Present were Joan McCloud, Barbara Mears, William Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:07 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of April 24, 2002 A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter and unanimously carried to approve the Minutes of the Tree Conservation Board meeting of Apri124, 2002. 4. Old Business None. 5. New Business A. Tree Removal Applications: :•., 1) Lot 3, Block 227, Section H: Mr. Paul Nichols of Bestcon, Inc., introduced himself. He advised the Board that he would like to remove the trees in the driveway, which he failed to indicate on the survey. Mr. Nichols outlined the trees he would like to use for mitigation and requested that he be allowed to make up the deficiency by either planting trees or paying into the Tree Fund. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 39" of oak and 10" of pine to be mitigated either on site or by payment into the Tree Fund. . 2) Lot 5, Block 227, Section H: Mr. Paul Nichols advised the Board of corrections to the survey. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 22" of magnolia and 34" of oak, to be mitigated on site with 11" of hardwood and 17" of oak. 3) Lot 6, Block 227, Section H: Mr. Nichols advised the Board of the trees he would like to use for mitigation and requested that he be allowed to plant additional trees to meet the mitigation requirements. A motion was made by Board Member Permenter, seconded by Board Member Shaughnessy and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 49" of oak, 45" of pine and 22" of hardwood to be mitigated with 22" of oak on site, 3" of oak to be planted, 21" of hardwood on site, and 13" of pine to be planted. "- ~``a Minutes of Tree Conservation Board May 22, 2002 Page 2 4) 580 Sherry Drive: Building Official Ford requested that this agenda item be addressed after Item S.A.S. since this applicant was not present. 5) 1900 Seminole Road: Mr. Chip Parman introduced himself. He stated that he is constructing athree- car garage and has determined that a cluster of oaks prohibits access to the third bay. Chair Mears stated that the Board could address the trees on the applicant's property but they could only make a recommendation to Public Works with regard to the removal of trees on City right-of--way. The Board determined that no mitigation was required for the trees the applicant is removing from his property. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 20" of oak with no mitigation required. The Board also recommends to the Public Works Department to allow removal of 23.5" of oak in the City right-of--way. 4) 580 Sherry Drive: The applicant was not present at this meeting. Building Official Ford stated that the applicant called him to explain that he was unsure if he would be able to attend the meeting but asked that the Board address this application. Building Official Ford advised that the trees had already been cut down at this location. He also advised that there was no way to measure a tree after it has been removed so measurements were to be taken from the remaining stumps. A motion was made by Board Member Shaughnessy, seconded by Board Member Permenter and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 23" of oak, 41" of palm and 56" of hardwood to be mitigated with 23" of oak, 41" of palm, and 44" of hardwood either to be planted on site or by payment into the Tree Fund. 6) 589 West 14"' Street: The applicant was not present at this meeting. Building Official Ford advised that he did not know what the applicant was requesting from the Tree Conservation Board but outlined the background with regard to this matter. The Board determined that Mr. Russell was not acting in good faith and requested that utilities be shut off at this location. A motion was made by Board Member McCloud, seconded by Board Member Permenter and unanimously carried to provide forced mitigation to the property by eliminating the utilities. Reports and Announcements A. Historical Tree Ordinance: Chair Mears stated that the next meeting was scheduled for Tuesday, May 28. She stated that the Sub-Committee has a clear idea of the presentation but is focusing on enforcement. Board Member Shaughnessy stated that the Sub-Committee is also discussing the possibility of educating the community, creating enthusiasm and raising awareness. Building Official Ford suggested posting the information at the new cultural center when it is completed in November.. 7.
