01-14-41 v MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT TH3 T06YN HALL AT 8 P. M. JANUARY 14, 1941. Present: E. L. Chiasson J. C. Outler Harcourt Bull , Jr. The Mayor, Mr. G. L. Rosborough, and Town Attorney, Mr. C. U. Howell, Jr. , were also present. Mr. Chiasson, as Vice-President, was in the Chair. The Clerk read the minutes of the regular meeting held December 10, 1940, which were approved as read. The Chair after a short statement praising the services of Mr. Geo. H. Smith and reciting that to fill Mr. Smith' s place on the Council would be difficult for anyone, declared nominations in order for a successor to Mr. Smith on the Council. Mr. Outler nominated Fred C . Allen to serve the unexpir- ed term of Councilman Geo. H. Smith, resigned. Mr. Bull seconded the nomination and all three members voted for the election of Mr. Allen. The Mayor was asked to notify Mr. Allen of his election to the vacancy on the Council and the Council recessed until the arrival of Mr. Allen. Fred C. Allen was sworn in as a member of the Council to serve the unexpired term of Geo. H. Smith, and immediately took his seat on the Council. Mr. Chiasson, President Pro Tem, asked that some member be chosen as President for the balance of Mr. Geo. H. Smith's term. Mr. Bull nominated Mr. Isaacs as President, which nomination was seconded by Mr. Outler, and Mr. Isaacs was elect- ed President.of the council. Mr. Cranford, Treasurer, submitted his usual monthly financial report, which, upon motion of Mr. Outler, seconded by Mr. Bull was approved and ordered filed. Upon motion of Mr. Outler, seconded by Mr. Bull , the following bills were approved and ordered paid: Jack Spottswood 127.00 N. A. Reifsnyder 2.50 Shell Oil Company 16.83 The Texas Company 17 .72 mason Lumber and Supply Co. 43.07 Joe Robbins 16.93 Southern Bell Telephone Co. 9.40 Dickinson' s Hardware 6.00 Wilkerson-Martin Company 1 .70 Atlantic Beach P. T. A. 10.00 ter. Bull introduced the following Resolution, which was seconded by Mr. Outler and unanimously adopted: BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA, that • The Resolution passed by the Town Council on October 1st , 1940, authorizing the signing of warrants to cover disuursements by the Town Treasurer be , and the same is hereby amended by striking the name of George H. Smith as President and substituting therefor the name of Henry G. Isaacs es President , and BE IT FURTHER RESOLVED that a certified copy of this Resolution, bearing the true and correct signature of Henry U. Isaacs , as shown herein, be forwarded to the Atlantic National Bank of Jacksonville, Florida. A discussion was had in reference to the bills of Mason Lumber and Supply Company, Farquhar Machine Company , Florida Machine and Foundry Company and Sherman Concrete Pipe Company , all bills due on tne Incinerator. Upon motion of Mr. Bull , seconded by Mr. Outler, the Clerk was ordered to pay 000. principal on these bills and ell accrued interest to date , the amount to be pro-rated as follows : Florida Machine and Foundry Company $100. Mason Lumber and Supply Company 230. Farquhar Machine Company 150. Sherman Concrete Pipe Company 20. and interest to date is to be added to these amounts. After discussion, the following Ordinances were passed to the next Regular Meeting for consideration: Building Code Loose animals Garbage Collection Fees House numbering. Mr. Bull moved the passage of the following Ordinance on first reading: "AN ORDINANCE GOVERNING THE INSTALLATION, 'USE , MAINTENANCE AND REPAIRS OF SYSTEMS FOP THE CONSUMPTION OF LIQUIFIED OR VAPOROUS FUEL GASES FOP LIGHTS, HEATING, COKING, ET CETERA IN THE TOWN OF ATLANTIC BEACH, FLORIDA, RE'UIRING Pr MTTS FOR THE INSTALLATION THEREOF , DESIGNATING THE BUILDING INSPECTOR AS THE ENFORCEMENT OFFICER THEREOF, FIXING INSPECTION FEES AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF." Mt. Outler seconded tne motion and this Ordinance was passed on first reading. Mr. Bull moved the passage of this Ordinance on second reading: "AN ORDINANCE GOvERNIN U THE INSTALLATION , USE, MAINTENANCE AND REPAIRS OF SYSTEMS FOR THE CONSUMPTION OF LIQUIFIED OR VAPOROUS FUEL GASES FOR LIGHTS, HEATING, COOKING, ET CETERA IN THE TOWN OF ATLANTIC BEACH , FLORIDA , REQUIRING PERMITS FOR THE INSTALLATION THEREOF, DESIGNATING THE BUILDING INSPECTOR AS THE ENFORCEMENT OFFICER THEREOF, FIXING INSPEC- TION FEES AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF." Mr. Outler seconded the motion and this ordinance was passed on second reading. The Town Attorney reported in reference to the Oltrogge matter; that nothing further had been heard and that he is of the opinion that no liability on the part of the Town exists. 41111 Joe Williamson, Jr. , submitted a report of Russell and Axon, Engineers , on a proposed water works for the Town. He read and explained a great many parts of the report and some discussion was had. However, it was decided that a full membership of the Council should he present and no other matters under consideration when Mr. Williamson should again appear before the Council . The report was , therefore , received and ordered held by the Clerk as strictly confidential information at this time. The Chair suggested tnat Mr. Williamson advise the members of the Council when he could again appear and thanked him for the information receiv- ed at this time. It was agreed that the contents of the re- port are strictly confidential at this time and would not be divulged until the council could make further study. The Town Attorney, chairman of the Laws and Rules Committee and Town Clerk were directed to act as soon as possible to compile such new legislation as seems to be re- quired for presentation to the Duval Delegation on or before March 7 , 1941 , in accordance with their request. upon motion of Mr. Bull , seconded by Mr. Outler, J .L. Russell , gown Marshal , was appointed sanitary officer for the Town, to work under and with the Town Supervisor in the enforcement of Health matters. The Town Attorney reported in reference to the Adams suits. The Seawall suit having been decided in favor of the Town has been appealed to the Supreme Court. The tax suit of Adams versus C. R. Frazier, Tax Collector is now in progress and will probably be completed in the Court of Miles Lewis within the next three or four weeks.
