' at MINUTES OF • TREE CONSERVATION BOARD January 9, 2002 A regular meeting of the Tree Conservation Board was held Wednesday, January 9, 2002, in the City Hall Conference Room. Present were Richard Bell, Judith Jacobson, Barbara Mears, Carol Rockwood, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:04 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of December 15, 2001: A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve the Minutes of the Tree Conservation Board meeting of December 15, 2001. 4. Old Business None 5.A. New Business/Tree Removal Applications: 1. 1955 Beachside Court: Mrs. Catherine Benz introduced herself and her husband, James Benz. Mrs. Benz informed the Board that prior to beginning the installation of their new pool,they spoke with a new employee with the City of Atlantic Beach who advised them that they did not need to mitigate for pine • and palm trees. She stated that they tried to follow the correct process but they were given the wrong information. She further stated that after five palm trees were removed from the lot, the Deputy Building Official advised them that a tree removal permit was required for the removal of palms. Mrs. Benz informed the Board that they have replaced the five palm trees with five palm trees for 100 percent mitigation. Mr. Benz stated that the biggest tragedy is that the neither the pool contractor nor the contractor who removed the trees advised them that they needed a tree removal permit. After discussion the Board came to the conclusion that Mr. and Mrs. Benz acted in good faith and that this matter should be treated as an exception. A motion was made by Board Member Jacobson, seconded by Board Member Shaughnessy and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 50" of palm to be replaced with 50" of palm. 2. 1120 Ocean Boulevard: The applicant was not in attendance so the Board moved this item to the end of New Business. 3. 315 Eleventh Street: Mr. George Bull, Architect, introduced himself and stated that he was representing the owner in this matter. He stated that two palm trees that are within the confines of the building line need to be removed and that no mitigation is required. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of two non-protected palm trees. 4111 4. 347 Third Street(East 45' of Lot 16 and the west 1/2 of Lot 14): Mr. George Bull, Architect, introduced himself and stated that he was representing Sun and Sky Development Company who has a purchase agreement to purchase this property. He stated that this lot was 125' x 150' and would be Minutes of Tree Conservation Board January 9, 2002 Page 2 divided into two lots. He further stated that the residential structure and out-building would be removed • and two new duplexes would be constructed on the site. Building Official Ford advised that the Tree Conservation Board could not issue a permit to a non-owner. Mr. Bull advised that 328 Second Street is a similar situation so he suggested that Agenda Items 5.A.4, 5, 6 and 7 be postponed until the next Tree Conservation Board meeting to allow him time to get written authorization from the owners to proceed with these matters. 5. 347 Third Street (Lot 18 and the west 5' of Lot 16): The applicant, Mr. George Bull requested that this agenda item be deferred until the next Tree Conservation Board meeting. 6. 328 Second Street(Lot 7, Block 3, Plat No. 1, Subdivision "A"): The applicant, Mr. George Bull requested that this agenda item be deferred until the next Tree Conservation Board meeting. 7. 328 Second Street(Lot 9, Block 3, Plat No. 1, Subdivision "A"): The applicant, Mr. George Bull requested that this agenda item be deferred until the next Tree Conservation Board meeting. 2. 1120 Ocean Boulevard: The applicant was not present to address this application. The Board held a discussion and determined that they could proceed with this application. A motion was made by Board Member Bell, seconded by Board Member Shaughnessy and unanimously carried to approve the application and to direct the Building Official to issue a permit for the removal of 9" of oak to be replaced with 4.5" of oak on site. 6. Reports and Announcements A. Discuss 2002 Calendar: The Board discussed the meeting dates of November 27 and December 25. • Building Official Ford suggested that the Board meet only once in December unless there is a matter that needs immediate attention. A motion was made by Board Member Rockwood, seconded by Board Member Jacobson and unanimously carried to meet only on December 11 unless there is a pressing issue. A motion was made by Board Member Rockwood, seconded by Board Member Shaughnessy and unanimously carried that the Board changes the meeting dates of November 13 and November 27 to November 6 and November 20. Board Member Jacobson asked for an update on the Historic Tree Ordinance. Building Official Ford advised that the Board has approved the map identifying all the trees. He further stated that he has a rough draft of the Ordinance in his possession but has not had an opportunity to make the corrections. A discussion was held with regard to the safety of Board members visiting sites and the amount of time involved to verify tree surveys. 7.
