Adjournment If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made, which record shall include the testimony of evidence upon which appeal is to be based. • • IS � MINUTES OF • TREE CONSERVATION BOARD September 7, 1999 A regular meeting of the Tree Conservation Board was held Tuesday, September 7, 1999,in the City Hall Conference Room. Present were Mae Jones, Chairperson,Richard Bell,Judith Jacobson,Eloise Koerber and Staff Members George Worley and Susan Dunham. The meeting was called to order by Chairperson Mae Jones at 7:31 p.m. 3.A.Old Business/Tree Removal Applications 1. None 4. New Business A. Request for modification of mitigation requirements for 750 Mayport Road:William Quattrucci, Esquire, and Harold Mathews,Property Manager,appeared before the Board on behalf of the property owner David E. Lewis. Mr. Mathews indicated to the Board that they hired a contractor to clear the property and the contractor did not advise them that they needed a permit to clear the lot. Mr. Quattrucci stated that Mr.Lewis spoke to the Building Official at the site,told him his plan to remove the trees and that the Building Official did not tell him that Mr. Lewis needed a permit. The Board stated that there is no record of the conversation with the Building Official and it is irrelevant since it is the responsibility of the property owner to verify that they have complied with all regulations. The Board offered the following responses to the attached letter from Mr. Quattrucci dated August 17, 1999: (1) With respect to the Board not being able to determine the species of the second tree,the • application submitted by Mr.Lewis stated that it was a pine; (2) Since the cedar tree had been cut down and moved prior to the application being submitted,the Board could not determine whether or not the cedar tree obstructed the public's ability to view oncoming traffic, and interfered with and damaged underground water pipes; (3) With regard to Mr. Quattrucci's reference to Atlantic Beach Code,Article III, Section 24-177(h), George Worley advised that this section of the code applies primarily to nuisance weeds,not trees; (4) In reference to considering the tree canopy of the adjoining lots in determining mitigation, it is not the intention of the Tree Ordinance to reduce mitigation because of lack of tree canopy on those adjoining lots. Based on the above,the Board found no reason to reduce the mitigation requirements. Richard Bell moved that the applicant come back before the Tree Conservation Board by October 4, 1999,or earlier,with a plan of how he is going to meet the mitigation requirements on the lot at 750 Mayport Road. Eloise Koerber seconded the motion,which passed unanimously. B. Discussion and possible action on Lots 4 and 5, Block 244 and 245: Eloise Koerber moved to rescind the action taken on February 22, 1999,regarding Mr. Russell's application for Lots 4 and 5,Block 244 and Lots 4 and 5, Block 245, Section H. Judith Jacobson seconded the motion,which passed unanimously. Judith Jacobson moved that Mr.Russell's application regarding tree mitigation requirements for Lots 4 and 5, Blocks 244 and 245 be placed on the agenda for action for the meeting of September 20, 1999,as communicated to Mr.Russell in the letter from George Worley of August 29, 1999. Report on memo regarding tree removal on public property as submitted to the City Commission: George Worley advised the Board that the Commission accepted the report but took no action and made no comment. 6. Approval of Minutes of Meeting of August 16, 1999 Eloise Koerber moved to approve the Minutes of the meeting of August 16, 1999 as submitted; Judith Jacobson seconded and the motion carried. 7.
