04-09-40 v MINUTES OF THE POSTPONED REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL HELD AT THE TO'19N HALL AT 8:00 P. M. APRIL 9, 1940. Pursuant to the notice quoted below , the Regular Monthly Meeting, scheduled for April 2, 1940, was postponed to April 9, 1940: "TO: George H. Smith, Mayor, J. C. Cutler, G. L. Rosborough, Robert F. Sugg, Thomas 'a V. Trout, Councilmen and C. F. Frazier, Town Clerk. You, and each of you are hereby notified that the Regular Monthly Meeting of the Atlantic Beach Town Council , scheduled for April 2, 1940, has been postponed to April 9, 1940, and this meeting will be open to the consideration of any and all matters arising at that time. The Mayor, Mr. George H. Smith, and Town Attorney, Mr. C. C. Howell , Jr. , were also present. The Clerk read the minutes of the Regular Monthly Meeting of March 5, which were approved as read. The Clerk read the minutes of the Special Meeting of March 25, which were approved as read. In the absence of the Town Treasurer, Y_r. Outler read the financial report for the month of March and upon motion of Mr. Trout, seconded by Mr. Rosborough, this report was approved and ordered filed. Howell , Jr. 41.54 186.88 • Upon motion of Mr. Outler , seconded by Mr. Trout, the Clerk was directed to pay >l50.00, plus accrued interest on the note of the 1m. A. Estaver Company at the Atlantic National Bank and extend this note for a period of ninety days. The Chair explained that the Board of Directors of the Gulf Life Insurance Company have approved the anniica- tion of the Town for a first mortgage loan on the Town Hall and Town Park in the sum of $4000.00; that the matter has been referred to the Attorneys for the Town and the Gulf Life Insurance Company to determine whether or not such e mortgage can be legally executed by the Town Officials. The Town Clerk was directed to advise ell creditors on the Incinerator project that an effort is being made to nay off all this indebtedness and to ask each of these creditors to carry this account for another thirty days. The matter of improvements on Second and Third Streets was passed to the May Meeting. The Town Attorney reported in reference to the suit against `V. H. Adams since the decision of the Court deny- ing the Defendants' answer in whole and that the Defendants have asked permission to file amendments, the amendments, however, being such that in the opinion of the Town Attorney will not effect the Court's decision, but is merely for an appeal . Mr. Howell also explained in reference to the injunc- tion against the Town Clerk and Tax Collector, brought by Mr. Adams to prevent the collection of 1939 taxes, and that in order to intervene on the part of the Town, it would be necessary for him to have a Certificate of Taxes which became delinquent on April 1st. The following motion of Mr. Outler, seconded by Mr. Rosborough, was unanimously adopted: BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH that it do , and hereby does, direct and authorize C . R. Frazier, Town Clerk of the Town of Atlantic Beach to deliver to C . C. Howell , Jr. , Town Attorney, for suit, copies of the assessment roll thereof , the taxes end assessments on the Hotel Peservation , the property of -,11. H. Adams , Sr. , The City Supervisor explained in reference to the proposed drainage of Sherman Creek and the lowlands adjacent thereto ; that this matter has been considered by the `.tate Board of Health and just as soon as a: general project has been anproved, it will then be possible for this work to be done without an individual application for a project. The Town Clerk presented an Ordinance for a propos- ed Building Code, it having been nassed on first and second reading at the Regular Meeting on February 6 , 1940, which Ordinance was referred to the Laws and Pules Committee and the Town Attorney for final approval before passage. The Town Attorney read and explained a Resolution setting up Abutting Property assessments on ::street Improve- ments. Thereupon, Mr. Outler moved that the following Resolution be passed , Mr. Trout seconded Mr. Outler' s motion, and it was unanimously adopted: • A RESOLUTION NO. 50 4 A RESOLUTION Providing for the Levying and Collecting Under Sections 3022, et seq. , Compiled General Laws of Florida, 1927, of Special Assessment for Payment of Part of the Cost of That Certain and Hereinafter Described Street Improvement Program Undertaken, in the Town of Atlantic Beach,Duval County, Florida, on July 28, 1938, and Therein Completed on January 5, 1939. WHEREAS, there was on July 28, 1938, and in the Town of Atlantic Beach, Duval County,Florida, such a demand for street paving and hardsurfacing for additional conveniences for the public at large that a public necessity existed in that behalf, and WHEREAS, the said Town, by its governing authority, determined to make such public improvement in certain of its said streets, and