If any person decides to appeal any decision made by the Tree Conservation Board with respect to any
matter considered at the above meeting, he or she will need a record of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is based.

TREE CONSERVATION BOARD
February 12, 2003
A regular meeting of the Tree Conservation Board was held Wednesday, February 12, 2003, at
Adele Grage Community Center. Present were Chair Barbara Mears, Tom Hill, Bill Permenter,
Maureen Shaughnessy, City Commissioner Paul Parsons, Building Official Don Ford and Susan
Dunham.

!, Chair Mears introduced new Tree Conservation Board member Tom Hill.

The Board moved this item to the end of the Agenda.
4. Approval of Minutes of Meetings of January 22, 2003
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously carried to approve the Minutes of the Tree Conservation
Board meeting of January 22, 2003.
5. Old Business
358 19"' Street: Discussion vas held with regard to mitigation for 358 19~' Street.
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously carried to send a letter to Coppenbarger homes reiterating
the mitigation parameters.
A. Tree Removal Application Form: Moved to the end of New Business.
6. New Business
A. Tree Removal Applications:
1) Lot 1, Block 185, Section H: Chair Mears advised that she found the survey to be accurate
but was concerned that the trees on the site had contradicting markings. Building Official Ford
ad~~scd that he would contact the applicant to adrzse him to barricade the trees prior to clearing
the lot. Board Member Hill suggested that the applicant re-mark the site.
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously carried that the Building Official issue a permit for the
removal of one 7" oak and two 8" oaks to be mitigated with two 7" oaks on site; that the
owner re-mark the trees to be removed and the trees to stay; and that barricades be
constructed at the tree line prior to removal of trees.
B. Proposed List of City-Approved Arborists: Deferred until the ne:ct meeting.
C. Rejecting Inaccurate Surveys: Discussion was held with regard to rejecting inaccurate
surveys and the definition of an inaccurate survey. Suggestions for the definition of an inaccurate
survey were: 1) protected trees not shown on survey; and 2) trees marked inaccurately on site.

D. Discussion of Permitting Procedures: Discussion was held with regard to permitting
procedures and fines for removing trees without a permit. Building Official Ford stated that he
would bring the building checklist to the nest meeting.
Commissioner Paul Parsons suggested asking the City Commission for a heavier fine if someone
removes trees without a permit. He stated that a heavier fine might prevent this type of situation
in the future. Building Official Ford advised that the Tree Conservation Board sets mitigation
and, if there is an infraction, it can be forwarded to the Code Enforcement Board who has the
authority to charge up to $x,000 for each infraction of the Code. Commissioner Parsons stated
that McDonald's and Coppenbarger Homes did not go before the Code Enforcement Board, and
Building Official Ford responded that this Board did not forward these matters.
E. Proposed Changes to Tree Ordinance: Discussion was held with regard to raising the
mitigation fine.
A motion was made by Board Member Permenter, seconded by Board Member Hill, and
unanimously carried that the Building Official research adjusting the per inch mitigation to
reflect the market value and to bring this information to the next meeting.
Chair Mears stated that she thought the amount assessed for clear-cutting a lot is too low.
Building Official Ford advised that changing the assessment would require a change in the
Ordinance. Discussion was held and it was determined that Building Official Ford would
research this issue and bring information to the next meeting.
I'. Vacancy on Tree Conservation Board: All positions filled.
G. Calendar: The Board changed the Tree Conservation Board meeting calendar as follows:
1) November 12 meeting changed to November ~,
2) November 26 meeting changed to November 19, and
3) December 24 meeting cancelled.
7. Reports and Announcements
Building Official Ford asked Board members if they would be interested in joining the National
Arborist Association. Board members expressed interest in joining.
Chair Mears requested that the following be added to the next meeting agenda: 1) tree removal
application, 2) inter-agency meetings; and 3) providing a written primer for new members.
8. Adjournment
There being no other business or discussion, the meeting was adjourned at 8:2~ p.m.
