03-17-97 v TREE CONSERVATION BOARD Minutes of March 17 , 1997 The Board held its regular meeting on Monday, March 17 , in the Conference Room of City Hall . Present were : Hope Van Nortwick, Chairperson Rick Bell Rick Beaver Mae Jones Staff: George Worley, Designee Carl Walker, Coordinator The meeting was called to order at 7 : 30 PM. The first application for removal was at Lot # 15 , Sevilla Gardens ( 1937 Sevilla Blvd. , W. ) . The removal was necessary due to an addition to the residence at that location. George Bull , owner , was present to address the Board. He explained that the homeowner' s covenant and restrictions require a side entry garage so there was no other choice for placement of it on the lot . There are several trees to remain on the pro- perty as mitigation for those proposed for removal . Although those trees were marked on site , they were not specifically indicated on the survey. Rick Beaver moved to approve the plans , as submitted , with the stipulation that a notation be made on the existing plans of the trees to remain on the lot as mitigation. Rick Bell seconded and the motion passed unanimously. Mr. Bull will mark the trees to be preserved for mitigation on the original plans later in the week so that they will be on record. Clifford Gray with Pulte Home was present for the review of the remaining applications listed on the agenda, all of which were submitted by Pulte Home . The first application was for removal at Units #3 & #4 , Block # 68 , Sec . H . Board members expressed that the site markings at that location were still not correct and they did not feel as though the survey was accurate as to tree placement . Mr. Gray distributed revised copies of the survey which indicate the trees to be preserved as mitigation. However, the Board did not have this document while they were on site and felt that they could not take action on the application until site markings were corrected and a revised survey submitted. Rick Beaver moved to defer action on the application for Unit #3 and #4 until corrections had been made . Hope Van Nortwick seconded and the motion passed unanimously. For the application on Unit #5 & #6 , Block #68 , Sec . H . , the Board briefly discussed the survey and agreed that it was ac- curate , as were the markings on site . It was noted that the 7" double oak on the lot was not to be removed and that cau- tion should be taken to properly barricade it . Mae Jones moved to accept the application as submitted with a notation that the 7" double oak be protected , along with those trees marked for mitigation purposes . Rick Beaver seconded and the motion unanimously carried. It was agreed that no protected trees were proposed for re- moval on the plans , or on site , at Unit #7 & #8 , Block #68 , Sec . H. Rick Beaver made a motion to accept the application as stated with the stipulation that the 48" DBH oak on the lot be overly protected. Mae Jones seconded and the motion passed unanimously. During discussion of Lot #6 , Block #234 , Sec . H . , Mae Jones noted that there were two pines , 14" & 6" near the driveway which were not to be removed, according to the survey and ap- plication but which were tagged for removal at the site . Mr. Gray said this would be corrected. He also stated that there were no trees to remain on the lot which could be used for mitigation purposes but replacement trees , as required, could be planted on the lot. Rick Bell moved to accept the plans as submitted, noting that the 12" DBH of protected trees to be removed must be replaced with 6" DBH of hardwood trees on site , and with a special notation be made to correct the tagging of the two pines im- properly marked. Rick Beaver seconded and the motion carried unanimously. No protected trees are proposed for removal on Lot #1 , Block #249 , Sec . H. Rick Bell made a motion to accept the applica- tion, as submitted. Hope Van Nortwick seconded; the motion unanimously passed . The application for Lot #4 , Block #249 , Sec . H . proposed re- moval of 1 protected trees , a 7" DBH oak in the driveway area. It was noted that while trees to be used as mitigation were marked on the property, none were so indicated on the survey. Mr. Gray marked an 8" DBH oak on the original plans to be used as mitigation purposes . Rick Bell moved to accept the plans , as amended, showing an 8" DBH oak as mitigation for removal of the 7" DBH oak. Hope Van Nortwick seconded and the motion passed unanimously. The last application for consideration was for Lot #6 , Block #228 , Sec . H . Three trees are proposed for removal , none of - 2 - which are protected. Mr. Gray pointed out that the driveway has been designed in a curved manner in order to preserve a 27" DBH pine tree . Rick Beaver moved to accept the plans as presented with special efforts to be made to barricade the 27" DBH tree near the driveway. Mae Jones seconded and the motion carried unanimously. The Board further discussed with Mr. Gray the Sec. H . miti- gation plan presented at the last meeting. Hope Van Nortwick pointed out that the Board cannot require replacement trees in excess of those called for by ordinance so if the plan was to be approved, compliance would be on a "good faith" basis. It was also again mentioned that even if the Tree Board re- commends relief of the fine paid by Pulte Home, the Code En- forcement Board may not grant such action. Following further discussion, the Board and Mr. Gray agreed that no action needs to be taken until a meeting in June at which time most of the lots involved will be permitted. Authority to the Board Designee for approval of tree removal was discussed and the specifics and history of that authority were reviewed. Rick Beaver moved to rescind the original agreement for administrative action by the Designee so that all tree removal applications would come before the Board. Hope Van Nortwick seconded and the motion passed unanimously. George reported that Albertson' s was contemplating moving into the former Pic 'N Save location. If that occurs, they were interested in working with Kent Theaters for a revision to the landscape plan. In the meantime, the six month time frame allowed Kent Theaters for implementation of the appro- ved landscaping plans will expire on May 19 . In other business , Mae Jones complimented the recent land- scaping by ABC Liquors at their location. Carl advised that a letter had been, on behalf of the Beautification Committee , thanking the owners for their efforts. Rick Beaver brought up the plantings to be installed on the Atlantic Blvd. med- ians as a result of the grant obtained by Greenscape. Rick Beaver inquired of George what handling has been given the incident of tree removal , without permitting or appli- cation, by Mayport Muffler at their property on Levy Road near Mayport Road. George has taken photographs of the trees which were removed but the owner has yet to file any application. George will follow up, by letter, and advise the Board further at the next meeting. Carl reminded the Board that the annual election of officers will be placed on the agenda for the next meeting of April 7 . - 3 - Hope Van Nortwick moved to approve the minutes of the last meeting , as written.
