' * --. MINUTES OF • TREE CONSERVATION BOARD November 5, 2001 A regular meeting of the Tree Conservation Board was held Monday,November 5, 2001, in the City Hall Conference Room. Present were Richard Bell, Judith Jacobson, Barbara Mears, Carol Rockwood, Maureen Shaughnessy, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order at 7:32 p.m. 2. Recognition of Visitors Commissioner Elect Paul Parsons introduced himself. 3. Approval of Minutes of Meeting of October 15, 2001 A motion was made by Board Member Jacobson, seconded by Board Member Rockwood and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of October 15, 2001. 4. Old Business A. Review of Request for Exception to Tree Mitigation Requirements for Lots 4 and 5,Block 244, Lots 4 and 5, Block 245, Section H: Building Official Ford distributed to the Board members a motion prepared by the City Attorney and signed by Mervyn Russell. Building Official Ford advised that the correct property address is Lots 4 and 5, Block 245, Section H, as indicated on the motion. Chairman Bell read the motion to the Board: Comes now, Mervyn Russell, and requests that the Tree Board • allow him an extension of time to complete tree mitigation at property located at Lots 4 and 5, Block 245, Section H, also known as 18-34-38-25-99E Section H,with a street address of 1405 Main Street. The required trees will be installed within ninety(90) days from the issuance of the Certificate of Occupancy. If the required trees are not installed at the end of the ninety (90) days from the issuance of the Certificate of Occupancy, the Building Official shall terminate the water service to the property. Mervyn Russell has agreed to the foregoing and will abide by it. This motion is executed this 5th day of November 2001. Building Official Ford advised that the Certificate of Occupancy would most likely be issued this month. A motion was made by Board Member Jacobson, seconded by Board Member Mears and unanimously approved that the motion regarding the property located at Lots 4 and 5,Block 245, Section H be approved as submitted by the Building Official. B. Tree Removal Applications: 1. South '/2 of Lot 10, Block 1, Donner's Replat: Mr. Thomas Huffman introduced himself to the Board. Mr. Huffman outlined the discussion that was held at the last Tree Conservation Board meeting and advised that Building Official Ford was to investigate the matter. Building Official Ford stated that he contacted HUD, who owns the property next door. He stated that they advised him that three trees were removed due to storm damage. He further stated that HUD is not able to get a tree removal permit for removal of trees on someone else's property and that they accept full responsibility. Mr. Huffman advised the Board that they would be constructing smaller units and,therefore,they would not be removing the 4.14"oak,the 12.74"oak and the 8.28"oak. Chairmen Bell determined that there • are no protected trees being removed from this property. • Minutes of Tree Conservation Board November 5, 2001 Page 2 • A motion was made by Board Member Mears, seconded by Board Member Rockwood and unanimously carried to approve the application and direct Building Official Ford to issue a permit since there are no protected trees being removed. 5. New Business A. Tree Removal Applications: 1. 377 8th Street: Mr. Kevin Byrnes introduced himself. He advised that he is building a home on this property and would like to remove four palm trees. He further advised that he would like to move the palms marked P5 and P8 but would have to discard the other two palm trees. A motion was made by Board Member Rockwood, seconded by Board Member Mears and unanimously carried to approve the application and direct Building Official Ford to issue a permit for the removal of 28" of palm to be mitigated with 14" of palm planted on site. Mr. Byrnes advised the Board that the bank assigned the street address of 377 but it is inaccurate. 2. Lot 2, Block 227, Section H: Building Official Ford advised that the Builder withdrew this application because the survey was inaccurate. 3. Lot 4, Block 227, Section H: Building Official Ford advised that the Builder withdrew this application because the survey was inaccurate. 4. Lot 7, Block 1, Ocean Grove, Unit#1: Building Official Ford stated that Mr. Adams was not able to • attend the meeting and requested that the Board review his application. Chairmen Bell stated that he reviewed the site and found the survey to be inaccurate. A motion was made by Board Member Shaughnessy, seconded by Board Member Mears and unanimously carried to defer this application until the applicant provides an accurate survey and presents it to the Board. 5. Lot 40& East % of Lot 2, Block 10, Subdivision "A": Building Official Ford advised the Board that Mr. Weber was not present to address his application. Board Member Jacobson expressed concern with regard to the location of the property line. Board Member Jacobson located trees on the survey to be used for mitigation but requested Building Official to verify their position at the site. A motion was made by Board Member Shaughnessy, seconded by Board Member Mears and unanimously carried to approve the application and direct Building Official Ford to issue a permit for the removal of 70.5" of water oak pending field verification of the placement of two live oaks and two water oaks to be used for mitigation. 6. Reports and Announcements: Chairmen Bell outlined the proposed Historical Tree Preservation Ordinance to Commissioner Elect Paul Parsons. Commissioner Elect Parsons stated that he would be glad to help in any way that he could. Commissioner Elect Paul Parsons thanked the Board members for allowing him to attend the meeting. 7.
