06-18-40 v MINUTES OF A SPECIAL MEETING OF THE ATLANTIC BEACH TONN COUNCIL HELD AT THE TOWN HALL AT 8:00 P. M. JUNE 18, 1940. Present: E. L. Chiasson J. C. Outler R. E. Sugg Yr. George H. Smith, the Mayor, was also present. This meeting was called pursuant to the following notice: "To: George H. Smith, Mayor, J. C. Cutler, G. L. Rosborough Robert E. Sugg, Thomas /t• Trout, Councilmen, and C. P . Frazier, Town Clerk. You, and each of you are hereby notified of, and respect- fully urged to be present at a special meeting of the Town Council of the Town of itlantic Beach, Duval County, Florida , to be held at the Town Hall in said Town at 8 P. M. , the 18th day of June, 1940, for the purpose of: Considering an arrangement with the City of Jacksonville for the installation of street lights , supplying current therefor and the payment therefor. Dated at Atlantic Beach, Florida, this 14th day of June , 1940. Signed: E. L. Chiasson President, Atlantic Beach Town Council . " The minutes of the regular monthly meeting of June 4th were passed until the next regular monthly meet- ing. The Chair explained the purpose of the meeting, as having to do with street lights. The Mayor and City Supervisor advised of arrangements with the City of Jacksonville for 27 street lights and the furnishing of current for these lights. It was explained that the cost of installation would not exceed ,*1500 for 27 lights and that t're method of payment for this installation would be by returning to the City of Jacksonville an amount equal to the earned franchise tax semi-annyally. It was also explained that Jacksonville would allow the use of current allotted for power purposes for these street lights. Thereupon, Mr. Outler introduced the Resolution which is attached to and made a Hart of these minutes, which was seconded by Mr. Sugg and by the following vote unanimously adopted: For: E. L. RESOLUTION NO. 1:44/-- A RESOLUTION Relative to the Installation of Certain Street Lights in and at the Town of Atlantic Beach, Duval County, Florida, WHEREAS, there is a pressing need for better street 4 lighting in and at the Town of Atlantic Beach, Duval County,Florida ; and WHEREAS, the City of Jacksonville , Duval County, Florida, has agreed to forthwith completely install, at a cost not to exceed Fifteen Hundred ($1500.00) Dollars, twenty-seven (27) street lights in the said Town of Atlantic Beach at points designated by the Town Council thereof; Be it therefore now RESOLvED by the Town Council of the Town of Atlantic Beach, Duval County, Florida , that: Section 1. The above-mentioned agreement by the City of Jacksonville, Duval County, Florida, is satisfactory to, and hereby accepted by, the said Town of Atlantic Beach. Section 2: With respect to the aforesaid charge of Fifteen Hundred ($1500.00) Dollars, the said Town states that this is the maximum figure for which it may be bound in payment for the contemplated improvements; as it admits itself liable only for the actual cost* *of labor , materials, engineering services, etc. -1- • attendant upon the installation of the aforesaid street lights, twenty-seven (27) in number -- and this only in the event such actual cost does not exceed the named sum of Fifteen Hundred ($1500.00) Dollars. Section 3: The said Town of Atlantic Beach will pay said actual cost attendant upon said installation of the aforesaid street lights out of the proceeds of that certain tax levied AP upon the said City of Jacksonville' s franchise to conduct an electric light, power, and supply business in the said Town, and more fully described in and by Ordinance No. 40 of the said Town. Such payment (a) will be in semi-annual , non-interest bearing installments, on or before the first days of January and July of each year, until the indebtedness hereinabove proposed is fully discharged and liquidated; and (b) will be made by warrant upon the treasury of the said Town drawn immediately subsequent to, and in the same amount as, the portion of the said City of Jacksonville's said franchise tax falling due , and payable , at the same time. 4 Section 4: As to payment by the said Town of Atlantic Beach for the current to be supplied to the said street lights: In accepting the aforesaid Ordinance No. 40 the said City of Jacksonville granted unto the said Town, without charge therefor, one thousand (1,000) kilowatt hours of electric current per mon th to be utilized for power purposes. The said Town consequently declares that in paying the said City of Jacksonville for the electric current to be used and consumed by the twenty-seven (27) street lamps aforesaid, it will deduct from the total amount due on account -2. 0 thereof , and credit itself on all rendered bills with, the monetary equivalent of any unused portion of the said one thousand (1,000) kilowatt hours during the respective periods of calculation involved.
