TOWN COUNCIL HELD AT THE TOWN HALL AT 8 P. M. ,
MARCH 25 , 1940
This Meeting called persuant to the following notice :

You, and each of you are hereby notified of , ,end respectfully
urged to he present at a special meeting of the Town Council
of the Town of Atlantic Beach, Duval County, Florida , to he
held at the Town Hell in said Town at 8 . M. the 25th day of
March , 1940, for the purpose of :
( a ) To consider a project for drainage of the low
lands in the hack area .
(h ) To consider Having certain streets in the Town.
(c ) To consider a esolution demanding that vacant
lots be cleaned.
(d) To consider assessments on completed V. P. A.
projects.
( e) To consider ways and means for taking care of
outstanding hills against the incinerator.
(f) To take whatever action is necessary in connec-
tion with the water works nrohlem.
(g) To consider means of finance and make such
arrangements as are necessary to meet the Town ' s
needs.
(h0 To consider the employment of additional help
for the Town.

Feeding of the Minutes of the Regular Monthly Meeting
of March 5th was passed to the next -'egular Monthly Meeting inApril . v
By unanimous consent, the City Supervisor was directed
to secure a N. P. A. labor project for the purpose of cleaning
• out and draining Sherman Creek. To carry out this plan, he was
directed to first communicate with the State Board of Health to
determine whether or not such project may now he sponsored by
the State Board of Health and if not to proceed on a Town
sponsorship.
The Having of Second rnd Third "treets between
S;ast Coast Drive end Sherry Drive was thoroughly discussed
and theproperty owners along these streets are to be asked
if shorter term payments can be made in case these streets
are raved. The matter was continued to another meeting.
Thereupon, Mr. Cutler moved that the bid submitted
under date of January 31 , 1940 by DuvA1 Engineering end
Contracting Company, for the nurnose of clarifying the
records , be , and the same is hereby rejected . Mr. Trout
seconded the motion end it was unanimously adopi-ed.
The matter of cleaning vacant lots in the Town was
thoroughly discussed. Mr. Cutler moved that the City Super-
visor be directed to proceed with lot cleaning throughout
the Town and that he should prepare, from time to time , proper
Resolutions covering such lots es are in a bad condition so
that the provisions of law may be complied with ; that it be
specifically understood that this clean-up campaign is to be
Town-wide and not limited to any particular area. Yr. Trout
seconded the motion and it was unanimously adopted. Thereupon ,
the City Supervisor presented a Resolution including the first
of a series of lots to be given Immediate consideration , which
Resolution was offered by Mr. Cutler, seconded by Mr. Trout
and passed by the following vote :

against: None .
The Resolution is quoted as follows:
"WHEREAS, the co-mingled end concerted growth of weeds, grasses
and underbrush upon the following lots , in the Town of Atlantic
Beach , Florida , to wit :

Part,
amounts to and constitutes a nuisance endangering the general
health, safety and welfare of the community at large ,
NON, THEREFOnr, be It resolved by the Town Council of .Ptlentic
Beach, that it hereby declares the condition on said lots a
nuisance endangering the general health, safety and welfare
of the community et large and recommends to the Mayor , that he
proceed in the manner provided by law, to correct and abate
said nuisance. "
The matter of outstanding bills on the Incinerator
constructed by the Town was thoroughly discussed. The Chair
advised that he had conferred with Mr. T. T. Phillips of the
Gulf Life Insurance roar any and that Mr. Philips h=gid stated
that if furnished with proper Resolution that he would take
up with the Members of his Board of Directors the Proposition
of loaning, upon first mortgage against the Town Hall and
Town Park, the sum of $4000, 1000 of which is to pay an
existing mortgage and ` 3000 is to apply on the payment of
bills incurred in the construction of the Incinerator. There-
upon , Mr. Outler made the following motion; seconded by Mr.
Trout and unanimously adopted:
That E. L. Chiasson, President of the Town Council , negotiate
further '�/i.th the Culf Life Insurance Company for a first
mortgage on the following described nroperty, in the amount
of $4000.00:
All that portion of the abandoned right-of-way of
the Mayport Branch of the Florida East Coast Rail-
way lying between the Nnth line of Seventh Street
and the North line of Eighth Street, as extended
Easterly, in the Town of P tlantic Beach Florida ,
said Strip being '.ane Hundred Sixty (160) feet wide
and three Hundred (300) feet more or less in length,
lying in Government Lot Five (5) Section Sixteen
(16) , Township Two (2) , South, Range Twenty-nine
( 29) East , Duval County, Florida,
and the following described property upon which Is now located
the Atlantic Beach Town Hall , to wit :
A pert of the Atlantic Beach Hotel Reservation in
the Town of Atlantic Beach, Duval County, Florida,
as recorded in Piet Book 5 , page 69, of the Current
Public records of said Duval County, more narticul = r-
ly described as:
Commencing at a Point on the Northern boundary line
of Seventh Street 166 feet Fast of the Center of the
Florida Fast Coast Railway right-of-way, thence run
Nesterly along the Northern boundary of said Seventh
Street a distance of 91 feet to the intersection of
the Eastern Boundary line of the right-of-way of the
Florida East Coast Railway with the Northern boundary
line of said Seventh Street , thence Northerly along
the Eastern boundary line of the said 'Florida East
Coast Railway right-of-way a distance of 100 feet,
thence Easterly and parallel with the TTorthern
r3oundary line of Seventh Street a distance of 47.5
feet , thence Southeasterly e distance of 109.4 feet,
more or less , to the point of beginning. Said land
being in the Southwest corner of said Gtlentic Beach
Hotel Reservation.
A discussion was had In reference to the water works
and the Chair reported the results of efforts of a Committee
of Citizens composed of the following: Messrs. Pobert F.
Milam, T. T. Phillips , Don E. Goodling , E: . L. Jones and G. L .
Rosborough end reed the following letter signed by Robert P .
Milam, Chairmen of the Citizens Committee :

