BEACH TOWN COUNCIL HELD AT THE TOWN HALL AT 8 P. M.
JUNE 4, 1940.
Present:

The Mayor , Mr. George H. Smith and Town Attorney, Mr.
C. C . Howell , Jr. were also present.
With unanimous consent , the reading of the minutes of
the previous meeting was postponed until the next regular
monthly meeting on July 2.
Mr. Osborne submitted his monthly financial report,
according to the records at the bank, which was approved and
ordered filed.
Upon motion of Mr. Rosborough, seconded by Mr. Trout,
the following bills were approved and ordered paid if and
when funds are available;

With regard to the bill of the Florida Times Union,
The Town Clerk was authorized to pay $100 on this account.
The Building Code was passed until the next meeting
so that further study could be given to the amendments.
It was announced that the assessment roll for the
M.P.A. Street improvements was completed on June 3 and this
assessment roll was presented to and filed with the Town
Council.
The following Resolution was presented:
"A RESOLUTION Causing a Copy of the Special Assess-
ment Noll to be Published, and Causing to be Attached There-
Unto a Certain Notice to all interested Property Owners.
Resolution No. 51 , entitled, "A RESOLUTION Directing
the Making of an Assessment Roll Subsequent to the Adoption
of Resolution No. 50" , was duly adopted and passed by the
Town Council of the Town of Atlantic Beach, Duval County,
Florida, on May 14th, 1940.
• The special assessment roll contemplated in and by
said Resolution No. 51 was completed on June 3, 1940, and
filed with the said Town Council on June 4th 1940.
Be it therefore now RESOLVED by the said Town Council
of the Town of Atlantic Beach that, in accordance with Sec-
tion 3028 of the Oompiled General Laws of Florida, 1927:
1. A copy of the said special assessment roll shall be
published once a week, for a Period of three weeks, in a
newspaper of general circulation, published in the said
County of Duval in which the said Town of Atlantic Beach
is located; because the said Town Council thereof hereby finds,
and so declares to be a fact, that there is no newspaper
published in the said Town.
2. In the publication of said special assessment roll
there shall be attached to the copy of the assessment roll
published a notice directed to all property owners interest-
ed in said assessments of the time and place where complaints
will be heard with reference to said assessments and when
said assessment roll will be finally approved and confirmed
by the said Town Council , the governing authority of the said
Town of Atlantic Beach, sitting as an equalizing board.
3. Complaints will be heard with reference to said
assessments at 8 :00 o'clock P. M. , on Tuesday night of July
2nd 1940, in the Town Hall of and at the said Town of Atlantic
Beach, Florida.
4. At said time and place the said Town Council of the
said Town will sit as en equalizing board and , after said
complaints have been heard as aforesaid, and any needed and
reasonable adjustment made with respect to any assessment on
any particular lot , tract, or parcel of land as shown on the
said special assessment roll , the said roll will then ehd
there be finally approved and confirmed by the said Town
Council.
5. The notice called for in paragraph "2" hereof , ante ,
shall be in substantially the following words end figures:
"N OTICE
TO: All Property Owners in and of the Town of Atlantic
Beach, Duval County, Florida, Interested in those
Certain Special Assessments r'ully Shown and yet Out
in the Hereinbelow Appended "Town of Atlantic teach,
Duval County, Florida , ASSESSMENT ROLL; Made in
Accordance with Section 3027, Compiled General Laws
of Florida, 1927; Based upon those certain Resolutions
Numbered, Respectively, 50 and 51 , and Passed by the
Town Council of the said Town; and in the Matter of
That Certain Street improvement rrogram Undertaken,
in the said Town, on July 28 , 1938, and therein
completed on January 5 , 1939" .
You, and each of you, will please take notice that at
8: 00 o 'clock r.M. , on the Tuesday night of July 2nd, 1940, in
the Town Hall of and at the Town of Atlantic beach, Duval
County , Florida, complaints will be heard with reference to the
hereinabove mentioned and hereinbelow described special assess-
ments; and at said time and place the Town Council of the said
Town of Atlantic Beach will sit as an equalizing board and , after
said complaints have been heard as aforesaid , and any needed and
reasonable adjustment made with respect to any assessment on any
particular lot, tract or parcel of land as shown on the said
special assessment roll , the said roll will then and there be
finally approved and confirmed by the said Town Council .
Kindly govern yourselves accordingly" .

Mr. xosborough moved that this t-esolution be adopted; Mr.
Trout seconded the motion and the voting was as follows :

Against: None.
A discussion was had regarding outstanding bills in
connection with the garbage incinerator. The following
resolution was offered by ivr. Posborough :
The Town Clerk and President of the Town Council be,
and they are hereby directed to give Farquhar Machinery Company
a note for t922.60, bearing interest at 5%, payable in one year
from July 1 , 1940. The interest to be paid from July 1 , 1939
to July 1 , 1940.
Mr. Trout seconded the motion and the Resolution was
unanimously adopted.
The Town Clerk was authorized to pay interest on $113.40
to June 1 , 1940, in amount of x'6.93, to the Sherman Concrete
Company, which is another outstanding bill in connection with
the Incinerator.
Mr. Howell , Town Attorney, discussed the various suits
of the Town.
Mr. Posborough brought up the question of traffic on
Atlantic Boulevard and the advisability of enforcing traffic
regulations on this Highway to the canal, if permission could
be secured from the State Highway Department. After
considerable discussion the matter was referred to the Town
Attorney and the Police Committee to see if some plan can be
worked out.
The Mayor explained about a meeting he had with Buckman,
Ulmer and Mitchell regarding the waterworks, and after some
discussion, the Mayor and President of the Council were
authorized to tender, through Buckman, Ulmer and Mitchell , a
letter to N. H. Adams, 3r. , containing a proposition to pur-
chase from Mr. Adams all pipes , meters, et cetera, outside the
Hotel Reservation, the Town to pay the sum of $10,000, such
pipes, meters, et cetera all of a physical nature, the purchase
price to include the use of the wells, aeration plant and tank
until such time as a Distribution system can be erected. The
time limit on such construction to be mutually agreed upon,
but not to exceed five years and not to be less than three
years. The $10,000 to be paid by the Town preferably by bond
issue, and possibly through the payment of ad valorem taxes for
general purposes.
There being no further business for discussion, the meet-
ing was adjourned.
