09-10-40 v 1 MINUTES OF THE REGULAR MONTHLY MEETING OF m E ATLANTIC • BEACH TWIN COUNCIL HELD PT THE TOWN HALL AT 8 P. M. , SEPTEMBER 10, 1940. I The Clerk called the roll and the following members answered present : George H. Smith E. L. Chiasson J. C. Cutler H. C. Isaacs Harcourt Pull, Jr. The Mayor, G. L. Posborough, was also present. The meeting was called to order by George H. Smith President. The Clerk read the minutes of the meeting of August 16, 1940, which were approved as read. Mr. Osborne submtted his usual financial report, which upon motion of ``r. Isaacs, seconded by Mr. Pull , was approved and ordered filed. Upon motion of Mr. Isaacs, seconded by Mr. Chiasson, the following bills were annroved and ordered paid as shown: Arnold Printing Company 16 .50 Auto Electric and Carburetor Co. .60 Southern Bell Telephone Co. 6.90 Neptune Garage 25.60 H. and W. Corp. 15.00 James David ( Ice ) 2.00 443.35 The matter of payment of insurance policies was discuss- ed, it having been suggested that all insurance premiums be combined in one account for monthly payment through a bank. Upon motion of Yr. Isaacs, seconded by Mr. Chiasson, the President of the Council and the Town Clerk were authorized to negotiate for the installment payment of all insurance premiums. The Mayor agreed to make such arrangements as are necessary to complete such a plan. Mr. Osborne , having agreed to continue as Treasurer until Vctober .Iet„ 1940, asked the Council ' s pleasure in reference to en audit of his accounts before turning the office over to Mr. Cranford. The Council unanimously agreed that no audit is necessary to make such a transfer of office and that the Council would accept Mr. Osborne 's figures as 4 correct. The regular order of business was suspended, in order to hear from Mr. Joe iilliamson, Jr. , rield Pepresentative of the firm of Russell and Axon, Engineers of St. Louis, Missouri , in reference to a proposal of his company to enter into a contract with the Town for the Construction of a waterworks. Mr. Smith relinquished the chair to Mr. Chiasson, 'Yr. Williamson explained in detail the proposal he had to offer, and read in full a proposed contract to be entered into by which the Town would (a) Secure a preliminary report which would enable the Town to arrive at a definite plan for waterworks , A furnishing all of the elementary engineering data necessary ijo therefor, an estimate of cost, method of procedure, et cetera. For these services the Town would obligate itsself to nay the sum of - 185. (b) Should an economical plan be devised, the estimates be within the requirements of bond buyers and all other things be completed by which the Town could nroceed with the construction of a waterworks, the Engineering firm would complete detail plans , prepare material specifications, assist in securing bids, et cetera , for 3-1/2 on the total/cost less engineering and legal fees, and Estimated (c ) To supervise during construction for en additional fee of 2-1/2 on the total cost less legal end engineering fees. After considerable discussion, several amendments to the proposed contractwere suggested and it was agreed that if and when these amendments ere written into the contract and it hes been approved by the Town Attorney, that the President of the Council/and the Town Clerk shall then sign the contract. Mayor • After fully discussing the amendments, the following were suggested, as well as such that the Town Attorney may find necessary: ( a) Expiration of contract to be August 1 , 1942. (b) Approval by Fire Underwriters Association. (c ) Negotiation with private interests and in case purchase of private property is made , an Engineer ' s fee of 2-1/2 per cent on the total cost of such private property. (d) Amend Section 3 to read "Actual Construction" . Thereupon, Mr. Smith moved, !'r. Bull seconded the motion, which was unanimously adopted, that the contract he approved if and when amended and approved by the Town attorney; that the Public works committee be authorized and directed to handle the matter and when ready for final execution it be presented to the President of t•'e council and the Town Clerk for signature. Mr. Smith resumed the Chair. A discussion was then had on the proposed_ Budget for the year 1940-41 . Each item was discussed and after amend- ments and corrections, the following, upon motion of Mr. Chiasson, seconded by Mr. Bull , was put to a vote for approval : Garbage Collection. Street Department, Parks and Up-keep. Salt Air Water 1CO. • Franchise Tax - Lights 450. Penalties 300.. Miscellaneous 300. 