10-08-40 v MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH TOWN
COUNCIL HELD AT THE TOWN HALL AT 8 P. M. , OCTOBER 8, 1940.
The Clerk called the roll and the following answered
present :
Geo. H. Smith,
H. G. Isaacs,
Harcourt Bull , Jr.
The Mayor, Mr. G. L. Rosborough was also present.
The Clerk read the minutes of the Regular monthly
meeting of September 10, 1940, which, upon motion of Mr. Bull
seconded by Mr. Isaacs, were approved as read.
The Clerk read the minutes of the Special meeting of
October 1 and the minutes of the Equalization Board on the
same date, which were approved as read.
Mr. Osborne, retiring Treasurer, made his usual
financial report, which was approved and ordered filed . Mr.
Cranford, the incoming Treasurer , was present end perticinat-
ed in the financial report. Mr. Osborne reported that all
Seawall bonds and coupons had been retired for 1940.
Upon motion of Mr. Bull, seconded by Mr. Isaacs, the
following resolution was unanimously adopted:
BE IT RESOLVED by the Mayor and Town Council of Atlantic
Beach , Florida that the Town Clerk be instructed to furnish
a statement to the Town Attorney of each Seawall Construc-
tion account,now delinquent, for collection by suit.
BE IT FURTHER RESOLVED that the Town Attorney may, at his
discretion, attempt the collection of such accounts es it
may be possible to collect, within a reasonable length of
time , before filing suits . ,,,
BE IT FURTHER RESOLV {.D that the Town Clerk be, end he is
hereby instructed to first write a letter to each person now
delinquent, advising that this action has been directed by
the Town Council end that unless such accounts have been paid
up to date on or before the 19th day of October , 1940, that
such certification as is directed herein be completed and
filed with the Town Attorney.
Upon motion of Mr. Isaacs , seconded by Yr. Bull the
following bills were approved and ordered naid , if and when
funds are available:

The matter of Mr. Howell ' s bill was discussed and
particularly in reference to the bill for professional
services in the Nye Odorless Incinerator Company case
Pilk against the Town. The Clerk was directed to write Mr. Howell
a letter inquiring whether or not a claim could be placed
against the Plaintiff in this case for attorney ' s fees and
other necessary costs incurred by the Town.
The Clerk reported the cost to furnish material to NPA
to build chairs. This matter was passed.

Upon motion of Mr. Bull , seconded by Mr. Isaacs ,
the Town Supervisor was directed to secure new bids for
the application of paint to the Town Hall End to hire
extra labor to remove as much of the old paint as possible
before the painter , hired to do the work, starts to work,
and that the Town Supervisor accept the best bid for the
work and to purchase the necessary material for the work.
The Town Supervisor to use his judgement as to when funds
would be available for this work.
The Town Supervisor raised the matter of the water
tap at the Boy Scout Hut. He explained that the water line
has been run to the Scout Hut but that it has not been
covered in payment for the tap charge set up by the previous
Council and that since that time the Church had been built
and a tap is necessary there. This matter was thoroughly
discussed.
Mr. Bull moved that the tap charge for Saltair
water be fixed at X15 per tap and that each new customer be
charged this fixed fee. Mr. Isaacs seconded the motion and
it was unanimously adopted.
By unanimous agreement, the Town Clerk was direct-
ed to accept payment for these two taps from the Church and
Boy Scout Hut either in cash or in labor to cover the pipe
from the well to the property line of the two institutions.
It having been shown that Mrs. Ethel Lake had
secured Homestead Exemption on her Beach property for the
year 1937 from the State end County; that she had not
applied for exemption on any other property; and that she
had represented that she had made such an application to
the Town of Atlantic Beach, but that such application could
not be found in the office , Mr. Isaacs moved that it be
considered that Mrs. Lake had filed application with the
Town and that the exemption be granted. Mr. Bull seconded
the motion end it was unanimously adopted.
The purchase of tires for the Police car was
discussed, the Town Supervisor having secured prices from
various standard make tire dealers. The Atlas tire is
favored. However, Mr. Isaacs expressed the opinion that he
could secure a better price than that quoted the Town and
the matter was turned over to him to secure a better price ,
if possible .
Mr. Isaacs presented an Ordinance entitled, "AN
ORDINANCE TO APPROVE AND ADOPT THE TAX ASSESSMENT ROLL FOR
THE YEAR 1940, AND TO DETERMINE AND FIX THE RATE OF TAXA-
TION AND MAKE THE ANNUAL TAX LEVY OF THE YEAR 1940" , for
third and final reading. The Ordinance was read and upon
motion of Mr. Isaacs, seconded by Mr. Bull, it was passed
on third and final reading.
