08-11-47 v 6'a-r-! - MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TOWN HALL ON MONDAY, AUGUST 11, 1947 AT $ P.M. 01. Present : Beale Travis N.A. Minchew W.D. Merritt W.EL Williams, Jr. Harcourt Bull, Jr. , Councilmen and G.L. Rosborough, Mayor Frank Thompson, Town Attorney C.R. Frazier, Town Supervisor Adele S. Grage , Town Clerk The reading of the minutes were deferred until the visitors present could be heard. Mr. O.B. Foster representing Leo Cabs presented his company's appeal for an increase in the minumum rate for a single passenger on phone call to two passenger rate . If it was a pick-up it would still be the one passenger rate , or if more than the one was picked ytp , there would just be the one passenger rate. There was a discussion of the matter following which it was referred to the Laws and Rules Committee for study and recommeddation upon motion of Mr. Minchew, seconded by Mr. Merritt. Mr. Parramore was present to see if Council was ready to report on his request of an outside stair at his house. The Laws and Rules Committee reported that the only way this consent could be given was to change the Zoning Ordinance and they do not feel that this should be done. After further discussion, Mr. Minchew moved, with second by Mr. Williams , that the application to build the outside stairs by Jr.• Parra- more be denied. This was carried. Mr. Leedy of Leedy, Wheeler, and Alleman & Associates of Orlando , Florida, Investment Dealers, introduced himself , • and advised the Council that he wanted to talk to them rela- tive to the financing on our proposed Sewerage Project . He advised that sewerage financing was comparatively new in Florida, and that his firm had haddled about 90% of such financing in the state. He advised that he was ready to present his proposal to the Council whenever they wished. There lit was some discussion, and he advised that he would like to bring Mr. Smith, who is with his firm, to discuss the details with the Council. It was, therefore, decided to have an adjourned meeting on Friday night , August 15th, 1947 at $ P .M. for conference with Mr. Leedy and Mr. Smith. The minutes of the regular meeting of July 14, 1947 were read, and on motion of Mr. Bull, seconded by Mr. Minchew they were approved. Upon motion of Mr. Bull, seconded by Er. Williams , the minutes of the adjourned meeting of July 11, 1947 were approved as read. Minutes of the Special Meeting of August 4th, 1947 were approved as read on motion of Mr. Williams , seconded by Mr. Bull. Mr. Frazier reported that Mr. Register had phoned that he would be at the Beach after August 10th, and would act as Tax Assessor for 1947 Tax Roll. (3.611r No report on the 7th Street Ramp for this meeting as the re-inforcement steel has not been received. The Public Works Committee reported that they have no recommendations for changes in the Garbage Collection Fees. This matter was referred to them after request from the Calcinator representative for information as to possible reductions, if a calcinator was purchased. Er. Merritt , Chairman of the Finance and Taxation Committee, reported that his committee had written the Town of Neptune Beach in reply to their letter of July 29th, 1947 relative to charges on sewer service. This letter of reply was read and upon motion of iir. Williams, seconded by Iqr. Minchew the report of the committee was approved, and copies of both letters are to be made a psrt of these minutes. Copies of the letters are therefore attached hereto: COPY 41111 Town of Neptune Beach Neptune Beach, Florida July 29, 1947 Town of Atlantic Beach Atlantic Beach, Florida Gentlemen: I have been directed by the Town Council of Neptune Beach, Florida, to advise you and every user of sewer service in Atlantic Beach being furnished by the Town of Neptune Beach as follows: According to our records the sum of 4,552.50 is now a! due and payable to the Town of Neptune Beach for sewer. service being furnished to Atlantic Beach by Neptune Beach. Although such service has been furnished for many months last past , no payment on account has been received by Neptune Beach and payment is long past due. Unless , therefore , payment of all amounts due are received on or before August 10, 1947, such sewer service shall be discontinued. Kindly govern yourselves accordingly. (Signed) Mary A. Beach, Florida Gentlemen: this is in reply to your letter of July 29th, 1947 which was concerned with the fees pertaining to the sewer connection the Town of Atlantic Beach has made with your sewer system. Until the recent appearance in one