MINUTES OF TREE CONSERVATION BOARD January 8, 2003 A regular meeting of the Tree Conservation Board was held Wednesday, January 8, 2003, in the i City Hall Conference Room. Present were Barbara Mears, Bill Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:00 p.m. 2. Recognition of Visitors 3. Approval of Minutes of MeetinE of December 11, 2002, and December 13, 2002 A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to approve the Minutes of the Trce Conservation Board meetings of December 11, 2002, and December 13, 2002, as written. 4. 01d Business A. Tree Removal Application Form: Deferred to the end of the meeting. B. Action on Mitigation for 358 19"' Street: Deferred until later in the meeting. C. Tree Removal Applications: 1) 1860 Francis Avenue: Mr. Craig Burkhart introduced himself and stated that he was representing Habitat for Humanity. Mr. Burkhart explained that he would attempt to save the 31" pine, the 36" pine and the 25" pine located in the proposed retention pond by building an island. Building Official Ford stated that he reviewed the lot and did not find any discrepancies with the survey. The Board reviewed the survey to determine mitigation. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of 506" of pine, to be mitigated on site with 349" of pine. B. Action on Mitigation for 358 19"' Street: Mr. George Paspalaris with Coppenbarger Homes introduced himself. He proposed that Coppenbarger Homes hire a professional landscape architect to design a landscape plan and use the mitigation fine of $4,550~}~~~e~~ia~onr landscaping the site instead of paying into the Tree Fund. In addition, he proposed that they bring the landscape plan to the Board for their approval prior to installation of any trees. Board Member Shaughnessy clarified, and Mr. Paspalaris concurred, that thefee-furt~he~ -}•m~dso3pe-archituct wvuh3-rtot-bg-in~ltzrlerl-in'ttr~$~#;558-'~ Building Official Ford proposed that the Board give Mr. Paspalaris a list of trees from which to choose. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter, and unanimously carried that the Building Official Lift the stop work order on 358 19`h Street contingent upon receiving plans prepared by a landscape architect, which X$4;550 fee would be used for trees only and not shrubs, plants, etc., or the landscape architect fee. Minutes of Tree Conservation Board ~I January 8, 2003 Page Z plans would include 1) 39" of trees to be planted on site; and 2) trees to be chosen from an ~' approved list of trees provided by the Board. S. New Business A. Tree Removal Applications: 1) 208 Belvedere Street: Deferred until later in the meeting. 2) 394 9"' Street: Deferred until later in the meeting. 3) 1215 Seminole Street: Mr. Adam Militello introduced himself and thanked Building Offcial Ford for his guidance through the tree removal permitting process. He stated he would prefer to pay mitigation into the Tree .Fund since it would cost him more to plant 4" oaks on his property. He also requested that he have until the issuance of the Certificate of Occupancy to pay into the fund. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of a 27" live oak and a 25" live oak to be mitigated with 26" to be paid into the Tree I~'und at $117 per inch at the time of the issuance of the Certificate of Occupancy. 4) Part of Lots 8 and ~9, Block 1, Ocean Grove Unit 1 (corner of Dewees Ave. and Beach Ave.): Mr. Brian Platock addressed this application. He stated that he would attempt to relocate the 7.6" live oak. In addition, he stated that they would not remove any trees for the walkway, ~, that they would work around them. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of 20.6" of palm to be mitigated with a 21" palm on site. 5) 435 Atlantic Boulevard: Mr. Wade Olszewski and Mr. Mike Urchuk of CPH Engineering, and Mr. Tim Darnall of McDonald's Corporation, introduced themselves. Mr. Olszewski summarized for the Board the building permitting process that occurred and explained how the trees were inadvertently removed without a permit. He stated that they have revised the landscape plans to include sabal palms, chordgrass and Indian hawthorn to tie in with the landscaping at Town Center. Board Member Shaughnessy suggested that crape myrtles not be planted because they were not considered trees. Mr. Olszewski advised that they removed 76" of oak, SO" palm and S" of spruce. The Board determined that they would not require mitigation of the S" spruce and, since only 10" of palm removed was protected, they would only require 10" of palm to be planted back on the site. The Board corrected the Existing Tree Legend to reflect the correct trees that were removed. In addition, the Board requested that the wax myrtles located in the back of the lot not be removed. Mr. Olszewski read a letter from Mr. Bud Kuthan, Owner Operator, dated January 8, 2003, attached and made a part of these Minutes. ~Llinutes of Tree Conservation Board January 8, 2003 Page 3 Discussion was held with regard to whether all the oaks required for mitigation would fit on the site. Mr. Tim Darnall stated that they would plant what would fit on the site and pay the difference into the Tree Fund. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of 76" of oak and 10" of palm to be mitigated with 10" of palm on site and tither 76" of oak to be planted on site or, if the trees do not fit on the property, the balance to be paid into the Tree Fund. The Board informed Mr. Olszewski that that the crape myrtles on the lot could be removed ', without a tree permit. 2) 394 9`h Street: Discussion was held and the Board determined that the trees proposed for removal were all either dead or diseased. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried that no permit is required because the trees on the lot look dead or diseased. 1) 208 Belvedere Street: Board Member Shaughnessy advised that the applicant would like to remove the magnolia because the branches would scrape the windows of the new bedroom addition. She further stated that the applicant would like to plant two 6" oaks for mitigation. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter, and unanimously carried to direct the Building Official to issue a permit for the removal of 23" of magnolia to be mitigated with two 6" oak trees to be planted on site. 6. Reports and Announcements 1) Update on~all of Block 8; Lot 4, Block 9; Lots 1-3, Block 22; and Block 23: Building Official Ford advised that he received a new survey of the site which identified trees that were either dead or dying. He suggested, and the Board agreed, that they all meet at the site to review the trees on the lot. Buildirg Official Ford stated that he would call the Board members to arrange a convenient date. 4: Old Business A. Tree Removal Application Form: The Board deferred this item to the next Tree Conservation Board meeting. ~ .. 7.
