Present were Chair Barbara Mears, Bill Permentcr, Maureen Shaughnessy and Susan Dunham. Absent was Charles Carroll. 1. Call to Order The meeting was called to order at 7:00 p.m. 2. Approval of Minutes of Meetings of .Yalu 9, 2003, and .Yalu 23, 2003 A motion tivas made by Board Member Permentcr, seconded by Board Member Shaughnessy, and unanimously carried to approve the Minutes of July 9, 2003. A motion was made by Board Member Shaughnessy, seconded by Board Member Permentcr, and unanimously carried to approve tl~e Minutes of July 23, 2003. 5. Old BUSiness A. Tree Removal Applications: 1) East 100 Feet of Lot 70A, North Atlantic Beach, Unit No. 3 (2038 Beach Avenue): The Board addressed this item later in the meeting. 2) 1814 hickory Lanc: The Board addressed this item later in the meeting. G. NCw Busines$ A. Tree Removal Applications: 1) 121 Ocean Forest Drive N: Mr. Michael Sones introduced himself. He stated that he needed to remove trees to allow for the renovation of his personal home. He advised that he plans to relocate the three short palm trees to another location on site. The Board determined that the applicant was removing 14" of oak, 12" of hardwood and 72" of palm. A motion was made by Board Member Permentcr, seconded by Board Member Shaughnessy, and unanimously carried to direct the Building Official to issue a permit for 121 Ocean Forest Drive North to remove 14" of oak, 12" of Hardwood, 72" of palm to be mitigated with 7" of oak, G" of hardwood and 3G" of palm to be planted on site. 2) 19-1G 17-25-29E Donncrs R/P Pt. Tree Removal Applications: 2) 1814 IIickory Lanc: Ms. Margie Petit introduced herself and advised that she was the buyer of the home located at 1814 Hickory Lane. She advised that she would like to remove the trees for the purpose of installing a pool. She further advised that she understood that the trees that she would like to remove had been used for prior mitigation but that she would be willing to plant trees inch for inch. Ms. Petit also informed the board that she did not plan to remove the 30" live oak on the east side of the lot which was originally proposed for removal. She proposed planting eight 4" oak trees to mitigate for the removal of protected trees. The applicant was advised to ensure that tree barricades were placed around all the trees that were to remain on the lot. Chair Mears stated that the applicant's proposal. provided for more trees than originally proposed and there would be no bald spots on the lot. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter, and unanimously carried to direct the Building Official to issue a permit for the removal of a 5" Laurel oak, a 10" laurel oak and a 13" laurel oak to be mitigated 100 percent with eight 4" laurel oaks to be planted on site. 6. New Business 3) East 40' of Lot 17, West 10' Lot 15, Block 12, Atlantic Beaclt: Mr. David Burbridge introduced himself. He stated that this request was for the removal of trees for new construction next to his home at 340 10`x' Street. He further stated that he would like to attempt to relocate the 14.3" palm tree on site but would like the option of removal if necessary. A motion was made by Board Member Permenter, seconded by Board Member Sltaugltnessy, and unanimously carried to direct the Building Official to issue a permit for the removal of a 14.3" palm tree to be replaced with 8" of palm or relocated on site. 2) 19-16 17-25-29E Donners R/P Pt. Govt. Lots 2, 3, 4, Block 21 (Simmons Road): Chair Mears advised that the applicant could not use crepe myrtle trees as mitigation. A motion was made by Board Member Permenter and seconded by Board Member Shaughnessy to direct the Building Official to issue a permit for the removal of 33" of oak to be mitigated with 16.5" of oak and to remove 24" of pine to be mitigated wit}t 12" of hardwood citlter to be planted on site or to be paid into the Tree Fund. Discussion was held and the board determined that the best way to handle this situation was to deny the application and to request that the applicant re-apply with proper mitigation noted. The vote was called and Chair Mears, Board Member Permenter and Board Member Shaughnessy voted against the motion. The motion failed. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to deny the Tree Removal Application. Old Business 1) East 100 feet of Lot 70A, Nortlt Atlantic Beaclt, Unit No. 3 (2038 Beach Avenue): Board Member Shaughnessy advised that the applicant was able to save the secondary dune thereby saving the trees on the dune. Therefore, she stated that the original permit indicating 57.2" of oak to be removed needed to be revised to reflect 31.25" of oak to be removed. The applicant's letter indicated that he would like to mitigate the 31.25" of oak with 39.5" of oak on site. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy, and unanimously carried to issue a revised permit to remove 31.3" of oak to be mitigated with 39.5" of oak on site. The applicant is to provide the city with an updated tree survey. 7. Reports and Announcements Chair Mears stated that she, called the Department of Forestry to determine. the process to dec]are a "champion" tree. She stated that a "champion" tree was determined by several criteria. In addition, she advised that there are only 20 "champion" trees in the state of Florida because a "champion" tree is a phenomenon, not a 36" oak. However, she stated that she found a designation of "challenger" which would fit the category of a 36" oak. Chair Mears suggested that the board look to change the ordinance to include a designation of "challenger" tree. Board Member Permenter suggested that Chair Mears put this in writing so that it could be submitted to the Commission. 8.
