MINUTES OF TREE CONSERVATION BOARD October 2, 2000 A regular meeting of the Tree Conservation Board was held Wednesday, October 2, 2000, in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Richard Bell, Judith Jacobson, Barbara Mears, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of September 5, 2000 A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve the Minutes of the Tree Conservation Board meeting of September 5, 2000, as presented. 4.A. Old Business/Tree Removal Applications 1. None. 5.A. New Business/Tree Removal Applications 1. West 53 feet of Lot 2, Tract A, North Atlantic Beach, Unit 3 (Second Lot on North Side of 19th Street): Due to the applicant not being in attendance at the meeting,this item was moved to • later in the meeting. 2. 1820 North Sherry Drive: Mr. Ray Magley, owner of the property, explained he needed to remove the 24"oak tree for the purpose of building an addition to his home. After discussion with the Board, Mr. Magley agreed to preserve the 4"oak on the north side of the property and the 10"oak on the south side of the property. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 24" of oak to be mitigated with a 10" oak and a 4" oak on site. 3. 31 Lewis Street: Reverend Marvin Nash of 12425 Eagles Claw Lane, Jacksonville, stated that the Helping Hands Ministries would like to add space to the back of the current building and would,therefore, need to remove the 22" Magnolia tree. Board Member Bell asked the applicant if it was really necessary to remove the Magnolia tree and Reverend Nash advised that it was. A motion was made by Board Member Bell, seconded by Board Member Mears and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of a 22" Magnolia to be mitigated on site with 11" of new hardwood. 1. West 53 feet of Lot 2, Tract A, North Atlantic Beach, Unit 3 (Second Lot on North Side of 19th Street): No one was present to address this application. After discussion,the Board determined that no protected trees were being removed from the lot and one cabbage palm was being relocated on site. • Minutes of Tree Conservation Board October 2, 2000 Page 2 • A motion was made by Board Member Bell, seconded by Board Member Mears and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the relocation of one 24" cabbage palm on site. 4. 2055 Beach Avenue: No one was present to address this application. Board Member Mears stated her concern of the complete flattening and paving on the lot. Board Member Bell declared that this home is located in one of the most unique groupings of sites in Atlantic Beach. In addition,the Board discussed their concerns regarding removing the dune between the house and Beach Avenue. Chairperson Jones requested that Building Official Ford provide them with information on the protection of dunes. The Board further discussed how the change in elevation of the lot would adversely affect neighboring properties. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried that we table this application and compose a letter to the owners and that Mr. Ford speak with the owners to express our views. Board Member Jacobson suggested that instead of writing a letter,the Board provide phrases for Building Official Ford to use when speaking with the owners. The following are the concerns the Board would like discussed with the owners: • The unique and irreplaceable topography of the lot • The unique tree groupings with the surrounding lots • Enhancement to the neighborhood that this lot provides • Loss of irreplaceable dune configurations • • Possible impact of erosion on adjoining property • Loss of canopy on the street • Loss of privacy to the neighbors • Consult with architect to paint realistic picture in terms of elevation • Loss to community in terms of walkway and bikeway 6. Reports and Announcements 2316 Beachcomber Trail: The Board discussed the ambiguity of the letter from Early Piety to Cindy Corey dated September 8, 2000, regarding 2316 Beachcomber Trail. Board Member Bell pointed out that Early Piety indicates in this letter that the live oak tree measures 32"dbh instead of the 26"dbh stated on the Tree Removal Application. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried that since Early Piety's letter did not say that the tree was dead or dying and,that in his expert opinion, it was 32" dbh,we approve the application and direct Building Official Ford to issue a permit for the removal of this 32" dbh oak tree with 16" of mitigation to be paid into the Tree Fund. Chairperson Jones expressed her concern regarding the lot to the east of the lot on 19th Street. Building Official Ford stated that there were no protected trees on the lot and the Builder is attempting to protect some small trees. In addition, Chairperson Jones expressed concern that a builder is allowed to clear a lot prior to coming before the Tree Conservation Board. Building Official Ford advised that a lot can be cleared if there are no protected trees being removed and that it is the job of Code Enforcement to ensure that no protected trees are removed. Chairperson Jones also stated her alarm that the builder had filled in the lot. Building Official Ford indicated that the builder had filled in the lot about three feet. Building Official Ford further indicated that no standards are in • place as to how much a lot can be filled. • Minutes of Tree Conservation Board October 2, 2000 Page 3 • Chairperson Jones and Board Member Jacobson stated that they appreciated that money had been allocated in the 2000/2001 budget to survey the historic palms. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried that we proceed with the survey on the historic palms. Chairperson Jones asked Building Official Ford if the plans for Dutton Island Park would be coming before the Tree Conservation Board. Building Official Ford stated that they would be but the plans would only show the location of the walkways. However,the Tree Conservation Board can request that a survey be provided showing the trees adjacent to the walkway. Don Ford distributed a letter from the City Manager to the Jacksonville Transportation Authority dated September 13, 2000, regarding the proposed retention pond off Mayport Road. Board Member Bell asked if this retention pond could be turned into a park,thereby turning a negative into a positive. The Board applauded the City Manager and Mayor's efforts. Board Member Bell brought up the issue of the parcel of land next to Tresca Park being included in the park so that it could not be developed or sold. The Board determined that Judith Jacobson would draft a letter to the Commission requesting that this parcel of land be included in Tresca Park and Board Member Jacobson would bring the draft letter to the next Tree Conservation Board meeting. Building Official Ford will provide a diagram, which can be included in the letter. Board Member Jacobson requested that the latest version of the Tree Ordinance be copied on colored paper and distributed to the Board Members. S 7.
