MINUTES OF TREE CONSERVATION BOARD March 12, 2003 A regular meeting of the Tree Conservation Board was held Wednesday, March 12, 2003, at .Adele Grage Community Center. Present were Chair Barbara Mears, Tom Hill, David Owens, Bill Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:12 p.m. 2.Recoenition of Visitors Silet Wylie. 3. Approval of Minutes ofMeetings of February 26, 2003 A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to approve the 1Vlinutes of the Tree Conservation Board meeting of February 26, 2003. 4. Old Business A. Tree Removal Application Form: Moved to end of Agenda. B. Proposed List of City-Approved Arborist: Moved to end of Agenda. C. Discussion of Permitting Procedures -Building Checklist: Moved to end of Agenda. 5. New Business: A. Tree Removal Applications: ' 1. 298 Aquatic Drive: Moved to later in the meeting. 2. Lot 6, Block 164, Section H: Mr. Larry Smallwood introduced himself and stated that he ,~ represents Mr. Stanley. He advised that his client wouId~Iike to build a single family attached building which would require the removal of several trees. The Board expressed concern about • ` ~ '; `: ~', the removal of a 43" oak and requested that the applicant consider moving the footprint Hof the .. ...home to accommodate the tree. Building Official Ford advised that the applicant has eight feet in {~ which to move the house but it would stiIl~require some re-design of the home to clear the root . ~! system of the tree. Mr. Smallwood advised that he would discuss this. request with his client. ;,,,:" 3: 680 E~"st Coast Drive: Mr: George Bull introduced himself and stated that he was representing the Winfrees who would like to build an addition to their home. Tree Removal Application Form: Discussion was held. A motion.was made by Board Member Hill, seconded by Board Member Shaughnessy, and unanimously carried to replace "area" with "zone" throughout the Tree Removal Application form. 435 Atlantic Boulevard: Building Official Ford informed the Board that there was a lot of misinformation being discussed with regard to 43~ Atlantic Boulevard. He advised that Early Piety, Certified Tree Arborist, looked at the property and the survey provided by the contractor, and determined that the oldest tree removed from the lot was approximately 60 years old so no ancient oak trees were removed. He further advised that there are tvvo oak trees currently on the property that are probably over 100 years old. Building Official Ford stated that ifthe owner of the property had applied for a Trce Removal Permit prior to removal of trees, he would not have been required to mitigate for any trees. He further stated that since he removed the trees without a permit, the owner was required to replace inch for inch every tree that he removed in addition to the $3,393 he had to pay into the Tree Fund. Building Official Ford advised that he spoke to the Commissioners, at the last Commission meeting about the options available to the Tree Conservation Board with regard to the strength of the Tree Ordinance for those who remove trees without a permit. He stated that the Board has the option of mitigating for trees removed or sending the applicant to the Code Enforcement Board who could fine the applicant up to $5,000 per tree removed. He further stated that the Board accepted the mitigation plan presented by the owner at 435 Atlantic Boulevard because he provided a good mitigation plan. B. Proposed List of City-Approved Arborists: Deferred until the neat meeting. C. Discussion of Permitting Procedures -Building Checklist: The Board requested that Building Official Ford make one change to the Building Checklist. 5. New Business B. Written Primer for New Members: Deferred until thc~next-meeting. C. Mitigation Fee: Building Official Ford advised that he would research this issue and bring the figures to the next meeting. 7. Reports and Announcements Chair Mears expressed concern that she and Board Member Shaughnessy attempted to attend last night's Code Enforcement meeting and they could not locate the meeting, Building Official Ford stated that he would look into this matter. Chair Mears advised that the Sea Turtle re-paved their parking lot and did not plant trees or provide sidewalks. Building Official Ford responded that Sea Turtle did not tear up the parking lot and re-build it so they were not required to meet the current Code. Board Member Hill advised that he would not be at the March 26 Tree Board meeting. iLlirt:ites of Tree Conservation Board ~Ltarclr 12, 2003 Pgge 3 Board Member Hill encouraged the Board members to drive by the Hickory Lane property that was cleared last week. He stated that the lot was clear-cut and encouraged all members to call the Commissioners. 8.
