09-03-96 v TREE CONSERVATION BOARD Minutes of September 3 , 1996 The Board held its regular meeting on Tuesday, September 3 , in the City Hall Conference Room. Present were: Hope Van Nortwick, Chairman Rick Bell Mae Jones Judy Jacobson Staff: George Worley, Carl Walker The meeting was called to order by Chairman Hope Van Nortwick at 7 : 35 PM. The first application was for tree removal on Lots # 1 & # 2 , Block # 68 , Sec . H . Wayne Haddock, surveyor, was present for review of the plans and also represented the applicant for the other property in Sec . H. listed on the agenda. Mr. Haddock was questioned on the removal of two oaks , 6" and 10" DBH, at the rear of the property outside of the footprint of the proposed structure . He advised that it was felt that the trees would not survive due to their closeness to the building . After further discussion, he agreed to attempt to save the 10" DBH oak and in the event it was preserved, he would return to the Board at a later date in order to reduce the required mitigation. It was determined that a total of 54" DBH of protected trees are to be removed, 22" DBH of which are oaks, the remainder, pines. The applicant chose to replace trees on site rather than contribute to the tree fund. Rick Bell moved to approve the plans with the stipulation that 16" DBH of hardwood trees and 11" DBH of oaks be replanted on site . Judy Jacobson se- conded and the motion passed unanimously. For Lot # 2 , Block # 124 , Sec . H. , Mae Jones stated that when she arrived at the site on Friday morning, August 30 , the lot was in the process of being cleared. This was promptly re- ported at City Hall . Mr. Haddock explained that there was a misunderstanding between the tree removal company and the contractor as to which lot was to be cleared but the problem was quickly corrected. Other Board members who had been on site subsequent to Mae Jones were unsure about the removal due to the overall appearance of the property. It was finally agreed that all of the trees which were removed or proposed for removal were properly identified on the site plan/survey. It was calculated that a total of 90" DBH of protected trees , pines and willows , were proposed for removal . Judy Jacobson moved to approve the plans, as presented, with the addition that 44 . 5" DBH of hardwood trees be replaced on site. Rick Bell seconded and the motion carried unanimously. On the final application, Lot # 4 , Block # 124 , Sec . H. , there are no trees on the lot with a DBH of 6" or greater. However, the ordinance does require minimum tree standards of one ( 1 ) 4" caliper tree to be planted/preserved for each 2500 square feet of lot area, or portion thereof. Mae Jones made a motion to accept the plans with the addition of 3 - 4" caliper trees to be replanted on site . Rick Bell seconded and the motion unanimously passed. In other business, the Board discussed the recent appeal by Sandar Industries to the City Commission. All Board members attended the meeting and the appeal was denied by a 3-2 vote . Hope advised that she attended the budget workshop of August 27 and spoke on behalf of the Board, supporting additional funds to be approved for enforcement of the tree ordinance . Hope advised that she and Mae have done additional work on the identification of specimen/historic trees . Photographs have been made of all nominations. Hope also took the op- portunity at the budget workshop to enlist the support of the Atlantic Beach Garden Circle in this endeavor. Under reports and announcements , Hope advised that there was a violation of the recently enacted Landscape Ordinance and while regulation and enforcement of that ordinance was not the Boards responsibility, she was concerned with the failure to comply. The renovated Atlantic Beach Theater, formerly the Royal Palms , reopened without complying with landscaping requirements . George advised that the Certificate of Occu- pancy had been issued erroneously and that a letter was sent to the owner, stipulating that the required landscaping must be in place by Friday, September 6 . If not , the violation will be turned over to Code Enforcement for action. Discus- sion followed on enforcement of the ordinance and how future incidents will be avoided. Hope reported that she had not yet received a response from the City Manager to her letter questioning the action taken with Tiffany by the Sea on the replacement tree planting at Saturiba. She will follow up for a reply. Judy Jacobson moved to approve the minutes of the last meet- ing , as presented.