provided for their aforesaid paving and hardsurfacing, with the result that the paving anc hardsurfacing of the hereinafter named streets was consequently undertaken by the said Town on July 28, 1938, and completed on January 5, 1939, and WHEREAS, a supplemental,additional, and alternative method of paying for such improvements is prescribed in and by Sections 3022, et seq. , of the Compiled General Laws of Florida, 1927, made, by Section 37 , of Chapter 13907 , Laws of Florida, Special Acts of 1929, a part and parcel of the Chart- er or governing authority of the said Town of Atlantic Beach, and 41 WHEREAS, the said Sections 3022, et seq. , provide, in part, that . . . all or any part of the cost of any such street improvement" may be paid for "by levying and collecting special assessments on the abutting, adjoinin6 contiguous, or other specially benefitted property" , and WHEREAS, the Town Council in and for the said Town of Atlantic Beach has determined to defray part of the expense of the aforesaid completed stree improvement program by means of such special assessments; and, acting pursuar to such determination has found in the manner more particularly hereinafter set forth,that (a)benefits have accrued to the property improved , (b) the amour. 41 -1- I thereof, (c) how such benefits will be prorated, and (d) that special assessments will be made in proportion to said benefits es directed by Section 3023, Compiled General Laws of Florida , 1927; N0W,THMEFORE: BE IT RESOLVED BY THE TOWN COUNCIL OF (PPE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, that Section 1: That certain "Report of Board of Appraisers" filed 0 of record in the office of the Town Clerk of the Town of Atlantic Beach, Duval County, Florida , on, to-wit, February 6th 1940 , is hereby expressly referred to; and, with respect to the matter therein contained relative to those special and public benefits which have respectively accrued to the improved abutting property therein described, and to the said Town of Atlantic Beach as a whole , is hereby declared to pro tanto be the basis of the instant Resolution. Section 2: In nature the improvement has been the paving and hardsurfacing of the hereinafter described streets, avenues, and ways in and of the said Town of Atlantic Beach. AP Section 3: Said streets, avenues , and ways which have been so improved are designated as follows: (a) East Coast Drive; from. Atlantic Boulevard on the south to Seventh Street on the north, and from Seventh Street on the south to Tenth Street on the north. (b) Third Street ; from Ocean Boulev=ard on the east, to Fast Coast Drive on the west. (c) Fourth Street; from Peach Avenue on the east to Ocean Boulevard on the west , and from Ocean Boulevard on the east to Sherry Drive on the west. -2- I (d) Fifth Street ; from Beach Avenue on the east, to Sherry Drive on the west. (e) Sixth Street ; from East Coast Drive on the east , to Sherry Drive on the west. (f) Tenth Street ; from Beach Avenue on the east , to East Coast Drive on the west. (g) Thirteenth Street; from Beach Avenue on the east to Ocean Boulevard on the west. IP (h) Fourteenth Street; from Beach Avenue on the east to Ocean Boulevard on the west. (i) Beach Avenue ;from First Street on the south to 33 feet north of third street on the north. Section 4: 93 % is that part or portion of the expense of the aforesaid paving and hardsurfacing to be paid by special assessments. Section 5: Said assessments shall be made in the following manner: They shall be assessed upon the property which ' has been specially benefited by the aforesaid street improvements in proportion to the benefits which have been derived therefrom; said special benefits to be determined and prorated (a) according to the foot frontage of the respective properties which have been specially benefit- ed by said improvement, and (b) at the respective amounts hereinbelow designated: viz , At 65d per front foot in Districts* 2 , 3 (with the exception of Lot 1 in Block 22, and Lot 6 in Block 25, therein) , 4, 5 , 7 , and 8; at 76¢ per front foot in District 1 (with the exception *Those certain "appraisal districts" established and created for the nonce , and as a result of respectively varying benefits conferred IP through said street paving and hardsurfacing, by the aforesaid Board of Appraisers in their above-mentioned Report . See Section 1, supra, and Section 7 ,infra. -3- 41 of Lots 1 and 2 in Block 9 , Lots 1 and 2 in Block 10, Lots 1 and 2 in Blocl 11, Lots 1 and 2 in Block 12, Lots 1, 2, 4, 5, and 7 in Park Terrace, end Lots 9, 10, 11, 12, 13, 14, 15 , and 16 in Block 1, therein) , along Lot 1 in Block 22 and along Lot 6 in Block 25 -- both in District 3, and in District 9; and at 79¢ per front foot along Lots 1 and 2 in Block 9, and along Lots 1 and 2 in Block 10,and along Lots 1 and 2 in Block 11, and along Lots 1 and 2 in Block 12 , and along Lots 