of the local papers of an item on this subject , and then upon receipt of the above mentioned letter several days later, the Town Council of the Town of Atlantic Beach was proceeding under the assumption that this matter was being satisfactorily handled in accordance with previously agreed plans. It was indeed a surprise to find that this assumption was erroneous. Our actions in this matter have been governed by the following facts. After various verbal, tentative plans for the proposed sewer connections had been arranged by the Town Supervisor of the Town of Atlantic Beach with several of your officials , on March 12 , 1946 a letter was sent to your councilman, Ir. H. B. Lighty by our Town supervisor. This letter stated the manner in which the sewer connections would be made and also outlined a plan of operation. According to this plan, the connection charges were to be decided upon later, and that the sewer rental fees would be controlled by a proposed Ordinance of the 'Town of Atlantic Beach. Soon afterword, .the Town of Atlantic Beach received a letter from Lir. Henry Boyer, President of your Town Council. This letter was dated April 2 , 1946 and read as follows : "Replying to your recent letter with reference to the proposed rates for sewerage disposal for certain of your taxpayers , please be advised that at a recent meeting held by our Town Council, we decided to leave the matter entirely at the discretion of your Council, both as to the manner of collection and the rates charged, feeling certain that you would be fair both to our Town and to your own taxpayers. Consider this letter your authority to commence work immediately." With Mri,Boyer's letter in mind, our Town Council passed the following Ordinance on June 4, 1946: Pas COPY To: Town of Neptune Beach, Fla. Page 2 "Sec. 3 (b) An annual service charge for each said unit of not more than 410.00, exact amount to be set from time to time by Resolution of Council, payable in advance on the first day of July in each year; provided, that where any unit is connected with such facilities for less than a full yearly period, the charge for such period shall be reduced proportionately." Because of the scarcity of suitable materials these sewer conn- ections were , by necessity, slowly completed. When this project was about completed our Town Supervisor met with your Supervisor of Operations to consider a more equitable basis upon which the annual sewer rentals could be established. Of course you are aware of the fact that it is very difficult to set such a fee when the citizens concerned are served by three different and distinct water supplies , some of whichare metered while some are not . Our Town Supervisor suggested the installation of a sewerage meter which would accurately measure the volume flow your sewer system was receiving from Atlantic Beach. Later, i,ir. C . R. Frazier, Town Supervisor fo the Town of Atlantic Beach received a letter from iir. henry Boyer, President of your Town Council. This letter, dated April 24, 1947, suggested that the citizens of Atlantic Beach who were discharging sewage into your sewer system be charged a fee the same as the present Neptune Beach water rate. Other suggestions included concerned: 1. The retention by Atlantic Beach of 33 1/3% of the monies collected for each connection until the total expenditures or costs for the installation were collected. 2. The furnishing to Neptune Beach by Atlantic Beach a list of connections nade with the total cost of the connections. 3. The request to make no further connections at 1st Street and Atlantic Blvd. without approval from the Town of Neptune Beach. 4. The assessment fees to be used at other future connections. With Mr. Boyer's letter of April 2, 1946 as the authority and since the Town of Neptune Beach had not notified the Town of Atlantic Beach that its sewer collection plan was not satisfactory, Atlantic Beach proceeded to collect and issue receipts for the sewer service as set forth in its Ordinance of June 4, 1946. These collections are to the amount of Two Hundred and Twenty Dollars ($220.00) . Enclosed, herewith, is our warrant made out for this amounty COPY145c 5 To: Town of Neptune Beach, Fla. Page 3 It is the sincere desire of the Town of Atlantic Beach to operate co-operatively and harmoniously with the Town of Neptune Beach. This fact , we believe , is clearly shown in past acts of co-operation. For instance , the customary license fee required of utilities supplying water service in Atlantic Beach has never been asked of Neptune Beach during the