Minutes of September 20, 1993
The Board held its regular meeting on Monday, September 20,
in the City Commission Chambers. Present were:
Carolyn Woods, Chairman John Weldon, Jr.
Jim Pelkey Hope Van Nortwick
Staff: George Worley, Designee Carl Walker, Coordinator
The meeting was called to order at 7:30 PM by Carolyn Woods.
The Board reviewed the application for property described as
Lot # 85, Unit # 1, Oceanwa l k. John Merritt, property owner,
was present to discuss the application and plans with the
Board members. There were a few correct ions made on the plan
as to the existence and/or location of certain trees shown
on the tree survey. Replacement trees, shown on the appli-
cation, were reviewed and no changes or additions were made.
After discussion, Hope Van Nortwick moved to accept the plans
as proposed, with the revisions as noted on the plans. The
motion was seconded by Jim Pelkey and unanimously passed.
The application for Lot # 55, Selva Norte, Unit # 1, was re-
viewed in the presence of Bart Cobb, property owner. Jim
Pelkey, prior to discussion, declared a conflict of interest,
as the intended builder of the residence. Following brief
consideration, John Weldon moved to accept the application,
as proposed. Hope Van Nortwick seconded and the motion car-
ried by unanimous vote.
Bob Porter, with Centex Homes, provided the Board with the
revised tree survey requested at a prior meeting and which
included the changes pointed out by Carolyn Woods regarding
the existence or location of trees on certain lots included
on the survey of Phase 2, Unit 2, Selva Linkside.
John Weldon voiced an objection to considering the property
as a whole unit rather than individually. He pointed out
that while this was done for Phase 1, there were fewer trees
for removal in that area. He also expressed that such action
could set precedent for similar requests by other developers.
Hope Van Nortwick questioned the accuracy of the survey since
its correctness would be an important factor in the Board' s
determination. Mr. Porter responded that all revisions which
had been detailed by Carolyn Woods had been included on the
survey revision. Mrs. Woods expressed that she was satisfied
with the revision.
Following addition discussion, Carolyn Woods proposed for
consideration that a total of no less than six trees remain
on each lot, after clearing, or that replacement trees be
planted in order to total at least six trees per lot. Thi s
proposal was discussed among the Board members, Mr. Porter
advised that he would be agreeable to this plan.
Ultimately, the following motion was made by John Weldon:
To permit tree removal in Selva Linkside, Phase 2, Unit `,
Lots # 108 through # 140, as a whole, with the following pro-
visions: 1 ) there will be compliance with the agreement made
for Phase 1 to replace one 3" caliper oak tree in the front
right of way of each lot ; 2) on any lot not having a tree
remaining in the front yard, a 3" caliper hardwood tree will
be replaced at that location, in addition to the required
3" caliper oak tree; 3) any lot with less than a total of
six trees remaining after clearing in accordance with the
tree survey dated September 20, 1993, will be required to re-
place additional trees so that each lot will have a minimum
of six trees in total ; 4) Each lot will have a total of not
less than six trees remaining or by replacement prior to a
Certificate of Occupancy being issued for the property; no
more than three of the replacement trees on any lot can be
palm trees; 5) in the event the developer cannot comply with
any of the above provisions, it is required that they seek
approval from the Board.
The motion was seconded by Hope Van Nortwick and passed by a
unanimous vote. Mr. Porter asked that he be furnished with a
copy of the minutes once they had been approved.
Minutes of the last meeting were reviewed and a motion made
by John Weldon to accept them, as written. Hope Van Nortwick
seconded and the motion passed unanimously.
With no further business, the meeting adjourned at 9: 10 PM.
