconded by Mr. Mason the Town Supervisor was instructed to write a
letter to Dr. Van Schaick advising that the Town's portion of the
seawall at this point is in a state of good repair, and therefore he
can go ahe&d with his repairs.
Mr. Brennan of the Federal Works Agency, Bureau of Community Facilities
advised that the epvernment was offering us the ser#6796 International
Dump Truck for 4$60.83 and the Crane truck mounting Quickway Ser#1254
for 43 ,958.25 . The bucket loaned by the Navy must be returned. There
was a discussion of the matter but it was tabled for the time being.
There was a discussion as to the amount of license being charged hotels ,
motels , and tourist courts . The matter was referred to the Laws &
Rules Committee for study and recor:,mendations upon motion of Mr. bawls ,
seconded by Mr. Bremer.
Ganzel read letter addressed to the Town 0 ouncil from Mr. George
Bull in which he detailed the discussion between himself and Mr. Ganzel
at the last meeting. There was a discussion, and upon motion of Mr.
Rawls , seconded by Mr. Bremer i t was decided that since Mr. Lawrence
did not perform, he was deemed to have withdrawn and the agreement was
therefore nullified.
Upon motion of iMIr. Rawls , seconded by Mr. Kirby the. Town Clerk was
instructed to file the letter in the correspondence of the Town and
not make same a part of these minutes.
4111 Upon motion of Mr. Rawls , seconded by mt. Kirby the letter from Mr.
Bull was turned over to the President of the Town Council , who is to
advise of action taken, and a copy of the (resident 's letter to be
placed in the Town files.
Upon motion of Mr. Rawls , the meeting adjourned from day to day.

The members met with the Finance and Taxation Committee to make
further study of the Tax Roll for the current fiscal year. any
items were taken up and fully discussed and then there was a
discussion of the whole matter of taxation for the present year.
The members , being in from day to day session, then convened in
regular session and upon motion of Mr. liason, seconded by lir.
Bremer the Town Clerk and Town supervisor were directed to proceed
with the preparation of the Tax Roll based on full cash value , all
previous resolutions , instructions, and rulings not withstanding.