twelve years it has been serving its Atlantic Beach customers. Also, no charges were made when the Town of Neptune Beach used a pumping unit owned by Atlantic Beach during an extended break-down in Neptune Beach's sewer system. He advised that copies were given to the press , but it did not get in Ocean Beach Reporter for last week. Mr. Minchew also reported on the letter written by his , committee in reply to Neptune Beach' s letter of July 29 ,1947 relative to Charge for fire calls. Mayor and City Council City of Jacksonville Beach Jacksonville Beach, Florida Gentlemen: As you gentlemen know, the Town of Atlantic Beach is now paying to tthe City of Jacksonville Beach the sum of $30.00 per month for taking calls at your police department and relaying them over the police radio to our Town Marshall when the people of Atlantic Beach are unable to locate our Marshall at our Town Hall. This is, of course, a service of value to us. However, we believe,we, through our Town Marshall, offer suffic- ient service and standby service to warrant your honorable body and City to offset this charge to the Town of Atlantic Beach. Naturally, our police car has a radio and through its use our i( Marshall has co-operated with your police department many times in the apprehension of criminals heading North who had eluded capture by your police. Our officer stands ready to assist your police department any way possible in the future through the use of the radio. In view of the mutual assistance rendered through this medium, we respectfully request you gentlemen to discontinue this monthly charge if you can possibly see your way clear to do so. Minchew Chariman, Police and Public Safety Committee MkMQ/m COPY Page 2- Mr. Mnrman Mi nncom • = A COPY City of Jacksonville Beach Jacksonville Beach, Florida July 21, 1946 Honorable Norman Ninchew Chairman, Police and Public Safety Committee , Town of Atlantic Beach, Florida Dear Mr. Minchew: In reply to your letter of June 30th , 1947 relative to the Town of Atlantic Beach not wishing to pay to the City of Jacksonville Beach the sum of $30.00 per monti for taking calls at our Police Department and relaying them over the police radio to your town marshall when the prople of Atlantic Beach are unable to locate your marshall at your town hall. We wish to give you the following information on the services rendered; from the period of July 1 t, 1946 to June 30th 1947, our Police Radio Station dispatched 6916 calls to your police car for various services. During this same period, we only dispatched 3700 calls to the Constable's car, and to our own radio cars which number four, there was an average of 4.400 calls per car. You will note from this information, that the Atlantic Beach car received a great number more calls than our own police department , and also than the constable's car. Further analysis shows that of the seven cars working from our Police Radio Station, over 1/3 of the calls were handled to your car No. 20, or an average of over 650 per month (approximately 22 calls in 24 hours. ) . According to our records, it costs the City of Jack- sonville Beach $500.00 per month to maintain this radio service , and with the servicing of seven automobiles , this is an average maintenace cost of $71.00 per month. The City of Jacksonville Beach Public Safety Committee met with Chief Seymour, and as to valuable services rendered your police department , we quote Chief Seymour as follows: "as to the valuable service they are giving to Jacksonville Beach, I have not noticed it , but know that the Jacksonville Beach police have been very valuable to Atlantic Beach by assisting them in calls for them as you will note by our daily log report" . ys M ti4 r. st COPY �card�.a Page 2- Mr. Norman Minchew July 21, 1947 After giving you the above facts and figures, if the Town of Atlantic Beach is desirous of discontinuing the pay- ment to the City of Jacksonville Beach of $30.00 per month for this police service, it will meet with our approval, and the service will be discontinued. Our Police Officer has always co- operated with your Police department when called upon to do so and will continue to do so in the future. The matter of doing away with this monthly charge for this ser- vice was never considered by us until it was suggested to one of our officials by one of the members of the City Council of the City of Jacksonville Beach. With this suggestion, and nothing to lose by asking, our letter of June 30, 1947 was directed to you for your consideration. We shall be very glad to see that the