02-22-99 v • TREE CONSERVATION BOARD Minutes of meeting of February 22, 1999 The Board held its regular meeting on Monday February 22, 1999 at City Hall. Present were: Judy Jacobson Eloise Koerber Rick Bell Staff: George Worley, Community Development Director The meeting was called to order by Rick Bell at 7:39 PM. 3.A.1. Tree removal on Lots 4 & 5, Block 244, Lots 4 & 5, Block 245, Section"H": Mr. Merve Russell introduced himself to the Board as owner and explained his plans for this commercial property. He explained to the Board that he was not aware of the Tree Protection Ordinance and that he would not have started tree removal if he had known. Eloise Koerber asked about the difference in the number of trees • shown on the original and revised drawings. Mr. Russell explained that he had produced the original drawing himself and that he had assistance with the revised drawing. The Board asked if a site plan was available. Mr. Russell explained that it was not yet completed. After further discussion as to the need for removal of nearly all of the trees on the site, the Board deferred action on this item until the end of the agenda. 4.A.1. Tree removal on Lot 4, Block 161, Section"H": Paul Nichols introduced himself representing Bestcon, Inc. and explained his application. After discussion it was determined that 40" of protected oak were to be removed and that 10" of oak were to be protected on-site. Judy Jacobson moved to approve the application as submitted with 40" of protected oak to be removed and mitigation to be provided by protecting one 10" oak on-site and an additional 10 "of oak to be planted new. Eloise Koerber seconded the motion and the Board approved it unanimously. 4.A.2. Tree removal on Lot 1 &part of Lot 2, Block 194, Section"H": Paul Nichols was present for this item, also. He explained that in the future his applications will include 4" diameter trees to be used for mitigation where possible. The Board discussed and determined that the 8" diameter oak tree on the south side of the building is a protected tree, resulting in a total of 26" of protected trees to be removed. Judy Jacobson moved to approve the application for removal of 18" of protected pine and 8" of protected oak with mitigation of 4" of oak and 9" of hardwood to be provided by protecting 3 - 4" oak trees on-site and planting of 1" additional of hardwood. (Staff note: minimum replacement hardwood trees must be 2" in diameter) 4.A.3. Tree removal on Lot 10, Francis Cove: Dave Clark of Beaches Habitat introduced himself to the Board and explained his request. Mr. Clark also drew the Board members attention to the 18" pine at the • front of this lot in an area to be donated to the City of Atlantic Beach for vehicular access to the two lots north of this one. Rick Bell suggested preserving the two 5" oaks near the southeast corner of the lot as mitigation for the 18" pine. Mr. Clark agreed. Judy Jacobson moved to approve the application as submitted with the removal of the 18" pine tree mitigated by protecting on-site the two 5" oak trees at the , • southeast corner of the lot. Eloise Koerber seconded and the motion was passed. 4.A.4. Tree removal on Lot 11, Francis Cove: Mr. Clark also addressed this application. He explained the PP P difficulty in placement of the driveway because of the utility pole and several trees. After discussion the Board agreed that the 22" pine would be removed along with a 20" palm. Judy Jacobson moved to approve the application for removal of a 22" pine and a 20" palm with mitigation to be provided by protecting the 19" pine on-site and by planting 3" of hardwood on-site. Eloise Koerber seconded and the motion was approved. 4.A.5.Tree Removal at 1410 Beach Avenue: No applicant was present for this item. The Board discussed the application and determined that the tree proposed for removal was not subject to mitigation because of its location on the lot. Eloise Koerber moved to approve the application as submitted and noted that no mitigation is required because the tree is not protected. It was the consensus of the Board to recommend to the property owners that the tree be relocated elsewhere on the property if possible. Judy Jacobson seconded the motion which passed unanimously. 3.A.1. Tree removal on Lots 4 & 5, Block 244, Lots 4 & 5, Block 245, Section"H": the Board returned to the review of this item for determination of the number of inches of trees to be removed and the mitigation required. After a lot by lot review it was determined that 14" of oak and 76.5" of other hardwood were removed prior to permitting. It was further determined that 130.5" of oak and 129" of hardwoods were proposed for removal. The ordinance requires the replacement of the inches removed prior to permitting to be on a one for one basis. The Board agreed that, because of their unusual growth pattern, the two Crepe Myrtles on Lot 5, Block 244 would not be counted in the mitigation calculation. The remaining mitigation was calculated at 50% of the inches removed. Rick Bell moved to approve the application as • submitted for the removal of 130.5" of oak, 129" of hardwood subject to normal mitigation requirements, plus 14" of oak and 76.5" of hardwood at one to one mitigation, for a total of 79" of oak and 141" of hardwood. 11.5" of oak were identified as on-site mitigation leaving 67.5" of oak and 141" of hardwood mitigation to be planted new on-site. 5. Reports& Announcements. The Board discussed the use of the City Hall Conference Room for meeting when the agenda is relatively light because of its less formal atmosphere. 6. Approval of Minutes. The Board approved the Minutes of the Meeting of January 20, 1999, as amended and the minutes of February 1, 1999 with a minor correction of a date.
