available for review at the City of Atlantic Beach Building Department located at 800 Seminole Road,
Atlantic Beach, Florida.
If any person decides to appeal any decision made by the Tree Conservation Board with respect to any
matter considered at the above meeting, he or she will need a record of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is based.

REGULAR MEETING OF THE
TREE CONSERVATION BOARD
June 11, 2003
A regular meeting of the Tree Conservation Board was held Wednesday, June 11, 2003, at the
City Hall Conference Room. Present were Chair Barbara Mears, Bill Permenter, Maureen
Shaughnessy and Susan Dunham. Absent were Tom Hill and David Owens.
1. Call to Order
The meeting was called to order- at 7:04 p.m.
2. Recognition of Visitors
None.
3. Approval of Minutes of Meetings of May 28, 2003
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously_ carried-to approve the Minutes of the Tree Conservation
Board meeting of May 28, 2003. - ---
4. Old Business
A. Change to Tree Removal Application for 223 Ocean Boulevard:
Mr. Jay Devine,landscape Architect, introduced himself. The Board reviewed the Minutes of
Apri125, 2003, pertaining to-the-previously approved-Tree-Removal Application for 223 Ocean
Boulevard. Mr. Devine advised that~theytivcre-unablctomave the seven palms to the Ocean
Boulevard right-of--way due to Public Works restrictions. As a result of these restrictions, they
would like to remove the palms instead- Chair Mears-stated-thatche seven palms were not
protected and did not require mitigation. Mr. Devine informed the board that he needed to
remove an additional 14" palm because it was too close to the garage door.
Mr. Devine advised the board that there was an error in the motion dated Apri125, 2003. He
stated that he was removing 29" ofpa}m; not 18" ofgalnr. The Board determined that they would
include the additional inches of palm in the motion for the removal of the 14"palm.
Discussion was held with regard to the motion dated-Apri125, 2003. The Board stated that this
motion required more mitigation than was required so the-applicant would not be required to
plant any additional mitigation.
A motion was made by Board Member Permenter, seconded by Board Member
Shaughnessy, and unanimously carried-to direct the Building Official to issue a permit for
the removal of 25" additional inches of palm to be mitigated with the 80" of palm that was
previously approved on Apri125, 2003. - ~---
In response to a question from Board Member PermenterLMr. Devine stated that he intended to
plant 80" of palm. Discussion was held with-regard~to the "more than required" mitigation in the
motion dated Apri125, 2003. It was determined that if Mr. Devine were not able to plant the
mitigation as outlined, he would notify the Building Official.

5. New Business:
A. Tree. Removal Applications:
1. Paradise Preserve Drainage Pond:
Mr. Paul Nichols of Bestcon, Inc., introduced himself. Mr. Nichols distributed an amended site
plan to all board members. He stated-that after walking the site, he determined that he could
modify the drainage pond to save additional trees, and that he would like to relocate all the palm
trees on site.
Mr. Nichols proposed that Bestcon post a bond equal to the amount of mitigation required. He
stated that he believed that there would be enough trees on the 471ots to mitigate for the lots and
the retention pond. Discussion was held and it was determined that the retention pond would be
considered an interior zone. The Board determined that there were enough trees located at the
drainage pond site to mitigate for the trees removed.
A motion was made by Board Member Shaughnessy, seconded by Board Member
Permenter, and unanimously carried to direct the Building Official to issue a permit for the
removal of 84" of oak and 23" of pine to be mitigated on site with a 7" oak, a 10" oak, two
14" oaks and two 15" oaks.
6. Reports and Announcements
Chair Mears advised that she made the semi-annual report to the City Commission on June 9.
She stated that she mentioned to the City Commission that the board would like to request that
the Building Department perform tree barricade inspections to possibly deter unauthorized tree
removal. She stated that the Commission thought .that this was a good idea.
Board Member Shaughnessy stated that she was appalled at the mounds of garbage located at
1150 Main Street. She further stated that the mounds are about eight feet high and appear to have
been trucked in by the construction crew.
