MINUTES OF TREE CONSERVATION BOARD November 6, 2000 • A regular meeting of the Tree Conservation Board was held Monday,November 6, 2000, in the City Hall Commission Chambers. Present were Mae Jones, Chairperson, Richard Bell, Barbara Mears, Judith Jacobson, Building Official Don Ford and Susan Dunham. 1. Call to Order The meeting was called to order by Chairperson Jones at 7:35 p.m. 2. Recognition of Visitors None. 3. Approval of Minutes of Meeting of October 16, 2000 A motion was made by Board Member Mears and seconded by Board Member Bell to approve the Minutes of the Tree Conservation Board Meeting of October 16, 2000. Discussion was held and Board Member Bell requested that the Minutes be amended as follows: 5.A.5. Third paragraph: change"...the three relocated trees must live for one year"to"...the three relocated trees were protected and must live for one year". A motion was made by Board Member Mears, seconded by Board Member Bell and unanimously carried to approve the Minutes of the Tree Conservation Board Meeting of October 16, 2000, as amended. • 4. Old Business A. Tree Removal Applications 1. Amended Plan for 2055 Beach Avenue: Dr. James Campbell of 10 Tenth Street, Unit 48, The Cloisters, introduced himself as the owner of the property located at 2055 Beach Avenue. Dr. Campbell is presenting an amended plan for the Board's approval. Dr. Campbell advised that with respect to the initial plan,he was informed by the State that he could build approximately 4 feet beyond the present structure, plus a 12-foot uncovered front porch. In addition, with Mr. Ford's help, Dr. Campbell stated that they have received verbal approval from the State Department of Environmental Protection (DEP)to move the house 22 feet forward. Based on this verbal agreement,they are submitting this amended plan for approval. Dr. Campbell introduced his architect, Mr. Dick Gradick. Mr. Gradick introduced Mrs. Campbell to the Board. Mr. Gradick advised that the garage has been reduced by 500 square feet,the pool has been eliminated,the courtyard has been reduced by 1000 feet and the driveway will wind around to save protected trees. Mr. Gradick presents this amended plan in an attempt to satisfy the State,the City and the taxpayers. Board Member Bell expressed concern regarding accessibility of the garage. Mr. Gradick stated that if they do need more room,the east side of the dune does not have significant tree cover and could possibly be cut into and not affect the canopy. Chairperson Jones and Board Member Bell expressed their concern regarding the potential damage to existing trees if the retaining wall is moved further west. In response to a question from Chairperson Jones, Building Official Ford stated that a letter from the Tree Conservation Board to the DEP would likely assist the Campbells in the process of gaining IIIapproval to move the home seaward. In addition, Chairperson Jones expressed her concern that the Minutes of Tree Conservation Board . November 6, 2000 Page 2 trees be marked correctly. Mrs. Campbell assured the Board that someone would be on the site overseeing the construction. iA motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of a 10" palm, a 21" palm, a 13" palm and a 10" palm to be mitigated on site with a 15" palm and a 16" palm preserved on site. Discussion was held regarding writing a letter to DEP regarding the Campbell property. A motion was made by Board Member Bell, seconded by Board Member Jacobson and unanimously carried to write a letter to the State Department of Environmental Protection stating that the Campbells are protecting the dune and the tree canopy on the dune and, in doing so,this forces their house seaward of their original plan and that we give our recommendation that they should be permitted an extra 22 feet to be used for their structure. B. Jacksonville Transportation Authority Retention Pond on Mayport Road: This agenda item was addressed later in the meeting. C. Revised Plan for 589 Levy Road: This agenda item was addressed later in the meeting. 5. New Business A. Tree Removal Applications 1. 1983 Beach Avenue: This agenda item was addressed later in the meeting. • 2. Lot 4, Block 181, Section H: Paul Nichols of Bestcon submitted the following correction to the site plan: the 17"oak to the north of the drive is actually a 21"twin oak. Mr.Nichols advised that there are no protected trees being cut down to build the house. However,the 7"hickory on the south side of the house has to be removed because it grows over the house. Mr. Nichols stated that he would like to use for mitigation the 5"oak which is not marked on the survey but is located on the south side of the house just east of the 11"oak. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal of 7" of protected oak to be mitigated by the protection of a 5"oak on site. 1. 1983 Beach Avenue: Building Official Ford indicated that Mr. Bull was unable to attend and requested Building Official Ford to represent his application. Board Member Jacobson stated that the palm tree indicated in the application was not 16"in diameter,but could possibly be 16"in circumference. A motion was made by Board Member Jacobson, seconded by Board Member Bell and unanimously carried to approve the application and to direct Building Official Ford to issue a permit for the removal and replanting of one palm tree on the western boundary of the site. 4.B. Jacksonville Transportation Authority Retention Pond on Mayport Road: Building Official Ford stated that the drawing is a preliminary drawing submitted by the Jacksonville Transportation Authority. This drawing is for informational purposes only. Building Official Ford indicated that the Jacksonville Transportation Authority reduced the volume of the pond,which saved 14 trees, and changed the slope to a • Minutes of Tree Conservation Board . ' • November 6, 2000 Page 3 more gradual slope so that a fence is not required. Jacksonville Transportation Authority is still working on the final plans. 4.C. Revised Plan for 589 Levy Road: This agenda item was deferred until the next meeting. • Discussion was held and the Board requested that Building Official Ford prepare a letter to the State Department of Environmental Protection with regard to 2055 Beach Avenue. The letter is to include the following highlights: • Intent of the letter is to encourage or to allow the 22 feet requested by the Campbells • Due to the Board's concerns,the Campbells redesigned their plans, i.e., eliminated the pool, changed the character, decreased the living area, increased impermeable surface area and saved trees • Owners incurred additional costs • Emphasize the uniqueness of the lot • The single remaining back dune configured lot in Atlantic Beach • Significant landward dune • Significant and irreplaceable dune and trees • Negative impact on adjacent properties regarding erosion if dune removed 6. Reports and Announcements Chairperson Jones requested that Board members mention at the Board meetings when they receive their financial disclosure forms as a reminder for each other. Board Member Bell advised that he received a call from Mary Lou Boyer with regard to 2055 Beach Avenue. Mrs. Boyer profusely thanked the Board for the work they have done. Board Member Jacobson distributed a letter to the Commission she prepared with regard to requesting land • to be included into the Tide Views Preserve. The Board suggested attaching a list of the exceptional trees and Building Official Ford stated he could include a copy of the tree survey. Additional changes were made to the letter and it was requested that Susan Dunham type this letter on City letterhead and bring it to the next Tree Board meeting. Building Official Ford updated the Board on the status of the tree survey for the historic palms. Building Official Ford stated that he had meetings scheduled with two survey companies but both companies canceled the meetings. He will continue working on this issue. Board Member Bell asked about the status of the property located at the end of Jasmine Street that was cleared illegally. Building Official Ford will look into this property. 7.
