Minutes of May 5 , 1997
The Board held its regular meeting on Monday, May 5 , in the
Commission Chambers of City Hall . Present were :

The meeting was called to order at 7 : 35 PM by Rick Beaver in
the absence of Hope Van Nortwick, Chairperson.
David Clark introduced himself to the Board as representing
Beaches Habitat , the applicant on the first four applications
on the agenda. He explained that the 4 lots were contiguous
and it would be cost effective to clear the trees from all of
them at one Lime . The trees proposed for removal are dead,
sickly, or in the house or driveway/parking pad footprint.
The houses to be built will each be 1000 - 1200 sq . ft . The
house footprints are not shown on the plans , and Mr. Clark
was asked to include them, as well as property set back lines
on future applications/plans .
The first application is for the north 1/2 of Lot # 12 , Block
# 4 , Donner replat . None of the three trees to be removed are
protected. Following a brief discussion, a motion was made by
Judy Jacobson to approve the application, as submitted. Rick
Bell seconded and the motion unanimously passed.
The application for the south 1/2 of Lot # 12 , Block # 4 ,
Donner replat , also calls for removal of three trees , none of
which are protected. One of these , an 8" oak, might be saved ,
according to Mr. Clark . After discussion, Mae Jones made a
motion to accept the plans , as submitted, for removal of two
7" DBH maples and one 8" DBH oak. The motion was seconded by
Rick Bell and carried unanimously.
On Lot # 13 , except the north 140 ' , of Block # 3 , Donner re-
plat , Rick Beaver expressed concern for the trees to remain
on the lot ajacent to the driveway. He stressed that proper
barricading would be needed to protect the root systems dur-
ing construction.
There are four protected oak trees proposed for removal with
a total of 28" DBH . There are trees to remain on the lot
which can be used for mitigation and , after dicussion, these
were so indicated on the plans .
Rick Bell made a motion to accept the application, as pro-
posed, for removal of 28" DBH of protected oak trees , to be
mitigated by saving a 10" DBH oak in the middle front of the
lot and a 10" DBH oak clump on the west side. Judy Jacobson
seconded and the motion carried unanimously.
On Lot # 14 , except the north 140 ' , Block # 3 , Donner replat,
it was agreed that no protected trees are to be removed. Judy
Jacobson moved to accept the plans , as submitted. Rick Bell
seconded and the motion unanimously passed.
There was no representative present for review of the plans
for Lot # 3 , Sevilla Gardens , Unit # 1 . During discussion,
it was calulated that a total of 49" DBH of hardwood trees ,
30" DBH of oaks , and 15" DBH of palms , all protected , were
proposed for removal . Sufficient mitigation for removal of
the hardwood and palms trees was indicated on the plans by
preserving existing trees on the property.
Rick Bell moved to accept the plans, as submitted, to remove
30" DBH of oak, 49" DBH of other hardwood, and 15" DBH of
palms , with mitigation as shown on the plans, and with the
stipulation that 15" DBH of oaks be planted on site. Judy
Jacobson seconded and the motion passed unanimously.
Mark Fleischer of All Pro Automotive ( a/k/a Mayport Muffler )
introduced himself to the Board and commented that he felt
the application for removal was not designated for the layman
to understand. He explained that the trees removed were from
the center of the lot in order to create an unpaved parking
lot and children' s playground area.
Since three adjacent lots are being developed, the Board dis-
cussed if set back requirements should be considered for each
lot or for the property as one parcel . George Worley brought
out that since a violation was involved, the Board would be
governed by the Sec. 23-17 of the ordinance ( copy attached )
requiring that the total inches of replacement trees shall
equal the total inches of protected trees removed.
The application lists 4 pines totaling 66" DBH, a 8" DBH oak,
and a 15" DBH palm have either been removed, or are proposed
for removal . Mr. Fleischer advised that the 15" DBH palm is
no longer to be removed from the lot . George confirmed that
the calulations appear to be correct for the trees removed ,
based on pictures taken after the violation was reported.
A sufficient number of inches of oak are to be saved on the
lot as mitigation; a total of 38" DBH of hardwood trees are
also shown on the plans to be saved as mitigation, which
leaves a balance of 28" DBH of hardwoods to be replaced .

During discussion , Mr. Fleischer asked if he could be allowed
a thirty day period in which to install the needed replace-
ment trees .
Rick Beaver moved that the application be approved with the
specified trees shown on the plans to be used as mitigation
and that an additional 28" DBH of hardwood trees be replanted
on site , no later than June 15 , 1997 . Rick Bell seconded
and the motion unanimously passed.
Under reports and announcements , George Worley advised that
he did not yet have a compilation of C.O. ' s issued, as re-
quested at the last meeting . However, it is in the process
of being completed and should be available by the end of this
week.
Mae Jones reported that she was still pursuing the Beaches
Historical Society to obtain a representative to come to a
future Board meeting , as discussed at the April 21 meeting .
The reel to reel tape listened to at the last meeting can be
converted to a cassette , with improved quality, at a cost of
$250 . 00 , according to a quotation obtained by Judy Jacobson.
Carl will relay this figure to Hope as information for the
proposed budget .
Carl reported that effective with the next fiscal year bud-
get, the tree fund monies collected will be placed in the
beautification budget which he is responsible for administer-
ing. According to the finance director, there is approxi-
mately $6 , 000 in that fund now.
Rick Beaver announced that he plans to run for the office of
City Commissioner in October and as a result, may have to
tender his resignation from the Tree Board, effective with
the date of the election.
Judy Jacobson made a motion to approve the minutes of the
last meeting , as written. Mae Jones seconded and the motion
passed unanimously.
