MINUTES OF TREE CONSERVATION BOARD • December 6, 1999 A regular meeting of the Tree Conservation Board was held Monday,December 6, 1999,in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Richard Bell, Camille Hunter, Judith Jacobson,Eloise Koerber and Staff Member Susan Dunham. The meeting was called to order by Chairperson Mae Jones at 7:35 p.m. 3.A. Old Business/Tree Removal Applications 1. Lots 1 &2,Block 102, Section H. Mr.Paul Nichols introduced himself to the Board. Mr.Nichols indicated that he missed the meeting of November 15 when this application was first presented to the Board. Mr.Nichols advised that his original reason for coming before the Board today was to discuss the mitigation requirements set by the Tree Board on November 15,but he is now before the Board to advise them that the lot has been improperly cleared of all trees except four. After discussion amongst the Board members and Mr.Nichols, it was determined that an additional 42"of oak had been removed and only 12"of oak were left on site to be used for mitigation. Discussion was held regarding whether or not Mr.Nichols should be penalized inch for inch for the additional trees that were incorrectly removed. Mr.Nichols asked that the Board take into consideration his attempt to protect as many trees as possible on his previous sites and that he immediately came to the Board to rectify the situation. Pursuant to this discussion,Richard Bell moved that heretofore people that inadvertently take out more trees than was their intent to take out with a permit and come to the Board immediately thereafter, shall be charged as if it were a • modification to the original permit. Judith Jacobson seconded the motion. Further discussion took place with Camille Hunter and Mae Jones expressing their concerns about making a general motion(not specific to this property)that might result in the Board facing a situation with a less cooperative individual. Camille Hunter suggested making the motion specific to Mr.Nichols since the Board feels that Mr.Nichols has been cooperative, has a history with the Board, and has shown that he is a conservative person who is trying to preserve the tree canopy. Richard Bell withdrew his motion. Judith Jacobson withdrew her second. Camille Hunter moved that pursuant to the application for Lots 1 &2,Block 102, Section H,after discussion with Mr.Nichols regarding this property,that since Mr.Nichols had a permit and additional trees that were to have been protected were removed in error,and given the fact that Mr. Nichols has immediately come before the Board and explained how this happened in error,that the Board will consider mitigation for these trees as a modification of the original permit. Richard Bell seconded the motion,which passed unanimously. After review of the original application and the additional trees removed from the site,Judith Jacobson moved that for Lots 1 &2, Block 102, Section H,the original application removing 134"of oak be modified with an additional 42"of oak removed by accident, leaving a total of 176"of oak to be mitigated. This will require 88"of oak, less 12"of oak to be protected on site,leaving a total of 76"of oak to be mitigated either by planting on site or by payment into the Tree Fund. Eloise Koerber seconded the motion,which passed unanimously. 4. A.New Business/Tree Removal Applications 1. This item was deferred to last because no applicant was present. Lot 6,Block 160, Section H. • Minutes of Tree Conservation Board December 6, 1999 Page 2 • 2. Lot 6,Block 79, Section H: Edward Matthews introduced himself to the Board. Mr. Matthews explained that the lot had been mistakenly cleared while he was out of town and that the following Monday he met with George Worley to discuss the matter. Mr. Matthews indicated that Mr.Worley was familiar with the lot and that Mr. Matthews had given George Worley pictures of the trees on the lot. The Board members discussed referring the matter to George Worley since there was no way for them to determine what was on the lot prior to it being cleared. Judith Jacobson moved that the application for Lot 6, Block 79, Section H,be referred to Mr. George Worley for an administrative decision. If he cannot make that decision it should then be referred back to the Tree Board. Camille Hunter seconded the motion,which passed unanimously. 3. Lot 1, Block 148, Section H: James Sanders introduced himself to the Board as owner of the property. Richard Bell advised Mr. Sanders that some of the trees are measured incorrectly and it would be to his advantage to re-measure with respect to mitigation. After discussion with Mr. Sanders, Richard Bell moved that we defer the application to allow the applicant to resubmit the survey. Judith Jacobson seconded the motion,which passed unanimously. 4. Lots 29&30,Block 3,Atlantic Beach Villa Unit 2: Jim Pelkey was in attendance to address this application. The Board made the following corrections to the site plan: the 24"pine on the north side of the property is actually an 18"pine;the 8"twin myrtle on the northeast corner is actually a 10.5" twin myrtle. Richard Bell moved that we accept the application for the removal of 56"of palm and 28.5"of hardwood to be mitigated with 15"of hardwood to be preserved on site and the planting of 4 palms totaling 28." Judith Jacobson seconded the motion,which passed unanimously. Forest Thomas appeared before the Board to address his application regarding Lots 1 through 5,Block • 243, Section H. The Board did not have his application and,therefore,was unable to act. Susan Dunham suggested that Mr.Thomas call George Worley tomorrow to determine the status of his application. 1. This item was deferred to last because no applicant was present. Lot 6,Block 160, Section H: The Board determined that the survey was not to scale, some of the trees were measured incorrectly, some of the trees were not measured and that there were no setbacks indicated on the survey. Camille Hunter moved that we defer this application until the Board receives an accurate survey. Eloise Koerber seconded the motion,which passed unanimously. 5. Reports and Announcements 1. The Board requested that George Worley make the following changes to the new Tree Removal Application: a. 7(b) Existing and proposed buildings and other improvements with dimensions and required setbacks. b. 7(d) Tree species and sizes in DBH expressed as inches. 2. The Board addressed various issues with regard to the order of agenda items. The Board requested that Susan Dunham speak with the City Clerk regarding the parliamentary rules with respect to agendas. 3. The Board discussed George Worley's increased absences from the Tree Board meetings due to other conflicting meetings. The Board determined that George Worley's attendance was critical to the Tree Board meetings. Mae Jones will speak with the City Manager. 4. Mae Jones stated that she spoke with Hope Van Nortwick regarding the inconsistency of the usage of tree caliper and DBH in the Tree Ordinance. Hope Van Nortwick indicated that it was a scrivener's error and that it was the intent that when a tree is measured in the field, it is measured in DBH;when a tree is purchased from a nursery, it is measured in caliper. The Board determined that if the issue , ' Minutes of Tree Conservation Board December 6, 1999 Page 3 • ever arises again,the Board will require that the survey indicate tree measurements in DBH and that trees purchased from a nursery will be measured in caliper. 5. The Tree Board requested an update from George Worley regarding the following: a. The survey for the Historic Tree Preservation Ordinance b. 750 Mayport Road c. Merve Russell 6. Approval of Minutes of Meeting of November 15. 1999 Eloise Koerber moved to approve the Minutes of the Tree Conservation Board meeting of November 15, 1999;Judith Jacobson seconded and the motion carried. 7.
