05-14-40 v MINUTES OF THE POSTPONED REGULAR MONTHLY MEETING OF TIP ATLANTIC BEACH TO NN COUNCIL HELD AT THE TOeNN HALL AT 8:00 P. M. MAY 14, 1940. Present : E. L. Chiasson J. C . Outler G. L. Rosborough R. E. Sugg Thomas N. Trout. Mr. George H. Smith, the Mayor and Mr. C . C. Howell , Jr. , Town Attorney, were also present. Minutes of the meeting of April 9th were read and upon motion of Mr. Rosborough, seconded by Mr. Outler, were approved as read. Mr. Osborne submitted his monthly financial report which was approved and ordered filed. Upon motion of Mr. Trout , seconded by Mr. Rosborough, the following bills were approved and ordered naid: Southern Bell Telephone Company 6.05 Consolidated Automotive Company 1.75 Gulf Life Insurance Co. Howell , Jr. 64.31 260.30 Florida Times-Union 344.96 In reference to the bill of the Florida Times-Union for advertising , the Clerk was ordered to pay the sum of X44.96. The Chair explained in reference to efforts to secure a loan on Town property by which money would he secur- ed to cover all outstanding accounts against the Town on the Incinerator project. It was explained that the attorneys had determined that it would be illegal to mortgage Town property and consequently a loan from the Gulf Life Insurance Company could not be obtained. The Chair then reported that after discussing the matter with Officials of the Florida National Bank, they pro- pose to take care of any and all accounts against the Incinerator by lending money to each creditor, the Town to pay the interest thereon. The Clerk was directed to advise all of the creditors of the arrangement with the Florida National Bank and to complete such arrangements when necessary. The Clerk was directed to furnish Mr. J. L. Dart with copies 411 of all letters to these particular creditors. Upon motion of Mr. Cutler, seconded by Mr . Trout, the Town Clerk end Tax gollector was directed to certify all delinquent taxes to the Town Attorney for collection by suit, when the delinquency is shown prior to 1939 and the amount is 50. or more , the Resolution as follows: BE IT RESOLVED BY THE TO'XN COUNCIL OF ATLANTIC BEACH that it do, and hereby does, direct end authorize C. R. Frazier Town Clerk end Tax Collector of the Town of Atlantic Beach, to deliver to C. C. Howell , Jr. , Town Attorney, for collec- tion by suit , copies of the assessment roll thereof , the assessments, both regular tax and Seawall Street end assess- ments on Lots 5 and 6 , Block 15 property of 0. P. Woodcock, Lot 4, Block 15 and Lot 5, Block 25 property of M. N. Barwald, Lot 6, Block 27 property of James D. Palmer, Lot 6 , Block 41 , property of H. P. Meyerson, Lots 19, 20 and 21 in Block 9 property of H. H. Elarbee , Lots 5 and 6 , Block 23 property of E. S. Spencer, Lot 6 End South 31 feet of Lot 7 in Block 33, property of Charles E. Pelote . By unanimous consent, the Clerk was directed to address a letter to all delinquent 1939 tax payers with exception of N. H. Adams, Sr. , which pending on suit , call- ing their attention to the fact that their taxes are now delinquent and on which penalties are accruing. The City Supervisor advised that he had carefully investigated the matter of a project for draining Sherman Creek and the back areas , and because of the fact that the State Board of Health does not have a general mosquito control project at the present time , he recommends that the Town undertake to do the work absolutely necessary to un- stop ditches and to cover them with oil . By unanimous consent, the City Supervisor was authorized to proceed with this work, provided the cost is no more than k25.00. After a discussion concerning street improvements on Second and Third Street, this matter was referred back to the City Supervisor and Harcourt Bull , Jr. , was request- ed to work with the City Supervisor ih an effort to find a plan by which this work could be completed before the next School Term. Mr. Outler offered the following Resolution which was seconded by Mr. Rosborough and unanimously passed: WHEREAS, Sherry Drive from Atlantic Boulevard to the Plaza, where it connects with the Seminole Beach Road, is an extremely important thoroughfare and one which would serve the general public both inside and outside Atlantic Beech, and WHEREAS, there is located on the said Sherry Drive a recently completed Elementary School to which is required all the thoroughfares possible to provide , and ,VHEREAS, Duval County has already paved the said Sherry Drive from Atlantic Boulevard to Third Street leaving a gap between the said Third Street and the Plaza a distance of 1800 feet, NOW, THEREFORE, BE IT RESOLVED by the Mayor and Town Council of the Town of Atlantic Beach, Florida, that the Board of County Commissioners for the County of Duval and the Budget Commission of the said County be, and it is here- by petitioned to make provision for the completion of this road in the next appropriation for Roads and Bridges , and BE IT FURTHER RESOLVED that a copy of this Resolution be furnished the Board of County Commissioners through Commissioner Howard Belote , Representing the Fifth District, and that a copy be furnished to the Budget Commission. The City Supervisor presented estimates covering the painting of the Town Hall . After much discussion, it was directed that additional information be obtained concerning 110 the burning off of all paint on the building and re-paint- ing with two coats. The City Supervisor was directed to proceed with this work after making the n.ecesaary