Minutes of July 1 , 1991
The regular Board meeting was held July 1 , 1991 in the former
Commission Chambers of "Old" City Hall . Present were :

The meeting was called to order at 7 : 30 pm. The first order of
business before the Board was the removal of trees , without ob-
taining a permit , on property at Lot #35 , Selva Linkside .
Mr . Richards , representing the owners of the property, explained
that a leaking well , apx. 6" , had been located on the property,
in addition to concrete slabs , apparently left from a private
airport which existed there at one time . Mr . Richards contended
that , in order to repair the leaking well and remove the concrete ,
it was necessary to remove the pine trees from the lot .
Chairman Woods explained that the issue before the Board, regard-
less of circumstances , was the removal of trees without a permit ,
or with application approval by the Board.
Mr . Richards further explained that he had not seen the Tree Re-
moval Application until June 17 and was not aware that approval
was required . However, related plans for the property had been
submitted on June 5 , according to the date stamp shown by the
Building & Zoning Department .
According to Mr . Richards , upon locating the leaking well, he
had contacted the DER , apx. a month ago , and their representative
sent to the site required that the well be "fixed" within three
days in order to avoid fine and/or penalty. A written confir-
mation from DER had not been sent , Mr . Richards advised.
The Board determined that apx . 468" (DBH) had been removed from
the property. It was the consensus of the Boardmembers that re-
placement of 1 /3 of the total inches , or 156" , was too extreme
and that a compromise should be reached as to a reasonable plan
for replacement trees .
Following discussion and consideration of several options , it was
moved by Sandra Sheppard that a minimum of 24" of trees be re-
placed; of that total , 12" must be Oak, 3 trees with a minimum
of 4" . The remainder may be any variety, excluding Palms ,
and any number , but each must be a minimum of 2" caliper .
All replacement trees must be spaced a minimum of 10 ' apart
and all must be properly barricaded . Dezmond Waters seconded
the motion which passed unanimously.
An additional motion was made by Sandra Sheppard that a tree
plan be submitted to the Board at the next meeting, showing
the location of the replacement trees . The motion was se-
conded by Dezmond Waters ; it passed unanimously.
The Board agreed that written confirmation should be sent to
Mr . Richards of the requirements of thetwo motions . Carl
Walker is to handle .
George Worley presented the Board with a plan submitted by
the City on project to include installation of a sidewalk
on the east side of Main Street , between Levy Road and Church
Street , and which requires removal of 21 pine trees .
After discussion, Dezmond Waters moved that the City make
available 21 hardwood trees , a minimum of 2" diameter each
for replacement of those removed . The trees will be made
available to adjacent property owners , on a one to one basis
for those removed, and must be planted within 10 ' of the pro-
posed sidewalk. Jim Pelkey seconded the motion which was unan-
imously passed.
In other business , George reported that on Lot #80 , Selva
Linkside , the proposed house had been shifted apx. 3 1 /2 ' .
Further movement of the house was not possible due to set-
back requirements .
Jim Pelkey brought up the construction on property at Ocean-
side Court . Although the lot has been cleared, there is no
recollection of an application or Board approval . George will
look into and report .
Dezmond Waters moved to accept the Minutes of the last meeting;
Sandra Sheppard seconded ; motion passed unanimously.
With no further business , the meeting was adjourned at 8 : 45 pm.
