If any person decides to appeal any decision made by the Tree Conservation Board with respect to any matter considered at the above meeting, he or she will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. MINUTES OF THE REGULAR MEETING OF THE TREE CONSERVATION BOARD July 23, 2003 A regular meeting of the Tree Conservation Board was held Wednesday, July 23, 2003, at the City Hall Conference Room. Present were Chair Barbara Mears, Bill Permenter,.Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. Absent was Tom Hill. 1. Call to Order The meeting was called to order at 7:00 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of Junc 25, 2003 The approval of the Minutes of June 25, 2003, was moved to the next Tree Conservation Board meeting. 4. Old Business None. 5. New Business: A. Tree Removal Applications: 1. 1G71 Francis Avenue (Francis Cove): Mr. Ralph Marcello, Executive Director of Beaches Habitat, and Mr. Paul Finley, Construction Manager of Beaches Habitat, introduced themselves. Mr. Finley stated that they were submitting a request to remove an additional nine trees for the following reasons: 1) they were now building duplexes which require different footprints; and 2) they were advised that the trees on the island in the retention pond would not survive. He also stated that they identified four trees that were previously approved for removal that they no longer need to remove. In response to a question from Building Official Ford, Mr. Marcello and Mr, Finley confirmed that the homes would be townhomes due to the common shared wall and the property line that runs through the middle of the wall. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to Direct the Building Official to issue a permit for the rcmovai of 148" of pine to be mitigated with 74" to be planted on site or paid into the Tree Fund. 6. Reports and Announcements Board Member Shaughnessy advised the following: 1) G02 Stock Street: two oak trees on the south side of the lot were removed; 2) 8G West 7`~' Street (corner of 7`~' and Orchid): two pine trees were removed; 3} 223 Ocean Boulevard: No barricades are placed around the large cedar tree; and 4) West 10`x' and Orchid: workers are throwing trash on the ground at the job site. Chair Mears advised that she had been approached by several individuals who felt that the tines were not high enough for people who circumvent the Tree Conservation Board. Building Official Ford advised that the board had three recourses: 1) assess mitigation; 2) if the lot is clear cut, the Minutes of Tree Co~tservation Board Jitfy 23, 2003 Pagc 2 board could charge $1.00 per square foot of cleared lot; and/or 3) forward the matter to the Code Enforcement Board who could fine up to $500 per tree for a maximum up to $5,000 for "permanent damage." He further advised that the board could make a suggestion to the Commission to increase the fees charged by the Code Enforcement Board. Building Official Ford advised that the he stopped the owners of a property at North Sherry Drive south of 19`x' Street from removing a 40-50" oak tree. He stated that the board needs to establish criteria to set guidelines for "champion" trees. 7.
