MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC
BEACH TOWN COUNCIL HELD AT THE TOWN HALL ON MONDAY,
JANUARY 13TH, 1947, $ P .M.

Upon motion of Mr. Minchew, seconded by Mr. Bull
the minutes of regular meeting of December 9 , 1946 were
approved.
Upon motion of W.E. Williams , Jr. , Seconded by Mr.
Minchew the minutes of the adjourned meeting of December
16th, 1946 were approved.
The fire rates have not yet been settled , and Mr.
Travis advised that he and Mr. Rosborough would get to-
gether and try to have a report for the next meeting.
The Finance and Taxation Committee had no report
as to a donation for advertising as requested by the
Jacksonville Beaches Chamber of Commerce , and action
was therefore deferred.
Mr. Durden's map has not yet been received.
Upon motion of Mr. Bull , seconded by Mr. Williams ,
Mr. Frazier was authorized to contact General Youngberg
relative to concrete steps , and to have him draw plans
and specifications for same if cost not too high. Previous
to this motion , there had been a full discussion of this
matter, and Mr. Frazier was instructed to proceed with plans .
Mr. Frazier reported that he is working on the
7th street ramp.
There being no objections received as to the
change in the Zoning Ordinance to add to Section A 6,
Article 4 to permit certain buildings in Residence "A"
district , upon motion of Mr. Bull , seconded by Mr. Merritt ,
the Ordinahce No. 94 titled "AN Ordinance to Amend Ordinance
Providing for Zoning of the Town of Atlantic Beach , Duval
County, FlIrida, etc" was passed on third and final read-
ing. The vote was as follows : Travis , Merritt , Bull and
Williams "yes" , Minchew "pass".

attached hereto and made a part of these minutes.
The matter of Waterworks came up fur further dis-
cI'ssion, and u, on motion of Mr. Bull , seconded by Mr.
Minchew the Town Attorney was requested to see what is
the status of the suit realtive to rights to streets ,
and who owns what in the streets in Atlantic Beach. This •
suit was Atlantic Beach Holding Co. vs Adams, et al,
File#38232-E. The Attorney was requested to recommend
action , that is as to whether to continue, let rest ,
or start other action.
On Sewerage , Mr. Frazier advised that check had
been received from the Government to cover 1/2 the
Engineering fee , and that Mr. Williamson of Russell
and Axon had been notified. Upon motion of Mr. Bull
seconded by Mr. Minchew the following Resolution was
passed :
BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL
OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA
That the Town Clerk be authorized to open an
account with the Beach Bank in the name of the Town of
Atlantic Beach, Florida- Sewerage Account , and that
the Town Clerk to-gether with the president or vice-
president of the Town Council be designated to sign
the warrants on same.
upon motion of Mr. Merritt, seconded by Mr. Williams
the Treasurer's report was approved. The balances as
of January 1, 1947 were General Fund $4,621.08; Seawall
Fund $1 ,041.34 plus $4500. in Jackaonville Federal Sav-
ings & Loan Assn. and $5000. in the First Federal Savings
& Loan Ass 'n.

Mr. Frazier presented a request from some of the prop-
erty owners along the Mayport Road and Kestner Road that
the Zoning Ordinance be extended , and that same be Zoned.
Upon motion of Mr. Bull, seconded by Mr. Merritt an Ordinance
to Amend the Zoning Map was passed on first reading. Upon
motion of Mr. Bull , seconded by Mr. Williams , it was passed
on second r eading. The Ordinance was then r eferred to the
Laws and Rules Cormittee.
Mr. Frazier's monthly report was presented and filed.

As to the/Reservation Rd. the County Engineer will
replot and get a map rea4y as soon as possible.

Upon motion of Mr. Bull, seconded by Mr. Minchew
the following, resolution on drainage was passed :

WHEREAS, The Town of -'.tlantic r3wach and the territory
izw ediately north and adjacent to the Town,in Duval county,
is growing fast in population and by virtue of this growth
now requires, and in the near future will require, more and
more streets and roads, and
wHERtad, There is now an urgent need for a drainage
program in the Town and in the County area north of the Town
in order that necessary streets and roads can be built
economically and effectively a 3intained thereafter, and
for the #further purposes of protecting existing streets and
roads, such as parts of aalttir Boulevard, Old Sherry Drive ,
the plasm, the Aayport Road and others; elimination of the
mosquito nuisance and other health menaces during the wet
seasons, and
} r.R1 AS, such a program will require considerable study
and work with a probability that the Stat• Legislature may be
called upon for authority to prosecute and finance an
adequate and equitable plan, and
WHERiAB, The County Engineer,neer, acting under proper authority,
has already done sons ground work and made some preliminary study
of this problem, but due to the fact that he now has on hand a
large column of work having priority call on his facilities, has
not been able to assemble sufficient facts upon which to predi-
cate definite action,
NOW, THEREFORE,
BE IT RESOLVED BY THE MAYOR ANS TOWN
COUNCIL OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA:
That the attention of the Board of County Comu issioner,
Duval County, Florida, be called to the above stated facts, and
particularly to the fact that should Legislative action be
found ncessery to carry on a drainage program as indicated
above, the time for such preparation, prior to the meeting
of the State Legislature in April 1947, is limited, and
BE IT FURTHER RES,LVED That it is not the purpose of the
said ;'mayor and Town Council to ask a priority rating for this
project over and above all other matters but due to the lack
of time and the fact that there is sufficient need for the
program that to delay beyond the coming session of the :hate
Legislature might automatitally defer the matter for a period
of two years, the said 4ayor and Town Council do respectfully
requedt that the project be placed ahead of fill other work,
except emergencies and such other programs previously scheduled
as are in need of completion for the sane reasons stated relating
to this proposed program, and

BE IT FURTHsRASOLVJ D THAT the Town Clerk be directed to
furnish a copy of this Resolution to the Hoard of County
Cotrissioners, Hon. W. Howard 33elote, Co a4s*ioner for the
Fifth District, and to the County Engineer.

Mr. Rosborough suggested some charter changes that should
come before the State Legistature at the next meeting. There
was a discussion on this , and upon motion of Mr1. Bull, seconded
by Mr. Williams, it was recommended that anyone with sugges-
tions as to charter changes file same with the Town Clerk or
Town Supervisor by February 1st to be turned over to the Laws
and Rules Committee for action by next meeting, and that all
members of Council read the charter.
Mr. Bull explained the steps necessary to straighten
out the street line on Second Street , and upon motion of Mr.
Bull , seconded by Mr. Williams an Ordinance entitled " An
Ordinance Closing to the Public Usage All That Portion of
Second Street Between East Coast Drive and Sherry Drive that
lies South of the North Side of Block 3 , and across the
North Ten Feet of the Unplated Strip Between Block 3 and
Old Sherry Drive , Etc ." was passed on first reading, Upon
motion of Mr. Bull , seconded by Mr. Minchew it was passed on
second reading. In connection with this matter an affidavit
was presented to the Town from Robert W. Gavin and Barbara
Ann Gavin, owners of Lots 1 & 3 , block 3 in which they request
the Town to deliver to them Quit Claim Deed on the North
10 feet of their lots.
Upon motion of Hr. Bull , the meeting adjourned.
