04-06-98 v ,1 TREE CONSERVATION BOARD Minutes of meeting of April 6, 1998 The Board held meeting on Monday April 6th,1998 at City Hall. Present were: Mae Jones, Chairman Susan Bullock Judy Jacobson Richard Bell Staff: George Worley, Community Development Director The meeting was called to order at 7:35 PM by Mae Jones, Chairman. Agenda Item 2. A. This item was withdrawn at the request of the applicant. Agenda Item 2.B. The next item was the review of the required mitigation for the removal of 62" of protected trees without a permit at 1177 Atlantic Boulevard. Mr. Geraldo Gonzales introduced himself to the Board as well as Gaitano Tabacco the owner. Mr. Gonzales explained that Mr. Tabacco did not understand that a permit was necessary for the removal of the trees. The Board explained that mitigation of trees removed without proper permits was calculated at a 1:1 ratio. This requires 50" of oak and 12" of hardwood to be replaced on-site or an equivalent amount donated to the tree replacement fund. Judy Jacobson moved to require replacement of 50" of oak and 12" of hardwood either on-site or by donation to the Tree replacement fund, at the owners option. The motion was seconded by Susan Bullock and was approved unanimously. Agenda Item 2.C. Tree removal application for 1700 Francis Avenue. Mr. Percy Golden introduced himself to the Board as representative of the Holy Church of the Living God Revival Center. After review the Board found that 126" of oak and 28" of pine were to be removed and subject to mitigation in the amount of 63" of oak and 14" of hardwood. The applicant requested the Board defer final action until the April 20 meeting to allow him to review this requirement with his church. Rick Bell moved to defer this item until the meeting of April 20 to permit the applicant to bring back a mitigation proposal to the Board. The motion was seconded by Judy Jacobson and approved unanimously. Agenda Item 3.A.1. No applicant was present, however the Board found that the application was sufficient to review. The Board noted that the stand of Wax Myrtle at the rear of the property was of such quality that they recommended to the applicant that it be saved if possible. Susan Bullock moved to approve the application as presented with notation that the 7" oak in the front be carefully barricaded to protect it during construction and that the applicant consider preserving the Wax Myrtle stand at the rear of the lot. Rick Bell seconded the motion which passed unanimously. Agenda Item 3.A.2. Michael Dunlap introduced himself to the Board as owner of this property. The Board determined that 30" of oak and 27" of palm were to be removed requiring 15" of oak and 13" of palm replacement. The applicant explained that there were existing hardwood trees on-site that he wished to use for mitigation of the palms. The oak replacement is to be mitigated by new planting or donation to the fund. The Board expressed concern about the location of the trees that the applicant wanted to use for mitigation. The applicant requested this item be continued to the next meeting to allow him to consider a mitigation strategy or a method of preserving the oak and to mark the property more clearly. Judy Jacobson move to defer action until the April 20th meeting. Rick Bell seconded the motion which passed unanimously. Under Reports and Announcements the Board discussed the issue of responsibility when a property owner hires a contractor to work for him. Specifically discussed was the issue at 1177 Atlantic Boulevard where the owner hired a Tree Service which did not obtain the required permits for tree removal. After considerable discussion it was determined that it is the responsibility of the property owner to meet the ordinances. A typographical error was noted and corrected in the minutes of the April 6th meeting. Approval of the corrected minutes of the regular April 6, 1998 meeting was moved by Susan Bullock, seconded by Rick Bell and approved unanimously.
