MINUTES OF TREE CONSERVATION BOARD 110 December 18, 2000 A regular meeting of the Tree Conservation Board was held Monday, December 18, 2000, in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Richard Bell, Barbara Mears, Judith Jacobson, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of December 4, 2000 Board Member Jacobson requested that the Minutes of December 4, 2000, be corrected as follows: Page 2, 5.A.1)add"There is a"before"Cherry Laurel at site which is not on plan." A motion was made by Board Member Jacobson and seconded by Board Member Bell and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of December 4, 2000, as amended. 4. A. Old Business/Tree Removal Applications All Old Business agenda items were addressed after New Business Tree Removal Application 1)467 Inland • Way. 5.A. New Business/Tree Removal Applications 1) 467 Inland Way: Dane Boggs of 684 Ponte Vedra Boulevard, Ponte Vedra Beach, introduced himself. Mr. Boggs informed the Board that Mr. and Mrs. Elder would like to build a room addition on the south side of their house;therefore, they need to remove one 20"oak tree to allow for this construction. Mr. Boggs suggested preserving trees in the front of the property for mitigation. The Board determined that the 20"oak tree is actually a 25"oak tree. Chairperson Jones expressed her concern with regard to whether or not this property had previously been before the Tree Board and whether or not the trees in the front of the property are already protected. After accessing the City file on this address, Building Official Ford and the Board determined that the trees proposed for mitigation have not been previously used for mitigation. A motion was made by Board Member Bell, seconded by Board Member Mears and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of a 25" oak to be mitigated with a 13" oak to be preserved on site. 4.A. Old Business/Tree Removal Applications 1) 2019 Beach Avenue: Building Official Ford indicated that Mr. Grider would not be able to attend the meeting. The Board determined that the applicant is requesting the removal of one 20"protected palm tree. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 20 inches of palm to be mitigated by two palm trees on site to measure at least 10 inches, to be confirmed by Building Official Ford. • , Minutes of Tree Conservation Board < December 18, 2000 Paget 0 2) 465 Beach Avenue: The applicant was not present to speak to this application. The Board determined that the proposed trees listed for removal are not protected. A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve the application as there are no protected trees on the property, and to direct Building Official Ford to issue a permit. 3) Discussion of Revised Landscape Plan for 589 Levy Road: Building Official Ford brought this application before the Board again. Building Official Ford advised the Board that he spoke with the City Attorney, Alan Jensen, with regard to what latitude the Board has in requiring specific types of trees to be planted. In this conversation,the City Attorney asked Building Official Ford if any precedent had been set. Building Official Ford advised the City Attorney that a precedent had been set in at least four cases where the Board had allowed crape myrtles to be used on projects with no stipulations, except for one stipulation in one case. The City Attorney recommended that the Board try to be as consistent as possible. In addition,the City Attorney stated that if the Board wanted specific trees to be planted in specific locations,that the Board amend the Tree Ordinance. Building Official Ford advised the Board that he brought this issue up because he was not comfortable telling the contractor to change the crape myrtles after he had given him tentative approval on the trees,based on previous approvals by the Board. Chairperson Jones advised the Board that Building Official Ford had shown her the changes that the City of Jacksonville is making to its Tree Ordinance. The City of Jacksonville is including a paragraph listing trees II and does not include crape myrtles. Chairperson Jones stated that this Board is probably going to have to look to amend our Tree Ordinance. This issue was tabled for a later date. Building Official Ford reiterated the facts with regard to 589 Levy Road. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the revised landscape plan for 589 Levy Road submitted at the Tree Conservation Board meeting of December 4, 2000, and to direct Building Official Ford to issue a permit. 