01-24-40 v MINUTES OF A. SPECIAL MEETING OF THE ATLANTIC BEACH TO VN COUNCIL HELD PT THE TONN HALL AT 8 P. M. , JANUARY 24, 1940. Present: E. L. Chiasson R. E. Sugg Thomas V. Trout . The Mayor , Mr . George H. Smith was also present. The meeting was celled to order pursuant to a notice sent out by the President of the Council . ,Vith unanimous consent , the reading of the minutes of the previous meeting was postponed until the next regular meet- ing on February 6. Mr. Trout moved that the Loning ordinance be placed on third and final reading. The Ordinance was read in full and discussed. Mr. Trout offered the following amendment to the Zon- ing Ordinance : To amend the Zoning Map by changing Lots 7 and 8 in Block 36 from Residence C to Business District. To amend the Zoning Map by changing all Ocean Front lots in Block 33 from Residence P to Residence B District. Mr. Sugg moved the adoption of this amendment, which motion was seconded by Mr. Trout end the vote for adoption was as follows : For : E. L. Chiasson, R. E. Sugg and Thomas W. Trout. against : None . Mr. Trout offered the following amendment to the zon- ing Ordinance : Amend - rticle II , Paragraph 37 by striking the words , "and after erection of" . Mr. Sugg moved the adoption of this amendment , Mr. Trout seconded the motion and the vote for adoption was as follows: For : E. L. Chiasson, R. Sugg and Thomas N. Trout. pgainst: None . Mr. Trout offered the following amendment to the ;'on- ing Ordinance: Amend article IV, Paragraph A, Sub-paragraph 9, by striking the following words , "at the time of the passage of this Ordinance" , in two instances. Mr. ,$ugg moved the adoption of this amendment , which motion was seconded by Mr. Trout end the vote for adoption was as follows: For : L. Chiasson , R. E. Sugg and Thomas N. Trout. gainst: None . • Mr. Trout offered the following amendment to the Zon- ing Ordinance : Amend .rticle IV, ,paragraph A , Sub-paragra-h 10, by striking the words , "at the time of the passage of this ordinance- , in two instances. Mr. Sugg moved the adoption of this amendment, which motion was seconded by car. Trout and the vote for adoption was es follows: For: r.. L. Chiasson, P . E. Sugg and Thomas S. Trout . gainst: None . Mr. Trout offered the following amendment to the Zon- ing Ordinance : Amend Article II , Paragraph 41 , by adding thereto the follow- ing words : The Ocean Front Beach is included and defined as a Street" . Mr. Sugg moved the adoption of this amendment , which was seconded by Mr. Trout end the vote for adoption was es follows : For : E. L. Chiasson , R. F. Sugg and Thomas N. Trout . Against: None . Mr. Trout offered the following amendment to the Zon- ing Ordinance : Amend Article III , Paragraph K by striking the words and figures , "when a lot has a depth exceeding 175 feet and a width of 50 feet or more" , and substituting therefor the following words end figures: ";'hen a lot has a width of 50 feet or more and extends from street to street" . Mr. Sugg moved the adoption of this amendment , which motion was seconded by Mr. Trout and the vote for adoption was as follows: For : F. I . Chiasson , P. F. Sugg and Thomas W. Trout . (gainst: None . Mr. Trout offered the following amendment to the Zoning Ordinance: Amend Article III , Paragraph L , Sub-paragraph 1 , by adding the following paragraph: "In the case of lots , not having a reverse frontage , re-subdivided by recorded deed and having a lesser depth than the average depth of the lots in the same block , as shown by a recorded plat, the required front yard shall not be less than one-sixth of said average depth" . Mr. Sugg moved the adoption of this amendment, which motion was seconded by Mr. Trout and the vote for adoRtion was as follows : For: F. L. Chiasson, R. E. Sugg and Thomas P'. Trout . Against : None . Mr. Trout moved that the Ordinance , as amended , he pass- ed on Third and Final Reading. Mr. Sugg seconded Mr. Trout ' s motion and the vote was as follows: For : E. L. Chiasson F. F. Sugg Thomas W. Trout Against: None . Upon suggestion of the Mayor, the Clerk was directed to obtain figures for the printing of the Toning Ordinance , the map not to be included. Mr. F. L. Jones , Chairman of the Board of Anoraisers on • the completed Street Project, reporter that the Board would make its final report at the Meeting on February 6 . An application of Gordon Fright to sink a three inch artesian well on his Second Street property was unanimously approved and the City Supervisor was directed to grant permission to Mr. Nright to sink this well. At the same time the City Supervisor is to advise Mr. Nright that the present Ordinance would be amended and that certain restrictions would be placed upon the use of such privately owned wells and that the Hermit granted in this instance would , of course , be sub- ject to any restrictive regulations passed in the future. Upon motion of Mr. Trout , seconded by Mr. Sugg, an Ordinance entitled, "AN ORDINANCE Appointing a Board of Appraisers to (1 ) Deter- mine the Amount of Special Benefit Nhich will Accrue to Those Certain Lots, Tracts or Parcels of Land in end at the Town of Atlantic Beach, Duval County, Florida , by Virtue of the Contemplated Imnroving of that Portion of Second Street In and at the Said Town , lying Between the Therein Designated East Coast Drive and Sherry Drive ; (2) To Make a Finding as to the Benefits Estimated to Result to the .'ublic at Large Because of Said Proposed Improvements ; and ( 3) to File a. Report of Such Determination and Finding" , was passed on first reading. This Ordinance was placed on second reading and the vote in this instance was as follows: For: E. L. Chiasson, R. E. Sugg and Thomas W. Trout . Upon motion of Mr. Trout , seconded by Mr. Sugg, an Ordinance entitled , "AN ORDINANCE Appointing a Board of Appraisers to ' 1) Determine the rmount of Special Benefit Which will Accrue to Those Cer- tain Lots , Tracts or Parcels of Land in and at the Town of Atlantic Beach , Duval County, Florida , by Virtue of the Crn- templated Improving of that Portion of Third Street in and at the Said Town, lying Between the Therein Designated East Coast Drive and Sherry Drive ; (2) to Make a. Finding as to the Benefits Estimated to Result to the Public at Large because of said Proposed Improvements ; and (3) to File a Report of Such Determination and Finding" , was passed on first reading. This Ordinance was placed on second reading and the vote in this instance was as follows: For : E. L. Chiasson, F . F . Sugg and Thomas N. Trout. Against: None .
