Adjournment 4111 If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose,may need to ensure that a verbatim record of the proceedings is made,which record shall include the testimony of evidence upon which appeal is to be based. • MINUTES OF TREE CONSERVATION BOARD July 2, 2001 A regular meeting of the Tree Conservation Board was held Monday, July 2, 2001, in the City Hall Commission Chambers. Present were Richard Bell, Camille Hunter, Barbara Mears, Judith Jacobson, Building Official Don Ford and Susan Dunham. 1. Call to Order Board Member Bell called the meeting to order at 7:30 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of June 18, 2001 A motion was made by Board Member Mears, seconded by Board Member Jacobson and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of June 18, 2001. 4.A. Old Business/Tree Removal Applications 1) None. 5.A. New Business/Tree Removal Applications: 1) Lot 36, Sevilla Gardens: Mr. Speros Hadjieseoglou introduced himself and stated that he would like to remove three maple trees and plant new oak or pear trees. Board Member Mears indicated that the three maple trees are actually one multi-trunk maple tree measuring 9", 10"and 12". She also indicated that the applicant could use a 6"oak and a 5"oak in the back of the property for mitigation. Building Official Ford advised that Mr. Hadjieseoglou received a tree removal permit approximately one year ago. He further advised that during the recent construction, Mr. Hadjieseoglou found that the turn into the garage could not be negotiated without removing this tree. The Board requested the survey from the original tree removal application; however, Building Official Ford advised that he was unable to locate it. The Board expressed concern that without the original application,they were unable to determine if the 6"oak and 5"oak had been used previously for mitigation. The applicant stated that he wants to plant new trees on the property anyway but would attempt to locate his copy of the original application. A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously carried to approve this request which amends the original application and adds the removal of 31" of maple tree to be mitigated with 15.5" of hardwood on site and the Building Official process this administratively upon receipt of the original application. 2) Lot 6, Block 82, Section H: Mr. Kato,the contractor for this application, introduced himself and stated that he needs to remove the indicated trees to place a new building on Lot 6. He further stated that he would like to replant some of the trees on Lots 4 and 5. Board Member Mears advised that the 22"oak is a 68"multi-trunk oak. Discussion was held with regard to the applicant attempting to obtain a variance to save the 68"oak. It was determined that if the applicant decides to apply for a variance,the Board would write a letter to the Community Development Board in support of granting this variance. • • Minutes of Tree Conservation Board July 2, 2001 Page 2 • A motion was made by Board Member Hunter, seconded by Board Member Mears and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 88" of oak to be mitigated with 44" of oak either on site or on Lots 4 or 5, Block 82, and that the newly planted oaks must be a minimum of 4". 3) Lots 1, 2, 3, 4, 5 and 6, Block 130, Section H: No applicant was present to address this application. A motion was made by Board Member Mears, seconded by Board Member Bell and unanimously carried to move this item to the end of New Business. 4) Lot 4, Block 148, Section H: Paul Nichols introduced himself and stated that he was representing Bestcon, Inc. He stated that he would like to remove the following trees: interior: 9"oak, 14"oak, 11" oak, 6"oak and 12"oak; exterior: 14"oak and 9"oak. He stated that he would like to mitigate with the 4"oak in the rear,the 5"oak in the front and one of the 2"oaks in the front. Board Member Hunter advised that a 3"tree is the minimum allowed for mitigation for existing trees on site. Building Official Ford stated that he would verify if the 2"oak and the 1"oak on the south side of the lot is a multi-trunk tree. The Board discussed the possibility of preserving an oak cluster. A motion was made by Board Member Hunter, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 23" of oak to be mitigated with 11.5" of oak, for mitigation a 4" oak a 5" oak and a multi-trunk consisting of two 2" trunks to be inspected by Building Official Ford to verify that they in fact are multi-trunk and joined at the base and, if not, to come back and notify the Board to reconsider the application. Mr.Nichols stated that he sees the spirit of the Ordinance is to preserve the trees in Atlantic Beach. He further stated that a tree native to Atlantic Beach is better than a newly planted tree found at a nursery. He suggested that the Ordinance could be worded to allow on-site mitigation regardless of the size of the tree and, if new trees have to be planted,then set a minimum. 5) Hidden Paradise Preliminary Tree Removal Application: Mr. Nichols advised that he will be out of town for the meeting scheduled for July 14 so his associate, Karen Beck, will be attending the meeting. Mr. Nichols displayed two surveys to the Board members for their review. He stated that he is required to mitigate approximately 608"and has 709"inches available and he would like to leave every one of those trees recognizing that not all of them are going to survive. He stated that a master survey would be available for the Board members for the meeting on July 14. 3) Lots 1, 2, 3, 4, 5 and 6, Block 130, Section H: The Board determined that the survey was inaccurate and the site was marked inaccurately. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to request the applicant to resubmit the application with a minimum 1:20 scale survey with the identification of the tree marked next to the tree,that all trees 6" and greater on the lot be indicated on the survey and that on the lot itself the trees that are going to be removed be identified with red ribbons and those trees that are going to be saved identified with blue ribbons. • A., • • Minutes of Tree Conservation Board July 2, 2001 Page 3 • An amendment to the motion was made byBoard Member Jacobson, econded byBoard Member Bell and unanimously carried to request the applicant to note multi-trunk trees and treat them as stated in the instructions on the application. 6. Reports and Announcements Building Official Ford distributed a copy of a memo to the City Commission with regard to the Jacksonville Transportation Authority Mayport Road retention pond tree mitigation contract. Building Official Ford advised that this item would be on the City Commission agenda for Monday night. He requested that Board members review the memo and call him prior to 5:00 p.m. tomorrow if any corrections needed to be made. A. Progress Report on Historical Tree Preservation Ordinance: Building Official Ford distributed a copy of the proposed Historical Tree Ordinance. He advised that the second page has been retyped to add the specific descriptions of additional palm trees on East Coast Drive that were not in the original Ordinance. He asked that the Board members review the draft Ordinance and let him know as soon as possible if there are any corrections to be made. Building Official Ford stated that he would like to bring the Ordinance to the next Tree Conservation Board meeting for final approval and then take it to the City Commission. Discussion was held with regard to recognizing indigenous tree canopy less than 4"and tree clusters. Board Member Hunter advised that oak clusters develop into weaker trees—they are more likely to be damaged in storms, more easily diseased, more competition for root systems and tend to form imbedded • bark which is a weaker spot in the tree. 7.
