08-06-40 v MINUTES OF THE REGULAR MONTHLY MEETING OF THE ATLANTIC BEACH TOWN COUNCIL ON AUGUST 6 , 1940 HELD AT, THE TOWN HALL AT 8:00 P.M. A roll call showed that a quorum was not present and the meeting was adjourned until Wednesday night, August 7th at 8 P.M. On August 7th a roll call showed the following members present , which constituted a quorum: E. L. Chiesson J. C. Outler G. L. Rosborough Thomas N. Trout The Mayor, Mr. George H. Smith and Mr. C. C. Howell , Sr. , representing the Town Attorney, were also present. The Clerk read the minutes of the regular monthly meeting of July 2, 1940, which were approved as read. The Clerk read the minutes of the Special Meeting of July 18th, which were approved as read. Mr. Osborne, Town Treasurer, submitted his usual monthly financial report, which was approved and ordered filed, upon motion of Mr. Trout, seconded by Mr. Rosborough. Corporation 15.00 15.00 1235.74 723.54 Upon motion of Mr. Outler, seconded by Mr. Rosborough, the President of the Town Council and the Town Clerk were authorized to reduce the note at the Florida National Bank, due on August 12th, from -;500 to 400 and to extend this note for ninety days. _ The regular order of business was suspended in order that the Council could hear Mr. P. M. Burroughs. Mr. Burroughs raised the question of bus service available to colored help at the Beaches. He stated that the bus line is not furhishing sufficient buses to transport colored help with a reasonable degree of promptness; that very often as many as three buses would pass up negroes and they would have to wait on buses from two to three hours both morning and evening; that several employees have been discouraged in using their own cars to carry others to and from Jackson- ville. This matter was discussed at length and the City Supervisor was directed to communicate with Jacksonville Beach and Neptune Beach in an effort to secure concerted effort on the part of the Beach communities to have additional buses provided or some other means of trans- portation. Mr. Burroughs also called attention to the weeds on the side walk between Beach Avenue and Ocean Boulevard. It was explained to him that weather conditions for the past month had not only caused the weeds to grow hut had hindered the work of the Town to such a degree that the Town Crew has operated behind schedule. Mr. Burroughs was assured by the Council and City Supervisor that this matter would be attended to es soon as possible. Upon resuming the regular order of business, the Mayor reported in reference to the installation of street lights; that he had conferred with Ernest Anders end that Mr. Anders had promised to have the work done at once. Mr. Smith also reported that the reason for the delay in making this installation of lights has been due to the emergency work required by the Naval Air Station. Final action on the Building Code was passed to a later date. Mr. Rosborough reported that nothing had been done concerning the proposed traffic light on Atlantic Boulevard, but that he had hopes that one would be placed there some- time before the next season. The Town Attorney advised by letter that he had looked into the matter of the road and Bridge Tax and that he had been furnished with certain figures by the County Commissioner Howard Belote and County ?ngineer Sollee indicating that the Town of Atlantic Beach had benefited by work performed by the County in an amount possibly exceeding that which would be obtained if a set-up were followed by which the Town would secure the return of taxes collected for that purpose. It appeared, however, that in this statement of work performed, a considerable outlay, which was not spent within the Town limits, , was included. The Town Clerk was directed to ask that the Town Attorney call this to the attention of the County Officials and obtain, if possible , a more accurate state- ment of the money spent within the Town. It was the attitude of the Council as a whole , that the Town would not take a position relative to legislative action in this connection, at least for the time being. The Chair explained in reference to the with- drawal of the note of_ the Mason Lumber Company from the Florida National Bank, which was secured by a certificate of indebtedness on the part of the Town to the Mason Lumber Company on account of the construction of the Incinerator. This matter was thoroughly discussed and the present Council feels that some plan should be worked out immediately for the coming tax year whereby a fee for garbage collection could be placed upon those benefited which would be applied as collected to the payment of all bills incurred in the construction of the incinerator. The City Supervisor was directed to obtain all available informa- tion, particularly from Miami and Miami Beech regarding garbage collection fees and to report his findings to the Council. s A letter from the Reconstruction Finance Corpora- tion in Washington, in reference to the retirement of bonds against the Seawall account before maturity, was read and the Town Clerk was directed to follow this matter up with a view to retiring bonds if and when possible. A letter from the Town Attorney,concerning the five lawsuits in which the Town is interested, was reed end ordered filed for information. The Town Attorney was directed to obtain technical evidence concerning the Incinerator suit, the Town Attorney to use his best judgment in the matter of fees to be paid for this work. In reference to technical witnesses for the other cases, C. C. Howell, 3r. suggested that this matter could be decided after evidence is submitted by the hotel company. It was thoroughly agreed, however, that the Town should employ well known appraisers if and when necessary. The Registration officer submitted a list of qualified voters which was examined and upon motion of Mr. Rosborou`.h, seconded by Mr. Trout, the list was approved.