investiga- tion concerning complete removal of the paint. The estimate submitted by Otis Futch , a resident of Atlantic Beach, was tentatively approved, in the event the cost of removing the paint is found to be prohibitive. The City Supervisor was directed to make purchase of paint of the best quality and at the best price. The City Supervisor submitted a report on lot clean- ing; thereupon Mr. Cutler offered the following Resolution which was seconded by Mr. Trout and unanimously adopted: WHEREAS, the co-mingled and concerted growth of weeds, grass- es and underbrush upon the following lots in the Town of Atlantic Beach, Florida , to wit: Block 11 Lots 2, 3 , 4, 5, 6, 7 , 8, 9, 10, 11 , 12, 13, 14, 16, 17, 18 , 19, 20, 22 , 24, 26, 28, 30, 32, 34, 36 , 38, 40, 42, 44, 46, Block 12 Lots 1 , 2, 3, 4, 5, 6 , 7 , 8, 9, 10, 11 , 12, 13 , 14, 15, 16, 17 , 18 , 19, 20, Block 13 Lots 1, 2, 3, 4, 5, 8, 12 , 14, 18, 20, 22, Block 14 Lots 1, 3, 4, 5, 6 , Block 44 Lots 1 , 2 , 3 , 4, 5, 6 , amounts to and constitutes a nuisance endangering the general health, safety and welfare of the community at large, NON, THEREFORE, be it resolved by the Town Council of Atlantic Beach, that it hereby declares the condition on said lots a nuisance , endangering the general health, safety and welfare of the community at large and recommends to the Mayor that he proceed in the manner provided by law to correct and abate the said nuisance. Upon motion of Mr. Cutler, seconded by Mr. Rosborough, the following Resolution was unanimously passed: RESOLUTION NO. 51. A RESOLUTION directing the making of an Assessment Roll Subsequent to the Adoption of Resolution No. 50. The Town Council of the Town of Atlantic Beach, Duval County, Florida, did, on April 9th , 1940, adopt and pass Resolution No. 50, entitled: "A RESOLUTION Providing for the Levying and Collecting under .sections 3022, et seq. , Compiled General Laws of Florida, 1927 , of Special Assessments for Payment of Part of the Cost of that Certain and Hereinafter Described street Improvement Program Undertaken, in the Town of Atlantic Beech, Duval County, Florida, on July 28, 1938, and therein Completed on January 5, 1939. Therefore , BE IT NON RESOLVED by the said Town Council that in accordance with Section 3027 of the Compiled General Laws of Florida, 1927: 1 . C. R. Frazier, Town Clerk in and of the said Town, is here- by required and directed to make an assessment roll in accord- ance with the method of assessment provided for in the said hesolution 50. • 2 . Said assessment roll shall be completed and filed with the said Town Council as promptly as possible. 3. Said Assessment roll shall show: (a) The lots and lands assessed, (b) The names of the respective record owners thereof , (c) The amount of the assessment against each lot or parcel of land, and (d) The number of annual installments in which the assessment is divided. An Ordinance previously passed on first and second reading, providing a Building Code for the Town of Atlantic Beach, was referred back to the Laws and Rules Committee for further study. The question of furnishing water to the Boy Scout Hut was raised and thoroughly discussed. Mr. Rosborough offered the following resolution, which was seconded by Mr. Trout: BE IT RESOLVED by the Mayor and Town Council of Atlantic Beach, Florida , that the Town agrees to extend water mains from the Salt Air Nell to the Bou Scout Hut , a distance of approximately 950 feet for a consideration of the sum of 425 as a tap charge to be liquidated by the Governing Board of the Boy Scouts and the Boy Scouts by furnishing labor equal to the sum of 425 , That the Town make a charge of 41 per month for an un- metered tap, and That the City Supervisor is hereby authorized to purchase from the R. C. B. S. Corporation approximately 500 feet of three inch pipe and approximately 500 feet of one and one- half inch pipe , the total cost not to exceed 480; that such purchase is to be made upon the following terms, 415.00 per month, on or about the 15th of each month until the total amount of 480 has been liquidated. The vote was as follows: For Adoption: E. L. Chiasson G. L. Rosborough R. E. Sugg Thomas N. Trout. Mr. Outler passed. The Town Clerk submitted a letter addressed to the Town Council by Marion N. Gooding in reference to the encroach- ment found at the corner of Beach Avenue and Fifth Street, the estate of E. M. Nolan, in which Mr. Gooding asked that a form of release be granted, in order that the property may be trans- ferred with clear title. Upon motion of Mr. Trout, seconded by Mr. Cutler, the Mayor was authorized and directed to sign a waiver of this encroachment, the Town Attorney to prepare such waiver for Mr. Smith' s signature, the waiver to contain a revertible clause , in the event any alteration, change or new building is done on the property referred to. A letter signed by the Secretary of the Atlantic- Neptune P.T.A. ,commending the Town Officials on their co- operation with the School Board authorities and the P.T.A. ,was read and filed for information. The City Supervisor was directed to make all arrangements for and to put into effect the safety bathing Zone Ordinance on June 1. The matter of employing an additional Police officer • during the summer months was referred to the Police Committee for consideration. It was the unanimous recommendation of the Members of the Council that the Tax Assessor should begin work on the 1940 Assessment Roll as soon after July 1 , 1940 as possible.