1 and 2 and 4 and 5 and 7 ii Park Terrace and along Lots 9 and 10 and 11 and 12 and 13 and 14 and 15 and 16 in Block 1 -- all in District 1, and in District 6. And the said special assessments shall be paid, by the owner of the hereinafter (see Section 7 hereof, post) described property abutting upon the aforesaid (see Section 3 hereof,ante) and hereinafter ( see Section 7 hereof,post) named streets , avenues , and ways assessed, in and by these proceedings, for the aforesaid improvement, in 5 annual, and es nearly equal as may be, installments -- with the first of such installments becoming due and payable November 1st 1940; the second upon November 1st 1941; the third upon November 1st 1942; the fourth upon November 1st 1943; and the fifth and last of such installments 10 upon November 1st 1944. The said assessments shall bear interest at the rate of five (54) percentum per annum, with accrued interest on all deferred payments, unless paid within thirty days after said assessments shall stand approved and confirmed, as provided in Section 3029 of the Compiled General Laws of Florida, 1927 . And in all respects shall the said assessments be made in a manner following as nearly as may be the provisions of Sections 3022,et seq. , Compiled General Laws of Florida , 1927 , aforesaid. -4- 10 Section 6: 7cL is that part of the expense of the aforesaid paving and hardsurfacing apportioned to be paid from the general improvement fund of the said Town of Atlantic Beach. 11 Section 7: The lands upon which the aforesaid special assessments shall be levied, viz. , all lots and lands adjoining and contiguous or bounding and abutting upon such aforesaid improvement , together with their respective descriptions of (a) the Appraisal Districts ( see Section 5 hereof, ante) in which they severally lie, (b) the streets, avenues and ways upon whichthey respectively abut or adjoin, or to which they are respectively contiguous , (c) their respective lineal front footage upon said streets, avenues, and ways, and (d) the amount of special benefit 41 which, as a result of the aforesaid paving and hardsurfac- ing, they have individually and respectively received , are designated below: -5- 41 5-41 11 District 1 Street ,upon which said lot,tract or Parcel abuts ,Adjoins Lineal Lot ,Tract,or Parcel or is contiguous Feet Special Benefit . A great many lots have been authorized cleaned by the Town and several other property owners have done the work themselves. A letter signed by M. Cromwalt , requesting permission to replat Lots 4 and 6 in Block 9 so that they could face ast Coast Drive instead of Seventh Street , was read end discussed. It ennearing that the depth of the lots proposed to be replatted is only 130 feet and the frontage would be less than the minimum 50 feet required by the Zoning Ordinance , the Town Clerk was instructed to advise Yr. Cromwalt that the replat could not he permitted and that if 0 he desires to pursue the matter further, It will he necessary to follow the provisions of the Zoning Ordinance in making a demand on the Council for a change in the law. A letter signed by the City Supervisor, in reference to the future maintenance of the grounds of the newly completed Elementary School , was read end thoroughly discuss- ed. The Council heartily approved the suggestion that en effort be made to cooperate with the School Board in the maintenance of these grounds after V. P. A. has completed the work. The City Supervisor was instruttddto write a letter to Mr. T. F. Arnold , the Business Manager of the School 3oard, commending them for the excellent work that has been accomplished , including the playgrounds , ornamental pool , plantings, et cetera end to offer the coon=gyration of the Town in any Nay possible to properly maintain these grounds during the summer months. The City Supervisor raised the question of parking at the intersection of Atlantic Boulevard and Ocean Boulevard. The Chair asked that the Mayor, the Chairman of the Police Committee , the Town Marshall and City Supervisor work this matter out in a satisfactory manner. The City Supervisor raised the question of registra- tion for the August election, and the Town Attorney and City Supervisor were directed to look into the law in reference thereto and report on it et the next regular Meeting. Mayor Smith reported that Mr. Lawrence K. Tucker , Jr. , had refused the chairmanship of the Committee to work out complaints with the Federal !lousing administration. 1'r. Sm' th also reported in reference to the Street Lights for the Town , advising that all plans for this work have been completed , but the matter has been temporarily held up on account of lack of funds on the nart of the City of Jacksonville . The question of the repainting and repair of the Town Hall was discussed and the City Supervisor was instructed to secure estimates on tis work for the next regular meet- ing.
