The letter from lir. Frank Thompson giving his opinion
on Mr. Gurtler's application to construct a number of
dupleA houses in Block 5 was presented. It is ] r. Thompson' s
opinion that the"application must be granted and the permit
issued to him unless the Council shall find and determine
that the construction and maintenance of the structures in
question at the locations in question would be contrary to
the public health, safety, morals , and general welfare of
the community, and that a denial of the permit is indispensa-
ble to the general zoning plan."

The matter was discussed at length, and/upon motion of
Mr. Minchew, seconded by Mr. Bull the meeting adjourned from
day to day until all council members who are in Town can be
gotten to-gether, with a view of meeting Friday night , July 11th,
1947 at $ P.M.

MINUTES OF THE ADJOURNED MEETING OF THE ATLANTIC BEACH TOWN
COUNCIL HELD AT THE TOWN HALL ON FRIDAY, JULY 11TH , 1947 AT
$ P.M.
Present: •

W.E. Williams, Jr. , ( late )
Councilmen;
and
G.L. Rosborough, Mayor
Frank Thompson, Town Attorney
C.R. Frazier , Town Supervisor

ht. Thompson's opinion on issueing the permit on the
Gurtler application was again stated add considerable
discussion insued. Mr. Merritt moved, and it was seconded
by lir. Bull, that Mr. Gurtler be granted permit to build
the buildings in question. On Roll Call the vote was :
Mr. Merritt -"aye"
Mr. Bull -"aye"
Mr. Minchew -"yes"
Mr. Travis - out of town
Mr. Williams- absent
Mr. Thompson advised that a Resolution could be passed to
take care of the Zoning situation for the time being until
a new Ordinance could be passed. Upon motion of Mr. Bull,
seconded by Mr. Merritt the following Resolution was passed:
BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOdN OF ATLANTIC BEACH, FLORIDA, that the
Council does find and determine that it is
necessary tothe public health, morals ,
welfare , safety and convenience of said
Town that the Zoning Ordinance being Ordi-
nance No. 50 as amended by Ordinance No. 83
be amended by changing all those provisions
of said Ordinances which permit under cer-
tain conditions the construction of duplexes
and multiple unit houses in Residence A
District as defined and established by said
Ordinance No. 50 and that pending the further
study by this Council of the character of the
changes necessary to be made in said Ordinance
as amended, that no permit for the construc-
tion of duplexes or other multiple unit
dwellings in said Residence A District be
granted .
Upon motion of 1.1r/ Merritt the meeting /adjourned.
