available for review at the City of Atlantic Beach Building Department located at 800 Seminole Road,
Atlantic Beach, Florida.
If any person decides to appeal any decision made by the Tree Conservation Board with respect to any
matter considered at the above meeting, he or she will need a record of the proceedings, and for such
purpose, may need to ensure that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is based.

REGULAR MEETING OF THE
TREE CONSERVATION BOARD
October 8, 2003
A regular meeting of the Tree Conservation Board was held Wednesday, October 8, 2003, at the
Adele Grage Cultural Center. Present were Chair Barbara Mears, Charles Carroll, Bill
Permenter, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. Absent was
Barbara Mears.
1. Call to Order
The meeting was called to order at 6:58 p.m.
2. Recognition of Visitors
None.
3 Approval of Minutes of Meetings of September 24, 2003
A motion was made by Board Member Permenter, seconded by Board Member Carroll
and unanimously carried to approve the Minutes of September 24, 2003.
4. Old Business
The Board determined that they would address New Business prior to Old Business.
A. Discussion and possible action to establish portions of Sclva Marina Drive, North Shery
Drive, Live Oak Lane, Hickory Lane,19`h Street, Oak Circle and Creekside Circle as a
Historic Preserve Corridor:

A. Tree Removal Applications
1. 770 East Coast Drive: Moved to the end of New Business.
2. 2348 Oceanwalk Drive West: Mr. Jerry Bahr introduced himself. In response to questions
from members of the board, Building Official Ford clarified that the front of the lot was on Inland
Way. Building Official Ford stated that the 12" palm was the only protected tree on the lot.
A motion was made by Board Member Carroll, seconded by Board Member Permenter,
and unanimously carried to direct the Building Official to issue a permit for the removal of
a 12" palm to be mitigated with 6" of trees and/or payment into the Tree Fund at $117 per
inch.
3. 160 Magnolia Street: Building Official Ford advised that this application was withdrawn.
1. 770 East Coast Drive: The applicant was not present. Building Official Ford advised that
East Coast Drive was considered the side yard. He stated that the applicant would like to use a
17" palm on site for mitigation for the removal of the 7" protected palm.
A motion was made by Board Member Permenter, seconded by Board Member Carroll,
and unanimously carried to direct the Building Official to issue a permit for the removal of
a 7" palm to be mitigated on site with a 17" palm located in the interior zone.

4. Old Business
A. Discussion and possible action to establish portions of Selva Marina Drive, North Sherry
Drive, Live Oak Lane, Hickory Lane,19`h Street, Oak Circle and Creekside Circle as a
Historic Preserve Corridor:
Building Official Ford advised that the first step to establish the Historic Preserve Corridor would
be to have a tree survey prepared which identified the trees in the corridor and adjacent to the
condor that the board would like to protect. Secondly, he stated that a resolution needed to be
presented to the City Commission which identified the streets as a proposed Historic Preserve
Corridor to protect trees and canopy. Building Official Ford informed the board that he would
prepare a proposed resolution for the board's approval which would include a request for funds
for the tree survey.
B. Approval of letter to scouts re study to locate the biggest trees in Atlantic Beach Parks:
Deferred to the next meeting.
6. Reports and Announcements
Building Official Ford distributed a handout with regard to Sunshine Laws and confirmed that
board members had received the Sunshine Law book. He advised that the book discussed what
could not be discussed outside a public meeting. He further stated that anything to be addressed
at a Tree Conservation Board meeting could not be discussed by Tree Board members outside the
public meeting. Building Official Ford added that two board members could not be on a lot
together and could not measure trees at the same time. Board Member Permenter suggested that
an orientation session be held for new members. Building Official Ford recommended that the
City Attorney attend one of the board meetings to discuss Sunshine Laws.
Discussion was held with regard to board members measuring trees on site. Building Official
Ford advised that it was the city's intent that board members drive by the properties to look at the
condition of the lot and adjacent properties, not measure trees. Board Member Permenter
reminded the Board that a motion had been made previously by Carol Rockwood, and approved
by the board, that directed staff to measure trees. After further discussion it was determined that
board members would no longer measure trees.
Building Official Ford advised that Chair Mears had given her verbal resigation from the Tree
Conservation Board.
7. Adjournment
There being no other business or discussion, the meeting was adjourned at 7:55 p.m.