4) 2316 Beachcomber Trail: The applicant was not present at this meeting. Building Official Ford reminded the Board that they had approved this application at a prior meeting. The Board had requested that if the 26"oak had to be removed, that the applicant identify the trees to be used for mitigation. Building Official Ford stated that the applicant identified a 19"oak. The Board discussed their concern with regard to the location of the 19" oak and whether or not it was already protected. After further discussion,the Board determined that it was not protected. 5) Lot North of Hess Gas Station on Mayport Road: Building Official Ford advised the Board that the City Manager requested that he bring the Jacksonville Transportation Authority's proposed plan to the Tree Board for their review. The City Manager would like comments from the Tree Board members. Chairperson Jones requested information with regard to what types of trees the Jacksonville Transportation Authority plans to plant in the Mayport Road medians. The Board determined that based on the diameter meters provided by Jacksonville Transportation Authority, 64"of oak and 216"of pine are proposed for removal. It was suggested that Building Official Ford prepare a memo to the City Manager stating that the Tree Board would like to see the site plan and the specific number of trees to be removed so that the Board can verify the information in the field prior to issuing a permit. • Minutes of Tree Conservation Board • • December 18, 2000 Page 3 II Chairperson Jones advised the Board that the City of Jacksonville is charging $117 per inch for mitigation. Building Official Ford stated the Board would be addressing this issue at the next Tree Board meeting. S.A. New Business/Tree Removal Applications 1) 467 Inland Way: This agenda item was addressed earlier in the meeting. 2) Southerly 10' of Lot 2 and the Northerly 40' of Lot 3, Block 187, Section H: No applicant was present to address this application. Chairperson Jones stated that there was a 25.25"oak cluster and a cluster in the back that the applicant was proposing to save. The Board discussed clusters of trees and determined that if you can see where the trunks are joined,then it is a multi-trunk tree. If you have to dig way down, then it is not a multi-trunk tree. Board Member Jacobson stated that she measured the oak cluster at 32.16." Chairperson Jones stated that the trees proposed for mitigation were also measured incorrectly. The Board determined that the survey was not accurate and, therefore, should be returned to the applicant. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to return the application for a more accurate survey. 6. Reports and Announcements Building Official Ford brought the Board's attention to the following: 1) A copy of a letter to the Florida Department of Environmental Protection with regard to Dr. and Mrs. Campbell. Building Official Ford stated that he hoped he captured the Board's feelings. 2) A letter from Boatwright Land Surveyors Inc. stating that the historic tree survey would be completed by • January 8, 2001. Susan Dunham distributed the 2001 Calendar for the Board's review. The Board changed the following meeting dates due to conflicting City holidays: January 1 to January 2; January 15 to January 16; February 19 to February 20; and September 3 to September 4. Board Member Jacobson stated that she was impressed with the number of barricade inspections listed in the Building Official's monthly report. Building Official Ford advised that the contractors are not erecting barricades on their oN\n; the barricades are erected after he inspects the property. The Board determined that they would remind applicants about the required barricades. 7. Campbell concerning actions of the Board as to property at 2055 Beach Aver0e. The letter is copied to you as information pertaining to the Campbell's project to build a new single family home at 2055 Beach Avenue. The Board has reviewed the Campbell's initial plan, requested changes, and • approved the changes and the final plan. The Board required the Campbells to reduce the size of impervious surfaces, shift the house seaward approximately 22 feet to save approximately 48 trees, and to save a dune next to Beach Avenue. These actions were taken by the Campbells in a spirit of cooperation in protecting the environment on this limited construction site. The Board feels like there is a conflict between the local Tree Conservation Ordinance and Florida State DEP regulations in that the Board required the Campbells to "shrink" the site and move the structure seaward to preserve the trees and save a landward dune. When the structure is relocated seaward (22 feet) it is moving, although slightly, into a seaward dune. The Board feels the seaward dune is only slightly impacted and the overall conservation attained on the site outweighs the slight encroachment onto the seaward dune. The Board appeals to the DEP to consider these facts in your review of this project and to allow the project to be constructed as approved by the Board. S' cerely, Don C.
