07-17-00 v • • • MINUTES OF TREE CONSERVATION BOARD JULY 17, 2000 A Regular Meeting of the Tree Conservation Board was held Monday, July 17, 2000, in the Commission Chambers located at 800 Seminole Road. Present were Mae Jones, Chairperson, Richard Bell, Judith Jacobson, and Camille Hunter. Also present were Building Official Don Ford and Julie Brandt. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:40 p.m. 2. Recognition of Visitors None. 3. Approval of the Minutes of the Meeting of July 5, 2000 • A motion was made by Board Member Jacobson, seconded by Board Member Hunter and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of July 5, 2000 as presented. 4. Old Business B. Tree Removal Applications 1. Lot 4, Block 102 Section H (Marsh Oaks) Mark Wheeler of 3537 Newcome Road, representing the owner of the property, presented a revised site plan/tree survey of the property and pointed out that the trees at the rear of the lot would not be removed. Chairperson Jones stated that she had inspected the property and expressed concern that several trees located at the front of the lot near the 7" camphor tree were not shown on the site plan. Board Member Bell concurred and pointed out that there were double 14" twin pines not noted on the plan. Chairperson Jones pointed out to Mr. Wheeler where additional trees should be located on the site plan. Discussion ensued and it was the consensus of the Board that a more accurate survey was • needed. The Board pointed out that it would be to the property owner's advantage to re-measure and accurately locate the trees with respect to mitigation and re-submit the application. • Minutes Page -2- July 17, 2000 A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to defer action on the application to allow the applicant to re-submit an accurate tree survey and amended application at the next regularly scheduled meeting. 5. New Business A. Tree Removal Applications 1. Parcels B and C on the Corner of Fifth Street and Sherry Drive James Watson, owner of the property owner, stated that he was saving fourteen of the seventeen trees located on Parcel C and all of the living trees on Parcel B. He further stated that the 15" and 18" palms on Parcel B, upon field review were found to be dead. He stated that all of the remaining palms on both parcels would be moved and relocated on their respective parcels. Board Member Bell inquired as to the type of foundation being installed. Mr. Watson responded that he was using stemwall foundations. Board Member Bell felt this type of footing would cut the 24" oak in half. Mr. Watson indicated that he would shift the foundation to the right. Board Member Bell stated that the same situation existed with the 30" hickory located at the back of the • property on Parcel C. Mr. Watson felt he would be able to save the tree since he had successes with saving trees in the past. Board Member Bell stated that the trees had to live for a year and it was really close to the foundation. Discussion ensued concerning the diameters of the trees submitted. Chairperson Jones felt the diameters were measured larger than they actually were. Mr. Watson indicated he wished to use the diameters as submitted. Board Member Jacobson indicated that a 24" Satin Palm, which was being moved, was a protected tree and must be documented. It was determined that mitigation could be one twelve inch palm moved on site. A motion was made Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application as submitted with 24" of protected palm to be mitigated with 12" of other palms planted on site. 2. Lots 1-22 Section 18,Township 2, Range 29E,Duval County (Paradise Cove Subdivision) Residential Development Paul Nichols, President of Bestcon Inc., developers of the property, introduced himself and briefly explained the proposed Paradise Cove development. Mr. Nichols verified the right-of- way lines,the house pad lines and pointed out the twenty foot front yards for the Board Members. ii• The Board Members determined that the application should include Lots 1 - 22, not just Lot 1 as • Minutes Page -3- July 17, 2000 indicated. It was decided that each lot should be discussed separately, and using the tree mitigation calculation sheet provided by Mr.Nichols,the Board addressed Lots 1-22 and recalculated the amount and types of trees to be removed and saved. Following a lengthy discussion, the Board arrived at the following figures for all of the lots and right-of-way: 163" of oak, 50" of pine and 42" of palm to be removed from the lots and street right-of-way requiring 81.5" of oak, 25" of hardwood and 21" of palm for mitigation. It was further determined that 197" of oak, 65" of palm and 68" of hardwood would be preserved on site. A motion was made by Board Member Bell, seconded by Board Member Hunter and unanimously carried to approve the application for the removal of 163" of oak, 42" of palm and 50" of hardwood trees from Lots 1-22 inclusive and the street right-of-way,to be mitigated by 81.5" of oak,21" of palm and 25" of hardwood to be preserved on site on Lots 1-22 and the right-of-way. These items will be delineated on a spreadsheet given to the Building Official noting how much is coming from each individual lot and the right-of- way. The applicant has noted that he has available 197" of oak, 65" of palm and 68" of hardwood to be preserved on site, and has agreed that in the event he might need to use any in case of accidental removal of a tree, they will be mitigated inch for inch at 100%. (The Building Official will monitor the removal of the trees as referenced on the spreadsheet upon issuance of a permit to remove the trees). The spreadsheet is attached and made part of • this official record as Attachment A. 6. Reports and Announcements Chairperson Jones • Inquired concerning filling the vacant seat on the Board and asked the status of the applications submitted by Mr. Smith and Mr. Showers. Building Official Ford stated he would look into this matter and report back to the Board. • Commented on the "For Sale" sign placed on the Russell property and inquired if he was trying to circumvent paying his mitigation costs for clear cutting the property. Building Official Ford indicated that he would investigate this matter and report back to the Board. Board Member Jacobson • Indicated that she would be absent for the August 7, 2000 meeting. Board Member Hunter • Indicated that she would also be absent for the August 7, 2000 meeting. • Building Official Ford • Minutes Page -4- July 17, 2000 • Commented on the non-native plant removal occurring on Sanibel Island. The Board Members felt this might be worth investigating, but felt it would be difficult to determine non-native plants. 7.
