Dezmond Waters called the meeting to order at 7 : 30 pm .
Those present were :

Don Ford, Designee
Mr. Dave Shields appeared before the Board to discuss the
removal of two oak trees at 2335 Oceanwalk Drive West. The
size of the trees as shown on Mr. Shield's plans were 32" and
13" DBH . Mr . Shields said the owner of the property
assessed the trees as being dead and asked him to remove
them . He did not have a permit for their removal . There is
a third tree which the owner also wants removed because it is
allegedly dead . The following action was taken :
1 . The Board put Mr. Shields on notice that he is in
violation of the ordinance by not having a permit to
remove the two trees .
2 . Mr. Shields was told that a permit to remove the
third tree must be obtained from the City of
Atlantic Beach .
3 . The Board passed a motion (4-1, Waters, against) to
require replacement trees of 15 inches DBH with no
one tree less then 3 inches to replace the 45 inches
of combined DBH that was removed . Mr . Shields will
bring us a plan on September 27.
Don Ford, as Board designee, presented the permits he had
approved in August, 1990 . He also gave us an update on the
Shoppes of Northshore . No changes have been made effecting
the landscaping .
In reviewing the permits of August with us, Don Ford told us
that although the Board had asked to inspect and make
decisions on all permits within 500 feet of the ocean, the
City Manager, Kim Linbaugh, has interpreted the ordinance
differently than the Board . Mr. Linbaugh's interpretation is
the designee, once appointed, is to do all the permitting.
Either the Board does the permitting or a designee is
appointed to do ALL the permitting . On this issue the Board
passed a motion (3-2 : Against-Pelky and Waters) to review
all permits until D . Waters clarifies with the Mayor and City
attorney the rights of the Tree Board to designate certain
areas of the city to come before the Board for permitting.
Don Ford also presented a new Building Permit Application
for our information . Although we had designed a tree permit,
as his request, it was not incorporated into the new building
permit . D. Ford does not want to add the tree permit until a
revised tree ordinance becomes effective because a change
would be confusing to builders . S . Sheppard questioned this
since the Board has been presented with three different
building permit forms since its inception in February, 1990.
Jim Pelky recommended stamping all new building permit
applications with a rubber stamp saying "ADDITIONAL PERMIT
REQUIRED FOR ANY TREES REMOVED. " In this way, all builders
would be informed of the ordinance until such time as the
City will add an application for tree removal permit .
The next meeting will be scheduled for October 1 .
The meeting was adjourned at 9: 52 p.m .