4300. 13724. For Approval: Mr. Iseacs, Mr. Outler, Mr. Chiasson Against: Bull , Mr. Smith. Mr. Smith explained his vote against es being opposed to including an item for garbage collection in the Town to be based on fees against the patrons when no such Ordinance has yet been passed. Mr. Bull stated that he wished to enter the same explanation. The Town Clerk advised that the Tax Assessor had instruct- ed him to submit to the Council the following matters concerning the preliminary tax roll for the coming year and after these matters had been duly considered by the Council In an advisory - manner that the Preliminary Roll be submitted to the Council for approval and adoption: That for the most part, the assessments for 1939 be followed, That he had placed the preliminary assessment against the Hotel Reservation on the same basis as lest year and asked whether or not that would meet the approval of the Council . The Council unanimously agreed to Mr. Mite ' s action in this connection. Mr. White asked in reference to the assessment against Lots 3 and 4, Block 42, there apparently being en error in the 1939 assessment , end whether or not it is the wish of the Council to make any change therein. In accord- ance with unanimous opinion, the assessment was placed at 9550 on the property. . All other questions raised were allowed to be governed by the figures shown on the 1939 roll. The Preliminary Roll was then tendered for adoption. Mr. Isaacs introduced the following Resolution, which was seconded by Mr. Outler And unanimously adopted: RESOLUTION APPROVING PRELIMINARY TAX ASSESSMENT ROLL FOR THE YEAR 1940. WHEREAS, the Town Tax Assessor has completed the . Preliminary assessment roll of the Town of Atlantic Beach, Florida for the year 1940, end has submitted ., the same to the Town Council , end . WHEREAS, It appears that all property , real and , personal , in the Town of Atlantic Beach subject to taxation hes been assessed on said tax assessment roll , and the, Tax Assessment Poll is in due form, THEREFORE BE IT RESOLVED by the Town Council of the Town of Atlantic Beach, Florida, that the said Preliminary Tax Assessment Roll be and the same is hereby approved, . BE IT FURTHER RESOLVED that the Town Clerk shall post et the Town Hall end at two other public places . in the Town and shall also caused to he published . daily for four consecutive days in a newspaper published in the City of Jacksonville, Duval County, Florida , notice. that said assessment roll hes been subm=tied to the Town Council and approved and also requiring all persons desiring to have corrections thereof made, whether in the listing, valuation of property or. otherwise , to file with the Town Tex Assessor on or before the First day of October, A. D. 1940 at 8 o' clock P. M. , their petition to the Town Council setting forth their objection to said assessment roll and the correction they desire made , and also that the Town Council will meet at the Town Hall in Atlantic Beach on the. First Day of October, A. D. 1940 at 8 o 'clock P. M. for the purpose of equalizing said assessments and making proper corrections therein. Upon motion of Mr. Isaacs, seconded by Mr. Outler, the Town Clerk was directed to post_ the following notice at the Town Hall and at two other public places in the Town and to cause the said notice to be published four consecutive_ times in a Jacksonville, Fuvel County , Florida newspaper: • "NOTICE OF COMPLETION OF PRELIMINARY TAX ASSESSMENT ROLL OF THE TOWN OF ATLANTIC BEACH, FLORIDA, FOR THE YEAR 1940. 1 TO ;'IHOM IT MAY CONCERN: You are hereby notified that the Preliminary Tax Assessment Roll for the Town of Atlantic Beach, Florida , for the year 1940, has been completed and submitted to and approved by the Town Council. All persons desiring to have corrections made thereof , whether in listing, valuation of property or otherwise , are required on or before the 1st day of October, A. D. 1940, at 8 P. M. to file with 110 the Town Tax Assessor of the Town of Atlantic Beach , their objections to the said assessment and the corrections that they desire made . "The Town Council will meet at the Town Hall in the Town of Atlantic Beach, Florida, on the First day of October, A. D. 1940, for the purpose of equalizing said assessments and making proper corrections therein. x',11 persons who shell file petitions as aforesaid will be given the opportunity to be heard at said meeting.
