matter considered at the above meeting, he or she will need a xecord of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made; which record includes the
testimony and evidence upon which the appeal is based.

A regular meeting of the Tree Conservation Board was held Wednesday,. October 9, 2002, in the
City Hall Conference Room. Present were Barbara Mears, William Fermenter, Carol Rockwood,
Maureen Shaughnessy, Building Official' Don Ford and Recording Secretary Susan. Dunham.

A motion was made by Baard Member Permenter, seconded°by Board Member Rockwood
and unanimously carried to approve the Minutes of the Tree Conservation Board meeting
of September 25, 2Q02, as written.

A motion was made by Board Member Rockwood, seconded by Board Member Permenter
and unanimously carried to direct the SuiIding_Qr~cial to issue a hermit for the removal of
62" of oak, to be mitigated with 28" of oak on site and 3" of oak to be planted.
2) Lots b9-A and 70-A within Unit Z: The applicant was not present to address the application..
Chair Mears advised that the applicant was requesting removal of 51" of oak, ~ 1" of holly and
13" of palm.
A motion was made by Board. Member Shaughnessys seconded b~Board Member
Rockwood and unanimously carried to direct the Building Official to issue a permit for the
removal of 51" of oak, 21" of holy, 13" of halm, to be mitigated on site with a 12" oak, a 8"
holly, a 13" oak and a 11" oak; and, twa 13" palms were to be mitigated through Public
Works.
B. Draft of Annual Tree Conservation Soard Report to City Commission: Deferred until the
next Tree Conservation Advisory Board meeting.

B. Tree Ordinance: Emergency Tree Removal: Building_Official-Ford advised that currently
Public Works has the authority to remove a tree if it is deemed an emergency. He further advised
that there is no definition of "emergency" in the Tree Ordinance and Public Works would like
clarification. Discussion was held and the Board determined that a situation would be considered
an emergency if a public utility, could not be repaired. without removal of the tree. Board Member
Permenter suggested that Building pfl„icial Ford work with Public Works to determine if any
other scenarios might apply.
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously carried to adopt the above definition of an "emergency."

b. Reports and Announcements
A. 580 Sherry Drive: Building Official Ford reminded the Board that the owner of 580 Sherry
Drive had removed trees without a permit and the Board had set the mitigation requirements. He
advised that the applicant has proposed planting_S4" afi~alms, 16" of oaks, 20" of hardwood and
paying $3,744 into the Tree Fund. Discussion was-held and the Board determined that the
applicant was proposing to pram the trees too close together and they were too small.

A motion was made by Board Member Shaughnessy, seconded by Board Member
Permenter, and unanimously carried that the applicant provide an updated survey showing
the footprint of the new home, new trees are to be planted must be planted a minimum of 10
feet apart, oak trees to be plantedmust be at least 3" in diameter and all other trees to be
planted must be a minimum of 4" in diameter.
B. 16016Iayport Road: Bui1d`~6fficial-Ford advised-that the owner of 160 Mayport Raad
planted the required trees at the site but that he only planted three 2" oaks when he was required
to plant 9" of oak. Discussion was herd and it was suggested that the owner plant two more 2"
oaks to fulfill the mitigation requirements.
A motion was made by Board Member Shau~finessyz seconded by Board 14lember
Permenter, and unanimously carried that the Building Official suggest to the owner of 160
Mayporit'Road that he plant two additional-Z" oak trees to fulfill the mitiga~on
requirements.
