Adjournment • If any person decides to appeal any decision made by the Tree Conservation Board at the above meeting, he will need a record of the proceedings, and for such purpose, may need to ensure that a verbatim record of the proceedings is made,which record shall include the testimony and evidence upon which appeal is to be based. • r % MINUTES OF • TREE CONSERVATION BOARD May 17, 1999 A regular meeting of the Tree Conservation Board was held Monday,May 17, 1999,in the City Hall Commission Chambers. Present were Mae Jones, Chairperson,Richard Bell, Judith Jacobson, Eloise Koerber, Camille Hunter and Staff Members George Worley and Susan Dunham. The meeting was called to order by Chairperson Mae Jones at 7:45 p.m. Tree Removal Applications 1. 617 Ocean Boulevard. No one in attendance to speak to this application to the Board. This property is anticipating construction within the next six months. Richard Bell moved to accept the application for the removal of one 6.36"protected tree to be mitigated with the 4' inch tree marked as No. 4 on plan. Judy Jacobson seconded the motion,which passed unanimously. 2. 2313 Oceanforest Drive West. Michael Bruce introduced himself to the Board as owner. His application addresses removal of two trees,a 36"oak and an 18"oak in the back yard for the purpose of installing a pool and bathroom cabana. Mae Jones raised the concern that the two 14"oaks marked for mitigation had been used previously for mitigation when the house was built. George Worley will attempt to locate the original site plans to see if this can be determined. Only the 36"oak is protected, requiring 18"of mitigation. Judy Jacobson moved that the application be approved as submitted with the condition that the two 14"oaks • designated as mitigating trees in the front part of the lot only be used for mitigation if they have not previously been used for mitigation. Camille Hunter seconded the motion,which passed unanimously. 3.,4., 5. Lots 2 and 3, all in Block 102, Section H: Paul Nichols attended on behalf of Bestcon, Inc. Mr.Nichols walked the lots last week and admitted that the trees were not marked correctly. The Board members found the site to be confusing and the survey inaccurate. Mae Jones commented on the Tallow tree. The Tallow tree is designated a nuisance tree by the State and the Board will not require mitigation for this tree;the Board will also not allow a Tallow tree for mitigation. Lot 4, Block 101: Mae Jones indicated to Mr.Nichols that the site plan shows using a 21"oak for mitigation. A 20"oak anywhere on the lot is protected and cannot be used as mitigation. Mr.Nichols suggested that he would use the 4"trees for mitigation. Judy Jacobson also advised Mr.Nichols that the site plan shows a 20"oak to be removed but it is not marked on the site and it is not listed on the cover sheet of the application. Lot 3, Block 101: Mae Jones pointed out to Mr.Nichols that this site plan indicates using an 8"and 9"oak for mitigation. These trees are protected so he cannot use them for mitigation. Richard Bell moved to defer all three of Mr.Nichols' applications. Camille Hunter seconded the motion,which passed unanimously. • 6. Lots 1, 2, 3 and 4, Block 40, Section H. Debbie Jackrel introduced herself to the Board and • noted that her site was marked incorrectly. Her business sells vans and minibuses,which are converted for the physically disabled. The lots addressed in the application are to be used for parking spaces for the vehicles until they are sold. Judy Jacobson expressed her concern that Ms. Jackrel understood that she would have to mitigate 156"hardwood, 12"oak and 45"palm. Board members asked Ms. Jackrel to provide an accurate tree survey on the property. Richard Bell moved to defer action on this request. Eloise Koerber seconded the motion,which passed unanimously. 7. 356/358 8th Street. Mae Jones found the survey to be inaccurate so she had asked that this property be removed from the agenda. Reports and Announcements. The Board discussed the issue of property having been before the Tree Board previously and trees used for mitigation more than once. The Board suggested adding to the application the following: "Has this property ever been before the Tree Board?Yes No Don't Know ". If anything but"No"is checked, it must be researched. George Worley will give the Board a report as to the feasibility of this. Mae Jones stated that quite a bit of time is spent by the Board members looking at property that is not correctly marked or surveyed. She indicated that she would be glad to look over the agenda package prior to mailing to Board members. It was agreed that Mae Jones would meet with Staff members when they put the next agenda packet together. • Camille Hunter expressed some concern regarding procedures for inspecting properties with occupied homes. George Worley invited Board members to see him if they would like an identification badge. George Worley showed the plans for Town Center Development,Phase III to the Board. Mae Jones expressed her concern regarding the City not coming before the Board for any proposed tree changes in this development and Bull Park. George Worley assured the Board that the City's permit process is the same as everyone else, and if they propose cutting trees,they will come before the Board. Camille Hunter will prepare a one-page list of nuisance trees to be given to all applicants. The list will be prefaced by the following: The State of Florida has identified the following as nuisance trees and,therefore,these trees will not require mitigation nor will they be considered acceptable for mitigation of non-nuisance trees. Camille Hunter and Eloise Koerber will hold a special workshop regarding the Historic Tree Preservation project. When they are ready to hold the workshop,they will contact George Worley several days in advance of the workshop so that he can post a public notice of the meeting. George Worley will mail to all Board members a rough draft of the ordinance enacting the program. The Board discussed Mr. Merve Russell. It was suggested that George Worley write a letter to Mr. Russell. • N.: 0: Approval of Minutes • Judy Jacobson moved to approve the Minutes of the meeting of April 19, Camille Hunter seconded and the motion carried.