Mr. Bull presented an Ordinance entitled, "AN
ORDINANCE ESTABLISHING STREET NUMBRING DISTRICTS AND
SYSTEMS IN THE TOWN OF ATLANTIC BEACH; IMPOSING CERTAIN
DUTIES ON THE BUILDING INSPECTOR; REGULATING ASSIGNMENT,
PLACEMENT, AND MAINTENANCE OF STREET NUMBERS ON BUILDINGS
WITHIN THE TOWN; PROVIDING PENALTIES FOR VIOLATIONS THERE-
OF ; AND REPEALING ORDINANCE NO. 16A AND OTHER ORDINANCES IN
CONFLICT HEREWITH" 'and moved its passage on first reading.
The motion was seconded by Mr. Isaacs and the Ordinance was
passed on first reading.
Upon motion of Mr. Bull, seconded by Mr. Isaacs,
this same Ordinance was passed on second reading.
The Town Clerk reported that the contract with 4111
Russell and Axon, Engineers, for the construction of a water-
works had been executed and forwarded to the St. Louis office
for signature by the firm, and read a letter from Mr. Joe
Williamson, Jr. , advising that preliminary work would be
started soon.
Mr. Isaacs , representing the Police Commttee , report
ed complaints regarding the dog owned by Carl Buck. This
matter has been reported to the Council on previous occasions.
The matter was turned over to the Mayor to handle and the Laws
and Rules Committee was asked to give the matter of an
Ordinance restricting dogs in the Town attention and make a
report.
A letter signed by the Building Inspector and address-
ed to W. H. Adams concerning old buildings at the north (Tenth
Street side ) of the Hotel Reservation and presented for the
approval of the Mayor, was submitted to the Council for
consideration. At the same time the matter of Other old build-
ings and conditions on lots where buildings have been torn
down or partially burned was raised. The whole question was
referred to the Laws and Rules Committee for consideration.
The Mayor raised the question of a contribution to
P. T. to help care for indigent children in the Atlantic
Beach School . After considerable discussion, Mr. Isaacs moved
that the Town contribute 410 per month for three months or a
total of 00 for this purpose. The motion was seconded by Mr.
Bull and unanimously adopted.
The Mayor raised the question of bills payable on
account of the Incinerator and asked that the creditors be
given some promise of a definite plan to liquidate these
accounts. The 1940-41 budget has :1000 in it for debt service
on the Incincerator and the chairman of the Finance and Taxa-
tion Committee was asked to work out some definite proposal to
pay off these accounts.
The Mayor reported that he had the matter of securing
shades for street lights complained of in his hands for action
and that he would keep after the Jacksonville officials in an
effort to have them carry out their promise to furnish them.
Mr. Bull stated that he had endeavored to secure
information relative to the completion of Sherry Drive from the
Plaza to the new School. The matter was discussed and it was
decided that a concerted effort would be made to influence the
County Commission to have this road completed by securing a
large representation of those interested to go before the
County Commission.
The City Supervisor raised the question of the legal
status of bus, taxicab and freight lines in the Town and
recommended that the necessary steps be taken to provide such
legal status and to place some sort of license or franchise
tax thereon. This matter was referred to the Laws and Rules
Committee.
The City Supervisor raised the question of placing
the installation of cooking gas upon en inspection basis in
the same manner that plumbing is inspected and to provide means
of obtaining some sort of remuneration to offset the loss of
tax from electrical current. The matter was referred hack to
him for his consideration and the preparation of an Ordinance
to cover such installation.
The City Supervisor recommended some amendments to
the Licensing Ordinance to include some activities not now
covered. He was directed to prepare such an amendment.
The Clerk read a le tter from the Town attorney in
reference to the Town 's authority to issue Revenue Mortgage
Certificates. The letter was received and ordered filed for
information.
The ulerk read a letter from the Town Attorney regard-
ing the suit against W. H. Adams , which was received and order-
ed filed for information.
The ulerk read a letter from Geo. H. Smith, as Clerk
of Sessions for the Atlantic Beach Community Church thanking
the Town
Officials for cooperation in the use of the Town Fall
for the past several years.
The Clerk read a letter from Mrs. Brooke G. "Jhite ,
Jr. , President of the Atlantic Beach Garden Circle , asking
help from the Council to maintain the Park during the com-
ing year. The matter was thoroughly discussed, and by
unanimous consent it was agreed to turn the Park over to
the Garden Circle for their project for this year. There-
upon, Mr. Isaacs moved that a sum not exceeding 412 per
month for the next twelve months be set aside from the
extra labor item in the Budget to be paid out on certifica-
tions by the Garden Circle covering labor only, the labor
to be under the supervision of the Garden Circle and the
Garden Circle to certify to the Town Clerk all sums due
such labor.
There being no further business for consideration
the meeting was adjourned.