regular remittance each and every month will be forthcoming with the usual promptness as in the past. COPY r Town of Neptune Beach-page 2. • The purchase of the new fire truck has meant a considerable saving in fire insurance premiums to the citizens of Neptune Beach, and it has been assumed by many that the citizens of Atlantic Beach are enjoying the same saving. However, for the most of us in Atlantic Beach, it has meant a saving of only .10¢ for each $1,000.00 of fire insurance written. We feel that since it is necessary that the fire fighting equipment presently stationed in Neptune Beach be maintained for the citizens of Neptune Beach to continue to receive their savings in insurance premiums , and that inasmuch as the large majority of our citizens in Atlantic Beach enjoy virtually no savings from the addition of the extra equip- ment , our arrangements with the Volunteer fire department is a most equitable one. Williams, Jr. �- (Signed) Bel Travis COPY TOWN OF ATLANTIC BEACH, FLORIDA August 6, 1947 Town of Neptune Beach Neptune Beach, Florida Gentlemen: This will acknowledge receipt of your letter of July 29, 1947 concerning your actions in making an annual charge of $1,$00.00 against the Town of Atlantic Beach to cover the cost of fire protection rendered by the Neptune Beach fire department. You can well imagine our amazement at first having seen this letter in the press without having received any communication from you, either oral or written, regarding this matter. For your information, we have always been under the impression that the fire fighting equipment stationed in Neptune Beach is the property of the Neptune Beach Volunteer Fire Department , and your letter of the above date is the first intimation we have ever had that it belongs to the Town of Neptune Beach. Several months ago, the Chairman of this committee was dele- gated by the Town Council of Atlantic Beach to make arrange- ments with the Volunteer Fire department for fire protection in the Town of Atlantic Beach. After nuL.erous conferences, we agreed that the Town of Atlantic Beach would make a dona- tion from its Treasury in the amount of 4300.00, which was done, and further pay the sum of $60.00 for each call made in Atlantic Beach. This has also been done. In addition to this donation by the Town of Atlantic Beach, we know of dona- tions by citizens of Atlantic Beach in an amount between $400.00 and $500.00 that was turned over to the Volunteer fire department. Individual members of the Fire dpPartment made further solicitations from the citizens of Atlantic Beach and we, of course , have no way of knowing how much more money was raised by them. At one of our Council meetings in Atlantic Beach, we proposed that the Volunteer fire department by incorporated and Atlantic Beach and Neptune Beach be issued assessable stock on a pro- rata basis of the number of building units in each Town and hence forth the Volunteer fire department make assessments against each Municipality for the maintenance of the equipment plus any deficit on the purchase price of the new truck not raised by subscription. After their consideration of this proposition, we were advised they couldn't do so and maintain Neptune Beach's reduction in their fire insurance rates. © 7r3 Mr. Frazier reported that hd had executed the Forms for the final payment by the Federal Works Agency on the loan For Sewerage Project .Engineering. There has hardly been enough time for the funds to be received. Mr. Bull reported on a letter received from lair. Joe Williamson of Russell & Axon giving the information requested. Upon motion of Mr. Merritt , seconded by Mr. Bull payment of the $2950. when received was approved. I'ir. Frazier was asked to forward the warrant with a letter to Russdll and Axon advising them that we recognize the balance due them, and have every reason to anticipate funds being available for payment of entire balance by January 1, 1948. Ordinance No. 97 covering location of Garbage Cans was passed on third and final reading upon motion of Mr. Bull, seconded by Mr. Merritt . The request of Perry 0. Drawdy for Homestead Exemption, due to the fact that they have lived in their place for over two years and w ere living there on Jan. 1, 1947, but thru some technicallity in re :the recording of the deed the County refused homestead exemption. MrnMinchew moved that homestead exemption for 1947 be allowed on this , it was seconded by Mr. Williagis , but on the vote Mr. Bull and Merritt adstained from voting, so the chair declared the motion "not carried" .
