Minutes of Meeting of August 17, 1992
The Board met for its regular meeting on Monday, August 17,
in the Conference Room of City Hall. Present were:

Carolyn Woods called the meeting to order at 7:30 pm.
The first business was to review the tree removal application
for property described as Lot # 88, Unit # 1, Oceanwalk. Mr.
Swaim, the property owner, and Mr. Donne l l o, representing t h e
builder, Wilson Homes, were present to discuss the plans and
application with the Board. Following consideration, Tom
Frohne moved to accept the application, as proposed. The
motion was seconded by Jim Pelkey and passed unanimously.
The Board reviewed the request by David Willis, contractor
for reconsideration of the approval previously granted for
Lot # 82, Selva Norte, Unit # 2. Mr. Willis stated that it
was not possible to save the elm tree to the rear of the pro-
perty due to the proximity of its canopy to the fireplace at
the rear of the house. He also brought out that the house
footprint had been moved approximately 3 1/2 feet forward on
the lot in an unsuccessful attempt to save the elm, and could
not be brought forward any additional footage.
As an alternative, Mr. Willis advised that replacement trees
could be planted to compensate for the loss of the elm in
question. The Board brought out that the reason they had re-
quested the protection of the elm when the application was
initially acted upon was due to its unusual specie (Florida
Elm) and its size and configuration. The Board members had
not had the opportunity to revisit the site, due to failure
to receive their packets, and felt as though it would be
necessary to again see the elm and construction site before
rendering a decision on the request for reconsideration.
The following representatives of Centex Builders appeared be-
fore the Board: Jeffrey Zammit, Bob Porter, and Andy Fuxa.
Mr. T. R. Hainline, with the lawfirrn of Rogers, Towers, etal.
was also present.
Following discussion between the Board and the above as to
the respective general objectives of each, the tree removal
application for Lot # 78, Selva Linkside, Unit # 1, was re-
considered. That application was denied on August 3 by the
Board. Following discussion, Hope Van Nortwick moved to ac-
cept the plans, with the house to be moved 2' to the rear of
the property, with special efforts to be taken to barricade
the 12" oak, and to require replacement of 2 - 3" hardwood
trees; the 30" oak in the rear of the lot is to remain, if
possible. If not, the Designee can make that determination.
Torn Frohne seconded the motion which unanimously passed.
Considerable discussion took place as to tree removal on the
street right-of-ways to be built in Selva Linkside, Unit II.
The Centex representatives furnished a copy of the plat map
showing the proposed lots and existing trees, consisting of
largely palm trees. It was agreed that these trees could be
transplanted elsewhere within the development. Several other
conditions were agreed upon, and so noted on the plat map.
Tom Frohne made a motion to accept the plans for the right-
of-way for Selva Linkside II, with the provision that all
palms within the right-of-way be relocated as follows: a
minimum of 2 palms to be placed within the rear 6' of lots
on the west border; the remaining palms to be relocated in
phase I at the locations of homeowners and developers dis-
cret ion. Further, as lots are built upon, a minimum of
1 - 3" caliper hardwood tree shall be planted in the front
yard of each, in addition to other Tree Conservation Board
requirements at that time; and, to save a minimum of 3 oak
trees as marked on the plat map. Hope Van Nc'rtwick seconded
the motion which passed by a unanimous vote. The developers
present were in agreement to these conditions.
George Worley reported his findings on the property at Beach
Avenue & 16th Street. The home owner, in the process of re-
novating or adding to his existing home, destroyed a dune,
unrelated to the building site. Because of the violation,

the City has issued a stop work order on the construction,
and the matter is now in the hands of the City Attorney.
The request by Mr. Willis for the removal of the elm tree
at Lot # 82, Selva Norte was again discussed by the Board.
It was decided that the Board would take a 20 minute recess
to visit the site. Following the recess and further de-
liberation, Torn Frohne moved to deny the request for removal
of the elm tree, previously determined by the Board to be a
specimen tree. Hope Van Nortwick seconded, and the motion
unanimously passed.
Carl Walker brought up that the next scheduled meeting of the
Board would be on September 7, the Labor Day holiday. The
date of the meeting was changed to Wednesday, September 9.
Without further business, the meeting was adjourned at
10: 15 pm by Carolyn Woods.
