TOWN COUNCIL HELD AT THE TOWN HALL ON OCTOBER 28, 1947
AT 7:30 P.M.

In the absence of Messrs. Travis and. Minchew,
Mr. Merritt vas unanimously elected to act as President
of the Council for this meeting.
The matter of the waterworks purchase contract
was discussed in re: the collection of outstanding water
bills unpaid on Jan. 1, 1948. Upon motion of Mr. Bull
seconded by Mr. Williams the following Resolution was
passed, and rescinds the resolution passed at the last
meeting:
RESOLUTION OF TOWN COUNCIL - TOWN OF ATLANTIC BEACH,
FLORIDA.
WHEREAS, the Town of Atlantic Beach,
Florida, has, by Conditional Sale Agreement,
dated October 18, 1947, purchased from E. G.
Adams, the water system now owned and operated
by the latter in this Town, and
WHEREAS, the said E. G. Adams has agreed
to continue operation of the water system until
December 31, 1947, and is entitled to the net
revenues produced from such operation, and
WHEREAS, the physical facililies and the
easements and rights have been turned over to
the Town of Atlantic Beach, simultaneously with
the execution of said agreement, and
WHEREAS, in and by paragraph 12 of said
agreement, the said net revenues are reserved
to said E. G. Adams, and it was understood
between the parties that the Town of Atlantic
Beach would undertake the collection of all
accounts due and unpaid to the said E. G. Adams
on and after December 31, 1947, and
WHEREAS, there has been some doubt ex-
pressed as to whether the obligation of the City
to make such collections is adequately expressed
in said paragraph 12,
NOW THEREFORE, BE IT RESOLVED by the Town
Council of the Town of Atlantic Beach that this
body recognizes that it has the duty and obliga-
tion under said paragraph 12 of said Conditional
Sale Agreement, to make every reasonable effort
to collect all water revenues which shall be due
and unpaid to the said E. G. Adams on or after
December 31, 1947, and this body agrees that
it will, among other things, and as a final
effort to make such collections, discontinue
service to any customer or account failing to
make such payments.

Upon motion of Mr. Bull , seconded by Mr. Williams , Ordi-
nance #103 entitled "AN ORDINANCE Imposing and Levying A
Tax On Each and Every Purchase Cf Electricity , Metered
Or Bottled Gas (Natural , Liquified Petroleum Gas or Manu-
factured) , Within The Corporate Limits of the Town of
Atlantic Beach: Providing for the Collection Of Such Tax;
Providing That In Every Case The Tax Shall Be Collected
From The Purchaser Ind Paid By The Purchaser For The Use
Of Said Town To The Seller Of Such. Utility Service At The
Time Of PayEng The Charge Therefbr :To The Seller; And
Providing Pcnralties For The Violation Of This Ordinance'"
was passed. on third and f ibel reading. Insertion In Section
7 , fine of not more than X500. or imprisonment for not
more than 90 cie.ys; and in Section 10, the effective date
to be on or after October 28, 1947 . The call vote on this
was Bull, Williams and Merritt "eye" ; Travis and Miechcw
"abse!-it" . Mr. Full reported that Mr. Travis, though
absent , had recuested that the minutes show that he was
in favor of this Ordinance .
Mr. Johnson appeared before the Council relative tc the
assessment on his house. Upon motion of Mr. Bull , seconded
by Mr. Williams, the following Resolution was passed:
That an error having been made in transferring figures
on Et of Lot 4, Block 16 to the 1947 Tax Roll ,
POW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF ATLANTIC BEACH?
That the assessment be corrected to read Real Estate p750.
and Improvements $3300.

Upon motion of Mr. Bull, seconded by ?1r. Williams, the Tax
Collector was instructed to ask the Tax Assessor to make
a study of the assessments in Block 16 when making up the
1948 Tax Roll.
