07-14-42 v MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL SCHEDULED FOR JULY 14, 1942, HELD JULY 21 , 1942 AT THE TOWN HALL AT 8 P. M. 41, Because of a lack of a quorum the meeting was adjourned on July 14th from day to day until July 21, 1942 when the following members were present. H. G. Isaacs Fred C . Allen E. L. Chiasson James A. Cranford The Mayor and Mr. C. C . Howell , Sr. representing the Town Attorney. The clerk read the minutes of the regular monthly meeting of June 9th, which were approved as read. The Town Treasurer did not submit his usual monthly financial report due to a misunderstanding of the time of the Council Meeting. • Upon motion of Mr. Allen, seconded by Mr. Cranford, the following bills were approved and ordered paid. 411 Mason Lumber and Supply Company $ 59.61 T. Wellington 10.00 $ 190.30 Mr. Howell reported on the case of Grice vs. Town of Atlantic Beach and asked permission to employ John 0. Jackson, Engineer, for the purpose of making a plat of the 10th Street and East Coast Drive Intersection. Upon motion of Mr. Cranford , seconded by Mr. Allen, 411 the Town Attorney was authorized to expend up to $25.00 for this purpose. The question of tenants in the servant ' s quarters owned by Mrs. J. A. Reid and Mrs. G. A. Pritchard was discussed. The Clerk read a letter addressed to these persons calling upon them for a sworn Certificate of Occupancy and advised that neither had filed such an affidavit but that Mrs. Pritchard had filed a letter. The letter was read. The matter was passed until later. The question of funds on hand in the Seawall account was discussed. The Clerk advised that a Representative of the RFC in Atlanta had called over long distance telephone in reference to this matter and had advised that if the funds now on had were immediately forwarded to RFC in Atlanta interest on the Seawall Bonds equivalent to the amount of money tendered would be stopped. The matter was discussed further and Mr. Cranford moved that a check be sent to the RFC covering the total funds now on hand to be applied to the RFC four maturities of principal. This resolution was seconded by Mr. Chiasson and unanimously adopted. A discussion was had in reference to the Attorney' s fee in the Adams seawall case. Mr. Allen expressed his opinion that the bill was too high and recommended that it not be approved until a full membership of the Council could be present. OF The question of whether or not any of the principal Seawall fund could be converted to the attorney' s fee was thoroughly discussed and this matter was passed for a ruling by the RFC. Mr. Howell being requested to write them explaining the situation. Upon motion of Mr. Chiasson, seconded by Mr. Cranford $1200.00 on account of the Attorney' s fee was ordered paid to Mr. Howell . This payment not to be binding in a final settlement of the fee. Mr. Chiasson, Mr. Cranford, and Mr. Isacs voted for payment of $1200.00 at this time and Mr. Allen voted "no." Mr . Howell submitted the Town' s Attorney' s bill in the Adams' Tax Suit before the supreme court. This bill amounting to $250.00, plus expenses and cost, making a total of $377.76. Mr. Cranford moved and Mr. Chiasson seconded that this bill be paid. Mr. Cranford, Mr. Chasson and Mr. Iasses voted for the Resolution and Mr. Allen answered "Present and not voting." Upon motion of Mr. Allen, seconded by Mr. Chiasson, the fee of Albion X. Knight , Special Master in the Adams' Seawall case, 1101 was approved and ordered paid. This bill was divided between the Town and Mr. Adams. Mr. Adams having already tendered his part to the Town so that the total amount of. the Tarrant should be $150.00. Mr. Howell reported in reference to the final tax Suit brought by Mr. N. H. Adams. He stated that the Attorney for Mr. Adams had instituted this suit primarily for the purpose of testing the constitutionality of the amendment to the Charter providing for unlimited tax mileage ; that the attorney for Mr. Adams- stated that after looking into the matter that he was fully convinced thrit there was no grounds for such a suit and that the amendment is constitutional and therefore is willing to terminate the suit, pay the cost and additional tax withheld amounting to u'300.00. The Mayor then made inquiry in reference to the Attorney's fee in the case of Grice vs . The Town, suggesting that a fee be arrived at in this case. The matter was temporarily passed. The City Supervisor explained in detail in reference to the 1110 survey being made to determine the amount of housing- facilities that might be available in Atlantic Beach for lease to the Government to house an Officer's Training School. He explained that he had been asked to enter into this- survey by the Mayor and City Manager of Jacksonville Beach; that the survey is progressing satisfactorily and that many of the large ocean front homes are available for lease.
