BEACH TO NN COUNCIL HELD AT 8 P. M. AT THE TOYN
HALL ON MARCH 5 , 1940.

The minutes of the Pegular Meeting of February 6
were approved as read.
The minutes of the Special Meeting of February 12
were approved as read.
The report of the Treasurer was read by Mr. Cutler,
approved And ordered filed.
Upon motion of Yr. Posborough, seconded by Mr. Sugg ,
the President of the Council and the Town Clerk were
authorized to act for the Town to borrow a sum of x'1000.00,
x500.00 of which is to pay the note due on March 12th at the
Florida National Bank, provided it appears at the time this
note is due the extra 1500.00 is required for running expenses,
otherwise the President of the Council and the Town Clerk' to
extend the :w500.O0 note for a period of sixty days. This
resolution was unanimously adopted.
Upon motion of Mr. Rosborough, seconded by Mr. Outler,
the following bills were approved and ordered paid if and when
funds are available :

Mr. Lester, Boy Scout Leader , Freddie "Jilliams and
Harry Burns, on behalf of the -Boy Scout Trout of Atlantic and
Neptune Beach appeared before the Council. Mr. Nilliams
explained that the Harcourt Bull interests had offered to
donate two lots on the 'West Side of Sherry Drive , near the
School ; that such lots would be offered to the Town for the
purpose of building a Scout Hut and that the Scout Troup desir-
ed that the Town give nominal sponsorship to the project , which
is to be constructed by N Y A and that the Scout troulp mould
furnish the cash outlay. This matter was discussed in detail
and Mr. Outler moved that the Town take title to the two lots
for the construction of the Scout Hut and sponsor such project,
provided no expense is to be charged to the Town. Mr . Rosborough
seconded the motion and it was unanimously adopted.
A. discussion was had in reference to the proposed paving
of Second and Third Streets between East Coast Drive and Sherry
Drive , it appearing that the bid suhruitted by the Duval Engineer-
ing and Contracting Company and opened at the Council Meeting on
February 6 is a little higher than the project would justify.
The City Supervisor was directed to look into the matter further
end to ascertain whether or not this work could be done in some
other manner. The City Supervisor was directed to call a
special meeting of the Council should he find e plan which could
be followed in this proposed work.
A discussion was had in reference to assessments
against abutting property on the N. P. A . projects completed
in 1938 and 1939. Two plans for assessments were submitted
by the City Supervisor and thoroughly analyzed. Upon motion
of Mr. Cutler, the following plan was proposed:
That the Town assume seven per cent of the total cash
outlay, as shown by the final report of the Sponsor' s contri-
butions , the total being ;;13 ,571.79. This part assumed by
the Town to cover intersections and non-assessable property
and that the balance of ,12,621.79 be raised by assessments
against abutting property owners on the following basis :
16 ' paving 65/ per abutting property running foot.
20' paving 76 ! per abutting property running foot.
21 ' paving 79V per abutting property running foot,
and that the matter be referred to the Town Attorney on this
basis in order that he may prepare the necessary legal
documents to set-up the assessments.

vote thereon was as follows :

The Town Attorney explained in reference to the action
now underway in suits to be filed for the collection of
delinquent taxes. The Town Attorney also reported that all
answers filed by the defendants in the suit of the Town against
N. H. Adams , et al had been ordered stricken by the court and
that the case would either be appealed or amendments made to the
answers. The next step in this suit will he considered by the
Court on April 1 .
The Chair explained the results of a special meeting
which was held on February 12th at which time a cross section
of tax payers in the Town were present and at which time many
bf the problems of the Town were discussed; that immediately
after this meeting the City Supervisor had a call from a memb-r
of the Adams family, suggesting that the time might be right
for negotiations with Mr. Idams regarding the water works end
that this party had suggested citizen ' s committee to contact
Mr. Adams. The Chair explained that he had designated Mr.. Robert
Milam as Chairman of this Committee , Messrs T. T. Phillips, Don
Goodling, E. L. Jones and G. L. Posborough as members; that a
preliminary meeting had been held and the Committee would take
some sort of action within a short time .
After a discussion in reference to the outstanding
accounts against the Town, Chargeable to the construction of
the Garbage Incinerator, Mr. Posborough moved that the "resident
of the Town Council and the Town Clerk be , and they are hereby
authorized to borrow, upon a first mortgage against the Town
Park and Town Hallproperty, un to 14000.00, the money to be
used first to pay off the present mortgage on the Town property
amounting to 4:1000.00 , the balance to be applied to the payment
of the above named bills. •
Mr. Cutler seconded this motion and it Was unanimous-
ly adopted.
The Mayor reported that plans are being considered
for the installation of street lights in accordance ,vi.th the
provisions of the franchise of the City of Jacksonville.
The City Supervisor was authorized and directed to
make the necessary repairs to street end steps on the Ocean
Front and as soon as possible to make necessary street repairs,
particularly on those streets recently completed by N. P. P .
The Chair advised that Y. H. Adams had filed a suit
against the Town Clerk and Tax Collector, enjoining against the
collection of taxes for 1939. The Town Attorney advised that
appearance had been filed in this matter and that it would be
set for preliminary hearing on April let.
The Mayor and members of the Council having had
complaints against the rulings of F. H. A . on property west of
East Coast Drive , by unanimous consent the Chair designated Mr.
Lawrence K. Tucker, Jr. Chairman of a Committee to make an
effort to secure F . H . A. approval for buildings on property
between East Coast Drive end Sherry Drive and the Mayor was
specifically requested to follow up this matter with Mr. Tucker.
The Clerk raised the question in reference to the dona-
tion to the P. T. A. 'Nelfare fund at Jacksonville Beach which
was originally for :w50 ,$30. of which has been paid. The natter
was discussed and upon motion of Mr. Rosborough, seconded by
Mr . Outler , the Clerk was directed to give to the P. T. A . in
Jacksonville Beach a warrant for T10. and the Atlantic Beach
School a warrant for °-'10, he to advise that this is as much as
the Town can do at this time and that further donations would
have to be governed by the financial condition of the Town.
The following Fesolution was introduced by Mr. Sugg and
seconded by Mr. Outler and uanimously adopted:
"WHEREAS, there has been dedicated to the Town of
Atlantic Beach in that section known as Donner' s Sub-
Division a road extending easterly approximately 1100
feet from Mayport Pond to a point at the southwest
corner of a 10 acre plot of ground listed as the proper-
ty of Inez Peterson,
NHLEREAS, there is an extension at right angles to the
North of said road, a road that has been dedicated to
the To,vn of Atlantic Beach , same being located
approximately 1100 feet East of Mayport Road and running
north a distance of approximately 2000 feet , and
YHEREAS, neither of these two thoroughfares have been
named,
NON THEREFORE BE IT RESOLVED BY THE MAYOR AND T0'VN
COUNCIL OF THE T01N OF ATLANTIC BEACH that the said
1100 feet easterly of Mayport Pond be and the same is
hereby officially designated as 'Donner' s Road' , and
BE IT FURTHER RESOLVED, that the said 2000 feet of road-
way extending northerly approximately 1100 feet east of
the Mayport Road be , and the same is hereby officially
designated as 'Francis Street ' .
There being no further business for consideration , the
meeting was adjourned.