Re : Atlantic Reach Vaterworks
Gentlemen:
Pursuant to request of Mr. "hillips and myself , Mr.
Adams and his son, Nilliam /dams, met with us in my office
today. After considerable discussion, Mr. /dams, proposal
was as follows:
He will sell :
(a) His franchise and easement rights in the
streets $15 ,000
(b) Mater system in streets including meters,
that is , everything beyond the property
of the Hotel Reservation 10,000
(c ) Use of his two wells for five years and
thereafter the right to all surplus water
above hotel reservation requirements 10,000
( d) He will include the strip of land eastward
from the Town Hall and nark lying between
the Town' s property line and the street
line .
He will accept payments in cash or in bonds
which would contain a provision that bonds
or coupons would be acceptable for all sums
due the Town.
He has about 150 connections which he says
averages about $20.00 per year each. His
charge is 172,00 per year for 80,000 gallons ,
which is 15/ per thousand gallons ; there-
after 12V per thousand gallons for the next
100,000 gallons; 'Ind above 180,000 gallons,
10V per thousand gallons.
All this for your information. Mr. Phillips has
kindly offered to discuss this further during my absence .

Thereupon, Mr . Outler moved that the offer made by
N. H. Adams , 6r. to sell the Vater works to the Town , upon
the terms set forth in the letter above , be rejected in
full. ?sir. Trout seconded the motion and it was adopted by
the following vote :
For: E. L. Chiasson, J. C . Cutler, Thomas S. Trout.
igainst: None.
Upon motion of Mr. Cutler, seconded by Mr. Trout,
the Town Clerk was directed to address a letter to all
members of the Citizens Committee , thanking them for their
interest and efforts in this matter.
The Town Clerk reported that the financial condi -
tion of the Town is somewhat improved and there is no need
for any immeci.ate action in this connection.
I letter addressed to the "resident of the Town
Council , some of the members of the Town Council and to the
City Supervisor by Miss E. J. Candee , in which she asked
for employment was thoroughly discussed. The Clerk was
directed to prepare a letter for the signature of the
president of the Council expressing regret to Miss Candee
that the Town does not have any employment to offer her at
the present time and that should something arise on which
her services could be used, the Council will be only too
glad to communicate with her.

Upon motion of Mr. Trout, seconded by Mr. Cutler,
penalty interest for the years 1937 and 1938 on Lot 5,
Block 22, payable by Es_ Li. Finkelstein and Morris ',Nhitten,
was waived, it appearing that this delinquency was not
intentional and was due to a confusion in the office
relative to the ownership of this lot.
The following motion of Mr. Cutler , seconded by 1,`r.
Trout, was unanimously adopted:
BE IT RESOLVED BY THE TONN COUNCIL OF ATLANTIC BEACH that it
do , and hereby does , direct and authorize C . F. Frazier,
Town Clerk of the Town of ° tlantic Beach , to deliver to C. C.
Howell , Jr. , Town Attorney , for suit, copies of the assess-
ment roll thereof the assessments, bathregular tax anr'.
Seawall assessments, on Lots 1 , 2, 3 , 4, 5 , 9, 10, 11 in
Block 36 , and Seawall Assessments on Lots 4 and 5, Block 36 ,
property of Pobert E. Sugg.
Upon motion of Mr. Trout , seconded by Mr. Cutler,
the Town Clerk was directed to accept the check of Miss Lydia
Burch, omitting penalties for the years 1933 , 1934 and 1935.
The Clerk presented a letter from the Town .Pttorney
to which was attached a letter from T. E. Satchwell of the
Mandalay Corporation, requesting relief of penalties on the
Town ' s Share Seawall on Mandalay Lots for the years 1935,
1936 and 1937; it appearing from the files in the office
that the Mandalay Corporation was apprised of omission of
these payments immediately upon a re-check of their last tax
remittance and it appearing that the said Mandalay Corporation
have had ample time to make adjustments and complaints, Mr.
Cutler moved and Mr. Trout seconded the motion that the
penalties referred to above be allowed to stand.
Mr. Chiasson explained in detail information he had
obtained from Mr. Taney of F. H. A . in reference to F. H. A .
loans in the Town of Atlantic Beach. He explained that F. H.A.
would make loans in the area Nest of East Coast Drive on those
streets where improvements have already been made and on such
other streets as is warranted and that the only exception they
would make would be those lots abutting Sherry Drive or on
lots more or less isolated. Mr. Chiasson reported that the
Federal Housing administration is highly favorable to loans
in the Town of Atlantic Beach because of the type of
• residences now existing and the possibilities for the future.
There being no further business for consideration,
the meeting was adjourned, it being agreed that the next meet-
ing set for April 2, 1940 be postponed to t.pril 9, 1940.
