Adjournment • If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made,which record shall include the testimony of evidence upon which appeal is to be based. r ' MINUTES OF TREE CONSERVATION BOARD III February 5, 2001 A regular meeting of the Tree Conservation Board was held Monday, February 5, 2001, in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Richard Bell, Judith Jacobson, Barbara Mears, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:40 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of January 16, 2001 A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of January 16, 2001. 4. A. Old Business/Tree Removal Applications 1) Lot North of Hess Gas Station on Mayport Road: Mr. Roger Sharp of the Jacksonville Transportation Authority introduced himself. Mr. Sharp advised that the Board had seen this proposal before and that he had been asked to come back to the Tree Board with dimensions in inches as opposed to metric. He advised that the dimensions are shown in metric but the sizes of trees are shown in inches. . Chairperson Jones stated that the tagging on the trees was very erratic. After discussion the Board determined that 258"of pine and 76"of oak were proposed for removal. a) Proposed Mitigation Contract: Board Member Jacobson asked for clarification with regard to the significance of three years. Mr. Sharp indicated that if the Department of Transportation is willing to proceed, the median could be installed within three years. In addition Mr. Sharp indicated that in the event there is no median placed on Mayport Road within three years,the Jacksonville Transportation Authority would pay the obligation in cash. Board Member Mears stated that the agreement does not guarantee that the trees would be alive after one year. Mr. Sharp responded that that this could be added to the agreement. Discussion was held as to why the trees are not to be planted around the retention pond. Mr. Sharp stated that they had to leave sufficient room around the pond for maintenance and this did not allow any room for planting trees. Discussion was held with regard to the mitigation rate Jacksonville Transportation Authority should pay. The Board determined that they should pay the rate that was applicable at the time they applied six months ago. *of $82.50 per inch A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried that in the event no other public rights-of-way are selected by the City for this tree mitigation, the Jacksonville Transportation Authority will pay into the tree fund an amount calculated at the mitigation rate of$82.50 per inch for the required 38 inches of oak and 129 inches of hardwood. as amended by the Tree Conservation Board on February 20, 2001 0 .0 • Miztutes of Tree Conservation Board February 5, 2001 Page 2 III 5.A. New Business/Tree Removal Applications 1) 422 206 Street: The applicant was not present to address this application. . A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of trees since no protected trees are being removed. 2) 1951 Beach Avenue: Building Official Ford stated that Mr. Morgan apologized that he was unable to attend the meeting. The Board determined that Mr. Morgan is requesting approval to remove non-protected trees and to relocate one 18"protected palm. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for relocating the 18" protected palm and removing the rest of the unprotected trees indicated on the survey. 6. Reports and Announcements Building Official Ford advised the Board that the James Morton file has been re-opened. He advised that the Code Enforcement Officer felt that it was not a legitimate case. However, after meetings between the City Manager and the Code Enforcement Officer, it was determined that this case would go to the Code Enforcement Board. Building Official Ford displayed the historical tree survey to the Board members. Building Official Ford will verify that the survey is correct and will determine if any trees are missing. In addition, he stated that he would bring the draft ordinance to the next meeting. * • 7. He indicated the ordinance protecting the historic trees would be based on the totals reflected in the survey. as amended by the Tree Conservation Board on February 20, 2001. S
