MINUTES OF TREE CONSERVATION BOARD Apri19, 2003 A regular meeting of the Tree Conservation Board vas held Wednesday, Apri19, 2003, at Adele Grage Community Center. Present were Chair Barbara Mears, Tom Hill, David Owens, Bill Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at'7:03 ~.m. 2.RecoQnition of Visitors None. 3. Approval of Minutes of Meetings oflVl-arch 2~6, 2003 A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to approve the Minutes of the Tree Conservation Board meeting of March 26, 2003. 4. Old Business A. Tree Removal Applications: 1) 725 Atlantic Boulevard (North~eac-h Center): Moved to after New Business. 5. New Business• A. Tree Removal Applications: 1) Lot 1, Hidden Paradise: Applicant was not present so moved to .later in the.meeting. 2) Lots 721 and 722, Section 3, Saltair: Mr. George Bull, Architect, and Mr. Steve Hamilton introduced themselves. Mr. Bull ad-vised-tfiat this morning lVfr. Ford called him and advised that the setbacks provided on the submitted survey were the zoning setbacks, not the setbacks as required by the Tree Ordinance. Therefore, fie statedtfiat he was providing a revised site plan that shows the correct setbacks. Mr. Bull requested that they be allowed to plant the mitigation trees across the street on the City right-of=way at the rear ofthe Laurel Plaza shopping center. A motion was made by Board Member Owens, seconded by Board Member Permenter, and unanimously carried to direct the Building Official"to issue a permit for the removal of 20" of palm and 65" of pine to be mitigated on site with 18" of palm and 40" of pine; and the removal of 22" of oak to be mitigatedwith 11" of oak~to be planted in the city owned right- of-way at the rear of Laurel Plaza on Sturdivant Avenue. 1) Lot 1, Hidden Paradise: Mr. Paul Nichols introduced himself. He stated that he was advised by Sonya Dcerr of Planning and Zoning that the front of this lot was not Levy Road but Begonia Street. He stated that based on this new information, he would like to come back to the Board in two weeks with a new survey. Mr. Nichols withdrew his application. Discussion was held with regard to tree removal permits for Paradise Preserve. Mr. Nichols proposed two phases for tree removal permitting: Part A as~the right of way and Part B as the community area. He stated that his company was wiIling to post a bond equal to the value of the mitigation required in the right-of--way (Part A) and when Part B is completed, use mitigation on site to reduce the bond for Part A. Mr. Nichols suggested a Saturday meeting on site to handle the tree removal application for Part A. tLli~rirtes ojTree Coraservatiorr Board April 9, 2003 Page 2 3) 2248 Barefoot Trace: The applicant was not present. A motion was made by Board Member Shaughnessy, seconded by Board Member Owens, and unanimously carried to direct the Building Official to issue a permit for the removal of a 14" Sweet Gum to be mitigated with a 14".Laurel Oak on site near the driveway. 4) Lot 1, Block 200, Section H: Building Official Ford advisedthat he met with the builder with regard to Agenda items 4) through 9). He stated that he advised the builder that the Tree Conservation Board would not be able to proceed with these applications until the lots were under brushed. A motion was made by Board Member Owens, seconded by Board Member Permenter, and unanimously carried to defer these applications until the applicant under brushes the lots. 5) Lot 2, Block Z00, Section H:. Old Business A. Tree Removal Applications: 1) 725 Atlantic Boulevard (North Beach Center): Discussion was held with regard to the mitigation trees and whether or notccape_myrtles are.allawed_ Board Member Permenter pointed out-thatthe applicant has enough-trees-forznitigation-withont~onnting the crape myrtles. A motion was made by Board Member Permenter, seconded by Board Member Hill, and unanimously carried to direct the Building Official-to issue a permit for the removal of 431" of palm to be mitigated by planting 217" of palm on site. The Board recommends that shade trees be used in lieu ofthe crape myrkles. 7. Reports and Announcements A. Report from Staff with Regard~to Paradise Preserve: Building Official Ford referenced his memo on issues with regard to Paradise Preserve. He stated that the City requires 100% mitigation on rights-of--ways. He further stated that this is not stated in the ordinance but began about 1~ years ago and is eriforced. Building Official Ford stated that the Board-has been finding "holes" in the Ordinance which need to be documented and presented to the Commission. 8.
